  <title><![CDATA[  Tomatoes Grown in Florida; Decreased Assessment Rate ]]></title>

  <description><![CDATA[ This rule decreases the assessment rate established for the 
Florida Tomato Committee (Committee) for the 200910 and subsequent 
fiscal periods from $0.0375 to $0.0275 per 25pound carton of tomatoes 
handled. The Committee locally administers the marketing order, which 
regulates the handling of tomatoes grown in Florida. Assessments upon 
Florida tomato handlers are used by the Committee to fund reasonable 
and necessary expenses of the program. The fiscal period begins August 
1 and ends July 31. The assessment rate will remain in effect 
indefinitely unless modified, suspended, or terminated.

  <title><![CDATA[  Pistachios Grown in California; Changes to Handling Regulations]]></title>

  <description><![CDATA[ This rule changes the handling regulations prescribed under 
Marketing Agreement and Order No. 983 (order), which regulate the 
handling of pistachios grown in California, Arizona, and New Mexico. 
The changes were recommended by the Administrative Committee for 
Pistachios (committee), which is responsible for local administration 
of the order. The changes bring the handling regulations into 
conformance with amendments to the order by including certain 
regulatory language previously contained in the order's provisions in 
the order's administrative rules and regulations, lifting the 
suspension of certain language, removing obsolete language, and 
revising references to renumbered order provisions.

  <title><![CDATA[  Pistachios Grown in California; Order Amending Marketing Order  No. 983]]></title>

  <description><![CDATA[ This final rule amends the marketing agreement and order for 
pistachios (order). The amendments were proposed by the Administrative 
Committee for Pistachios (Committee), which is responsible for local 
administration of the order. The amendments will: Expand the production 
area covered under the order to include Arizona and New Mexico in 
addition to California; authorize the Committee to reimburse handlers 
for a portion of their inspection and certification costs in certain 
situations; authorize the Committee to recommend research projects; 
modify existing order authorities concerning aflatoxin and quality 
regulations; modify the authority for interhandler transfers of order 
obligations; redesignate several sections of the order; remove 
previously suspended order provisions, and make other related changes. 
The amendments are intended to improve the operation and functioning of 
the marketing order program.

  <title><![CDATA[  Changes in Hourly Fee Rates for Science and Technology Laboratory  Services--Fiscal Years 2010-2012]]></title>

  <description><![CDATA[ The Agricultural Marketing Service (AMS) proposes changes in 
annual standard, appeal, overtime, and holiday hourly fee rates for 
fiscal years 20102012 for Science and Technology (S&T) Laboratory 
Services in order to recover anticipated laboratory program costs. The 
Agency is proposing to raise these rates to reflect, among other 
factors, national and locality pay increases for Federal employees and 
inflation, operating costs, instrumentation and training, equipment 
maintenance costs, and program and agency administrative overhead 
costs. This action also proposes miscellaneous changes for clarity.
</p><p>    Comments: Comments must be received on or before November 25, 2009.

Processed Pear Committee (PPC) for the 20092010 and subsequent fiscal

canning. The PPC is responsible for local administration of the 
marketing order regulating the handling of pears for processing grown 
in Oregon and Washington. Assessments upon handlers of pears for 
processing are used by the PPC to fund reasonable and necessary 
expenses of the program. The fiscal period for the marketing order 
begins July 1 and ends June 30. The assessment rate will remain in 
effect indefinitely unless modified, suspended or terminated.

  <title><![CDATA[  Cotton Research and Promotion Program: Referendum Procedures]]></title>

  <description><![CDATA[ This final rule establishes procedures which the Department of 
Agriculture (USDA) will use in conducting a referendum considering 
amendments to the Cotton Research and Promotion Order (7 CFR part 1205) 
(Order) implementing section 14202 of the Food, Conservation, and 
Energy Act of 2008, hereinafter the ``2008 Farm Bill.'' USDA is 
considering amendments to the Order in a separate action. Referenda 
among cotton producers and cotton importers are required by the Cotton 
Research and Promotion Act (Act) to implement, amend, continue, or when 
appropriate to suspend or terminate the Order or any of its provisions. 
The provisions of this rule would be used for all such referenda.

  <title><![CDATA[  Amendments to Mushroom Promotion, Research, and Consumer  Information Order]]></title>

  <description><![CDATA[ This rule amends provisions of the Mushroom Promotion, 
Research, and Consumer Information Order (Order) to reapportion 
membership of the Mushroom Council (Council) to reflect shifts in 
United States mushroom production as well as to add language to the 
powers and duties section of the Order allowing the Council the power 
to develop and propose good agricultural and handling practices and 
related activities for mushrooms. Section 10104 of the Food, 
Conservation and Energy Act of 2008 (2008 Farm Bill) amended sections 
1925(b)(2) and (c) of the Mushroom Promotion, Research, and Consumer 
Information Act of 1990 (Act). Specifically, section 10104 changed the 
Act's requirements for geographic regions used to appoint producer 
members of the Council from four to three, and adjusted the pounds 
required by each region for Council membership, which reallocated 
Council member representation in two of the three producer geographic

  <title><![CDATA[  Notice of 2009 National Organic Certification Cost-Share Program]]></title>

  <description><![CDATA[ This notice invites all States of the United States of 
America, its territories, the District of Columbia, and the 
Commonwealth of Puerto Rico, (collectively hereinafter called States) 
to submit an Application for Federal Assistance (Standard Form 424), 
and to enter into a cooperative agreement with the Agricultural 
Marketing Service (AMS) for the allocation of National Organic 
Certification CostShare Funds. The AMS has allocated $22.0 million for 
this organic certification costshare program commencing in Fiscal Year 
2008, and these funds will be annually allocated to States through 
cooperative agreements until exhausted. Funds are available under this 
program to States interested in providing costshare assistance to 
organic producers and handlers certified under the National Organic 
Program (NOP). States interested in obtaining costshare funds must 
submit an Application for Federal Assistance and enter into a 
cooperative agreement with AMS for allocation of funds.

  <title><![CDATA[  Egg Research and Promotion Order; Referendum Procedures ]]></title>

  <description><![CDATA[ This proposed rule would establish procedures which the USDA 
will use in conducting a referendum to determine whether egg producers 
favor increasing the assessment they pay to the American Egg Board 
(AEB) from a rate of 10 cents per 30dozen case of commercial eggs to 
15 cents per case. An amendment to increase the assessment rate in the 
Egg Research and Promotion Order will be implemented if it is approved 
by twothirds of the egg producers voting in the referendum or by a 
majority of producers voting if they produced twothirds of the eggs 
produced by all voters. These procedures would also be used for 
subsequent referenda. A proposed rule to increase the assessment rate 
is published separately in this issue of the Federal Register. AEB, 
which administers the Order, recommended this action to sustain and 
expand its national promotion, research, and consumer information 
program.

  <title><![CDATA[  Onions Grown in South Texas; Change in Regulatory Period ]]></title>

  <description><![CDATA[ The Department of Agriculture (USDA) is adopting, as a final 
rule, without change, an interim final rule that revised the regulatory 
period during which minimum grade, size, quality, and maturity 
requirements are in effect for onions grown in South Texas under 
Marketing Order No. 959 (order). The interim final rule shortened the 
regulatory period from March 1 through July 15 to March 1 through June 
4. The relaxation in the interim final rule was necessary to enable 
producers and handlers to compete more effectively in the marketplace.

  <title><![CDATA[  Kiwifruit Grown in California; Change in Reporting Requirements]]></title>

  <description><![CDATA[ This rule changes the reporting requirements currently 
prescribed under the marketing order that regulates the handling of 
kiwifruit grown in California. The order is administered locally by the 
Kiwifruit Administrative Committee (Committee). This rule requires 
handlers who ship 100,000 or more trays per season to file weekly 
shipment and price information with the Committee. Shipments of organic 
kiwifruit are exempt from this requirement. The Committee will use this 
information to prepare its marketing policy statements and annual 
reports and to provide timely information to the industry to assist  them in making<br/> [[Page 46307]]<br/>
marketing decisions throughout the season.

for fresh Florida citrus. The amendments are intended to improve the 
operation and administration of the order and provide the industry with 
additional tools for the marketing of fresh citrus.

  <description><![CDATA[ The Department of Agriculture (USDA) is adopting, as a final 
rule, without change, an interim final rule that relaxed the handling 
requirements prescribed under the California table grape marketing 
order (order) and the table grape import regulation. The interim final 
rule relaxed the minimum bunch size requirement for the 2009 season for 
grapes packed in containers holding 2 pounds net weight or less. Under 
the relaxation, up to 20 percent of the weight of such containers may 
consist of single clusters weighing less than one quarter pound, but 
with at least five berries each. The interim final rule was necessary 
to provide California desert grape handlers and importers the 
flexibility to respond to a marketing opportunity on a test basis for 
one season to meet consumer needs.

  <title><![CDATA[  Country of Origin Labeling of Packed Honey ]]></title>

  <description><![CDATA[ This interim final rule would establish a new regulation 
addressing country of origin labeling for packed honey bearing any 
official USDA mark or statement and would add a new cause for debarment 
from inspection and certification service for honey. The rule is 
necessary because section 10402 of the Food, Conservation and Energy 
Act of 2008 (2008 Farm Bill) amended the Agricultural Marketing Act of 
1946 to require country of origin labeling for honey if it contains 
official USDA grade marks or statements. The regulations governing 
inspection and certification would be amended to include a provision 
for country of origin labeling requirements for packed honey and for 
debarment of services if the country of origin labeling requirements 
are not met for packages of honey containing official USDA grade marks 
or statements.

issued under the California almond marketing order (order). The order 
regulates the handling of almonds grown in California and is

(Salmonella) treatment program by specifying that validation data must 
be both submitted to and accepted by the Board's Technical Expert 
Review Panel (TERP) for all treatment equipment prior to its use under 
this program. This will help ensure that all treatment equipment meets 
a 4log reduction of Salmonella in almonds.

  <description><![CDATA[ This rule decreases the assessment rates established for the 
Nectarine Administrative Committee and the Peach Commodity Committee 
(Committees) for the 200910 and subsequent fiscal periods. The 
Nectarine Administrative Committee (NAC) program decreased its 
assessment rate from $0.06 to $0.0175 per 25pound container or 
container equivalent of nectarines handled. The Peach Commodity 
Committee (PCC) program decreased its assessment rate from $0.06 to 
$0.0025 per 25pound container or container equivalent of peaches 
handled. The Committees locally administer the marketing orders which 
regulate the handling of nectarines and peaches grown in California. 
Assessments upon nectarine and peach handlers are used by the 
Committees to fund reasonable and necessary expenses of the programs. 
The fiscal periods run from March 1 through the last day of February. 
The assessment rates will remain in effect indefinitely unless 
modified, suspended, or terminated.

  <title><![CDATA[  User Fees for 2009 Crop Cotton Classification Services to Growers]]></title>

  <description><![CDATA[ The Agricultural Marketing Service (AMS) will raise user fees 
for cotton producers for 2009 crop cotton classification services under 
the Cotton Statistics and Estimates Act. These user fees also are

for this classification service was $2.00 per bale. This rule will 
raise the fee for the 2009 crop to $2.20 per bale. The proposed fee and 
the existing reserve are sufficient to cover the costs of providing 
classification services, including costs for administration and 
supervision.

potatoes handled under the marketing order for IdahoEastern Oregon

This rule would revise the size requirements to allow: Creamer size 
(\3/4\ inch to 1\5/8\ inches diameter) for all varieties of potatoes to 
be handled if the potatoes otherwise meet U.S. No. 1 grade; and round 
type potatoes to be handled without regard to size so long as the size 
is specified on the container in connection with the grade. The 
proposed changes are intended to improve the handling and marketing of 
IdahoEastern Oregon potatoes and increase returns to producers. The 
proposed changes would also allow the importation of Creamer size long 
type potatoes under regulations as authorized by section 8e of the

to the Dairy Promotion and Research Order. This proposed action is 
pursuant to the Farm Security and Rural Investment Act of 2002 (2002 
Farm Bill) and the Food, Conservation, and Energy Act of 2008 (2008 
Farm Bill). The 2002 Farm Bill mandates that the Dairy Promotion and 
Research Order be amended to implement an assessment on imported dairy 
products to fund promotion and research. The 2008 Farm Bill specifies a 
mandatory assessment rate of 7.5 cents per hundredweight of milk, or 
equivalent thereof, on dairy products imported into the United States. 
This proposed rule, in accordance with the 2008 Farm Bill, amends the 
term ``United States'' in the Dairy Production Stabilization Act of 
1983 (7 U.S.C. 45014514, as amended) to mean all States, the District 
of Columbia, and the Commonwealth of Puerto Rico. Producers in these 
areas will be assessed 15 cents per hundredweight for all milk produced 
and marketed.

proposed amendments to Marketing Agreement and Order No. 930 (order), 
which regulates the handling of tart cherries grown in Michigan, New 
York, Pennsylvania, Oregon, Utah, Washington, and Wisconsin. Seven 
amendments were proposed by the Cherry Industry Administrative Board 
(Board), which is responsible for local administration of the order. 
These proposed amendments would: Authorize changing the primary reserve 
capacity associated with the volume control provisions of the order; 
authorize establishment of a minimum inventory level at which all 
remaining product held in reserves would be released to handlers for 
use as free tonnage; establish an age limitation on product placed into 
reserves; revise the nomination and election process for handler 
members on the Board; revise Board membership affiliation requirements; 
and update order language to more accurately reflect grower and handler

  <title><![CDATA[  Peanut Standards Board ]]></title>

  <description><![CDATA[ The Farm Security and Rural Investment Act of 2002 requires 
the Secretary of Agriculture to establish a Peanut Standards Board 
(Board) for the purpose of advising the Secretary on quality and 
handling standards for domestically produced and imported peanuts. The 
initial Board was appointed by the Secretary and announced on December 
5, 2002. USDA seeks nominations for individuals to be considered for 
selection as Board members for terms of office ending June 30, 2011, 
and June 30, 2012. Selected nominees sought by this action would fill 
two currently vacant industry representative positions for the 
remainder of terms of office ending June 30, 2011, and six producer and 
industry representatives who are currently serving for the term of 
office that ends June 30, 2009. The Board consists of 18 members 
representing producers and industry representatives.

  <title><![CDATA[  Onions Grown in South Texas; Change in Regulatory Period ]]></title>

  <description><![CDATA[ This rule revises the regulatory period during which minimum 
grade, size, quality, and maturity requirements are in effect for 
onions grown in South Texas under Marketing Order No. 959 (order). The 
previous regulatory period for South Texas onions was March 1 to July 
15 of each year. The new regulatory period ends on June 4. Prior to 
this change, onions subject to order requirements from June 5 to July 
15 were present in the market at the same time as onions produced in 
other areas of the United States not regulated under Federal marketing 
orders. Changing the ending date of the regulatory period to June 4 
relaxes the regulatory requirements for onions covered under the order, 
and will enable producers and handlers to compete more effectively in 
the marketplace, and therefore, promote the orderly marketing of 
onions. The South Texas Onion Committee (Committee), which locally 
administers the order, unanimously recommended the change.

  <description><![CDATA[ The Agricultural Marketing Service (AMS) published a final 
rule in the Federal Register on July 20, 1992, on the Mushroom 
Promotion, Research, and Consumer Information Order (Order) referendum 
procedures. This rule established procedures for the conduct of a 
referendum to determine if producers and importers favored 
implementation of the Order. The procedures also apply to any 
subsequent referenda to amend, continue, or terminate the Order. As 
written, language to amend, suspend, or terminate the program was 
inadvertently omitted from the procedures. This document corrects that 
omission.

the Federal Register on March 3, 2008 (73 FR 11328). The document 
implemented amendments to the California walnut marketing order. 
However, that document inadvertently omitted a change that would make 
the term of office for California Walnut Board (Board) members 
correspond with the time period prescribed for the Board's marketing 
year. This correcting amendment changes the term of office of Board 
members from July 1 through June 30 to September 1 through August 31 to 
correspond with the Board's marketing year.

  <description><![CDATA[ This final rule terminates the Honey Research, Promotion, and 
Consumer Information Order (Honey Order) and its rules and regulations 
in their entirety. The Department previously proposed termination of 
the Honey Order because of the duplicative nature of the Honey Order 
with the new honey packers and importers program. This action is 
necessary because the results of a referendum conducted among honey 
first handlers and importers between April 2 and April 16, 2008, 
favored implementation of a new honey packers and importers program, 
and that program is now in effect. Therefore, termination of the Honey 
Order is appropriate.

  <title><![CDATA[  Irish Potatoes Grown in Colorado; Modification of the Handling  Regulation for Area No. 2]]></title>

  <description><![CDATA[ This rule modifies the minimum size requirement under the 
Colorado potato marketing order, Area No. 2. The marketing order 
regulates the handling of Irish potatoes grown in Colorado, and is 
administered locally by the Colorado Potato Administrative Committee, 
Area No. 2 (Committee). Currently, Colorado Area No. 2 potatoes must be 
U.S. No. 2 or better grade and most varieties must be at least 2 inches 
in diameter or 4 ounces in weight, except that round potatoes may be of 
any weight. For most long potato varieties, this rule changes the 
minimum size requirement from 2 inches in diameter to 1\7/8\ inches in 
diameter and removes the minimum weight requirement. This change is 
intended to improve the marketing of Colorado Area No. 2 potatoes and 
increase returns to producers as well as provide consumers with 
increased supplies of potatoes.

  <title><![CDATA[  Tomatoes Grown in Florida; Partial Exemption to the Minimum Grade  Requirements]]></title>

  <description><![CDATA[ The Department of Agriculture (USDA) is adopting, as a final 
rule, without change, an interim final rule providing a partial 
exemption to the minimum grade requirements under the marketing order 
for tomatoes grown in Florida (order). The order regulates the handling 
of tomatoes grown in Florida and is administered locally by the Florida 
Tomato Committee (Committee). Absent an exemption, Florida tomatoes 
covered by the order must meet at least a U.S. No. 2 grade before they 
can be shipped and sold outside the regulated area. This rule continues 
in effect the action that exempted Vintage Ripes\TM\ tomatoes (Vintage 
Ripes\TM\) from the shape requirements associated with the U.S. No. 2 
grade. This change increases the volume of Vintage Ripes\TM\ that meets 
the order requirements, and helps increase shipments and availability 
of these tomatoes.

  <title><![CDATA[  User Fees for 2009 Crop Cotton Classification Services to Growers]]></title>

user fees for cotton producers for 2009 crop cotton classification 
services under the Cotton Statistics and Estimates Act. These user fees 
also are authorized under the Cotton Standards Act of 1923. The 2008 
user fee for this classification service was $2.00 per bale. This 
proposal would raise the fee for the 2009 crop to $2.20 per bale. The 
proposed fee and the existing reserve are sufficient to cover the costs  of providing classification services, including costs for <br/>
administration and supervision.

  <description><![CDATA[ The Department of Agriculture (USDA) is adopting, as a final 
rule, without change, an interim final rule which decreased the 
assessment rate established for the Kiwifruit Administrative Committee 
(Committee) for the 200809 and subsequent fiscal periods from $0.045 
to $0.035 per 9kilo volumefill container or equivalent of kiwifruit. 
The Committee locally administers the marketing order which regulates 
the handling of kiwifruit grown in California. Assessments upon 
kiwifruit handlers are used by the Committee to fund reasonable and 
necessary expenses of the program. The fiscal period begins on August 1 
and ends July 31. The assessment rate will remain in effect 
indefinitely unless modified, suspended, or terminated.

requires the establishment of a National Organic Standards Board 
(NOSB). The NOSB is a 15member board that is responsible for 
developing and recommending to the Secretary a proposed National List  of Allowed and Prohibited Substances. The NOSB also<br/> [[Page 10879]]<br/>
advises the Secretary on all other aspects of the National Organic 
Program. The U.S. Department of Agriculture (USDA) is requesting 
nominations to fill five (5) upcoming vacancies on the NOSB. The 
positions to be filled are: organic producer (2 positions), retailer (1 
position), organic handler (1 position), and an environmentalist (1 
position). The Secretary of Agriculture will appoint a person to each 
position to serve a 5year term of office that will commence on January 
24, 2010, and run until January 24, 2015. USDA encourages eligible 
minorities, women, and persons with disabilities to apply for 
membership on the NOSB.

  <title><![CDATA[  United States Standards for Livestock and Meat Marketing Claims,  Naturally Raised Claim for Livestock and the Meat]]></title>

Management and Budget (OMB), for a new information collection for CFR 
Part 62Quality Systems Verification Program (QSVP). AMS established a 
voluntary standard for a naturally raised marketing claim that 
livestock producers may request to have verified by the Department of 
Agriculture (USDA). This standard will become effective once this 
information collection is approved by OMB. AMS verification of this 
claim would be accomplished through an audit of the production process 
in accordance with procedures that are contained in Part 62 of Title 7

  <description><![CDATA[ The Agricultural Marketing Service (AMS) announces that 
soybean producers may request a referendum to determine if producers 
want a referendum on the Soybean Promotion and Research Order (Order), 
as authorized under the Soybean Promotion, Research, and Consumer 
Information Act (Act). If at least 10 percent (not in excess of one
fifth of which may be producers in any one State) of the 589,182 
eligible producers, as determined by the Department of Agriculture 
(USDA), participate in the Request for Referendum, a referendum will be 
held within 1 year from that determination. If results of the Request 
for Referendum indicate that a referendum is not supported, a 
referendum would not be conducted. The results of the Request for 
Referendum will be published in a Notice in the Federal Register.

for the USDA's Agricultural Marketing Service (AMS).

  <description><![CDATA[ The Department of Agriculture (USDA) is adopting, as a final 
rule, with a change, an interim final rule revising the administrative 
rules and regulations governing nominations for the California Walnut 
Board (Board). The Board locally administers the marketing order that 
regulates the handling of walnuts grown in California (order). This 
rule continues in effect an action that removes references to 
independent handlers, revises specifications under which groups of 
growers may submit nominations for certain grower positions on the 
Board, and corrects numerical references to other sections of the 
order. These changes are needed to bring the administrative rules and 
regulations into conformance with recently enacted amendments to the 
order concerning Board structure and nomination procedures.

  <title><![CDATA[  Tart Cherries Grown in the States of Michigan, et al.; Final Free  and Restricted Percentages for the 2008-2009 Crop]]></title>

  <description><![CDATA[ This rule establishes final free and restricted percentages 
for the 20082009 crop year tart cherries covered under the Federal 
marketing order regulating tart cherries grown in seven States (order). 
The percentages are 73 percent free and 27 percent restricted and will 
establish the proportion of cherries from the 2008 crop which may be 
handled in commercial outlets. The percentages are intended to 
stabilize supplies and prices, and strengthen market conditions. The 
percentages were recommended by the Cherry Industry Administrative 
Board (Board), the body that locally administers the marketing order. 
The order regulates the handling of tart cherries grown in the States 
of Michigan, New York, Pennsylvania, Oregon, Utah, Washington, and 
Wisconsin.

  <title><![CDATA[  Grapes Grown in a Designated Area of Southeastern California and  Imported Table Grapes; Change in Regulatory Periods]]></title>

  <description><![CDATA[ This rule revises the regulatory period when minimum grade, 
size, quality, and maturity requirements apply to southeastern 
California grapes under Marketing Order No. 925 (order), and to 
imported grapes under the table grape import regulation, from April 20 
through August 15 of each year to April 10 through July 10 of each 
year. The order regulates the handling of grapes grown in a designated 
area of southeastern California and is administered locally by the 
California Desert Grape Administrative Committee (Committee). The 
change to the regulatory period beginning date is needed to ensure that 
imported table grapes marketed in competition with domestic grapes are 
subject to the grade, size, quality, and maturity requirements of the 
order. Section 8e of the Agricultural Marketing Agreement Act of 1937 
(Act) provides authority for such change. The change to the regulatory

  <title><![CDATA[  United States Standards for Livestock and Meat Marketing Claims,  Naturally Raised Claim for Livestock and the Meat]]></title>

  <description><![CDATA[ The Agricultural Marketing Service (AMS) is establishing a 
voluntary standard for a naturally raised marketing claim that 
livestock producers may request to have verified by the Department of 
Agriculture (USDA). This standard incorporates revisions made as a 
result of comments received from an earlier proposed standard. A number 
of livestock producers make claims associated with production practices 
in order to distinguish their products in the marketplace and there are 
a growing number of entities that are capturing valueadded 
opportunities by using alternative production methods to meet the 
demands of consumers and markets seeking meat and meat products from 
naturally raised livestock. This voluntary standard will allow 
livestock producers to utilize AMS' voluntary, third party verification 
services to provide validity to such naturally raised livestock claims 
and, in certain cases, access to markets that require AMS verification.

  <title><![CDATA[  Fruit, Vegetable, and Specialty Crops--Import Regulations;  Proposed Revision to Reporting Requirements]]></title>

  <description><![CDATA[ This rule revises the reporting requirements for imports of 
commodities regulated under section 608(e) (hereinafter referred to as 
``8e'') of the Agricultural Marketing Agreement Act of 1937. These 
changes require that the inspection certificates generated for each lot 
of such commodities include the entry number from the U.S. Customs and 
Border Protection (CBP or Customs) documentation that accompanies that 
lot. The changes also require that importers of raisins, dates, and 
dried prunes report products exempt from 8e import regulations on AMS 
Form FV6``Importers' Exempt Commodity Form,'' which is the same form 
that is currently used by importers of all other commodities exempt 
from 8e import regulations. These changes are intended to streamline 
the tracking of imported products and provide uniformity in electronic 
reporting systems used by the industries and the Department of 
Agriculture (USDA).

Class I prices in certain counties of the Mideast Federal milk

per hundredweight in 110 counties in the southern portion of the 
marketing area. The original hearing proposal to adjust Class I prices 
is recommended for adoption, except it is modified to recommend a $0.20 
increase in the Class I price at Charleston, West Virginia.

  <title><![CDATA[  Tomatoes Grown In Florida; Increased Assessment Rate ]]></title>

  <description><![CDATA[ This rule increases the assessment rate established for the 
Florida Tomato Committee (Committee) for the 200809 and subsequent 
fiscal periods from $0.0325 to $0.0375 per 25pound carton of tomatoes 
handled. The Committee locally administers the marketing order which 
regulates the handling of tomatoes grown in Florida. Assessments upon 
tomato handlers are used by the Committee to fund reasonable and 
necessary expenses of the program. The fiscal period begins August 1 
and ends July 31. The assessment rate will remain in effect 
indefinitely unless modified, suspended, or terminated.
