DOCUMENT SUMMARY: The Federal Communications Commission, as part of its continuing effort to reduce paperwork burdens, invites the general public and other Federal agencies to take this opportunity to (PRA) of 1995 (PRA), Public Law 10413. An agency may not conduct or sponsor a collection of information unless it displays a currently valid control number. Subject to the PRA, no person shall be subject to any penalty for failing to comply with a collection of information that does not display a valid control number. Comments are requested concerning (a) whether the proposed collection of information is necessary for the proper performance of the functions of the Commission, including whether the information shall have practical utility; (b) the accuracy of the Commission's burden estimate; (c) ways to enhance the quality, utility, and clarity of the information collected; and (d) ways to minimize the burden of the collection of information on the respondents, including the use of automated collection techniques or other forms of information technology.

Needs and Uses: 47 CFR 74.1251(b)(1) states that formal application on FCC Form 349 is required of all permittees and licensees for any of the following changes: Replacement of the transmitter as a whole, except replacement with a transmitter of identical power rating which has been certificated by the FCC for use by FM translator or FM booster stations, or any change which could result in the electrical characteristics or performance of the station. Upon the installation or modification of the transmitting equipment for which prior FCC authority is not required under the provisions of this paragraph, the licensee shall place in the station records a certification that the new installation complies in all respects with the technical requirements of this part and the terms of the station authorization.
Section 74.1251(c) requires FM translator licensee to notify the
FCC, in writing, of changes in the primary FM station being retransmitted.

section 3 of the Cable Television Consumer Protection and Competition Act of 1992 (47 U.S.C. 543).

Nature and Extent of Confidentiality: There is no need for confidentiality.
Needs and Uses: On May 3, 1993, the Commission released a Report
and Order and Further Notice of Proposed Rulemaking, MM Docket No. 92
266, FCC 93177, In the Matter of Implementation of sections of the
Cable Television Consumer Protection and Competition Act of 1992; Rate
Regulation. Among other things, the Report and Order implemented
section 3(a) of the Cable Television Consumer Protection and
Competition Act of 1992 wherein a local franchise authority (``LFA'')
must file with the Commission a written certification when it seeks to
regulate basic service cable rates. Subsequently, the Commission
developed FCC Form 328 to provide a standardized, simple form for LFAs to use when requesting certification.
