SUBJECT CATEGORY: Proposed Collection; Comment Request--Recordkeeping Requirements Under the Safety Regulations for Non-Full-Size Cribs

DATES: Written comments must be received by the Office of the Secretary not later than July 19, 2004.

DOCUMENT SUMMARY: As required by the Paperwork Reduction Act of 1995 (44 U.S.C. Chapter 35), the Consumer Product Safety Commission requests comments on a proposed three year extension of approval of information collection requirements in the safety regulations for nonfullsize cribs codified at 16 CFR 1500.18(a)(14) and Part 1509. These regulations were issued to reduce hazards of strangulation, suffocation, pinching, bruising, laceration, and other injuries associated with nonfullsize cribs. (A nonfullsize crib is a crib having an interior length greater than 55 inches or smaller than 49\3/ 4\ inches; or an interior width greater than 30\5/8\ inches or smaller than 25\3/8\ inches; or both.) The regulations prescribe performance, design, and labeling requirements for nonfullsize cribs. They also require manufacturers and importers of those products to maintain sales records for a period of three years after the manufacture or importation of nonfullsize cribs. If any nonfullsize cribs subject to provisions of 16 CFR 1500.18(a)(14) and Part 1509 fail to comply in a manner severe enough to warrant a recall, the required records can be used by the manufacturer or importer and by the Commission to identify those persons and firms who should be notified of the recall. The Commission will consider all comments received in response to this notice before requesting approval of this collection of information from the Office of Management and Budget.

SUPPLEMENTAL INFORMATION

The Commission staff currently estimates that there are approximately 16 firms required to annually maintain sales records of nonfullsize cribs. The staff further estimates that the average number of hours per respondent is five per year, for a total of 80 hours and an annual cost of $1,958. (80 hrs. x $24.48/hr. (Based on total compensation of all civilian workers in the U.S., September 2003, Bureau of labor Statistics) = $1,958).

B. Request for Comments

The Commission solicits written comments from all interested persons about the proposed renewal of this collection of information. The Commission specifically solicits information relevant to the following topics:
Whether the collection of information described above is necessary for the proper performance of the Commission's functions, including whether the information would have practical utility;
Whether the estimated burden of the proposed collection of information is accurate;
Whether the quality, utility, and clarity of the information to be collected could be enhanced; and
Whether the burden imposed by the collection of information could be minimized by use of automated, electronic or other technological collection techniques, or other forms of information technology.
