  <title><![CDATA[  Sweet Onions Grown in the Walla Walla Valley of Southeast  Washington and Northeast Oregon; Increased Assessment Rate]]></title>

  <description><![CDATA[ This rule increases the assessment rate established for the 
Walla Walla Sweet Onion Marketing Committee (Committee) for the 2008 
and subsequent fiscal periods from $0.21 to $0.22 per 50pound bag or 
equivalent of Walla Walla sweet onions handled. The Committee locally 
administers the marketing order which regulates the handling of sweet 
onions grown in the Walla Walla Valley of Southeast Washington and 
Northeast Oregon. Assessments upon Walla Walla sweet onion handlers are 
used by the Committee to fund the reasonable and necessary expenses of 
the program. The fiscal period begins January 1 and ends December 31. 
The assessment rate will remain in effect indefinitely unless modified, 
suspended, or terminated.

  <title><![CDATA[  Hazelnuts Grown in Oregon and Washington; Establishment of  Interim Final and Final Free and Restricted Percentages]]></title>

  <description><![CDATA[ The Department of Agriculture (USDA) is adopting, as a final 
rule, without change, an interim final rule establishing interim final 
and final free and restricted percentages for domestic inshell 
hazelnuts for the 20072008 marketing year under the Federal marketing 
order for hazelnuts grown in Oregon and Washington. This rule continues 
in effect the interim final free and restricted percentages of 8.1863 
and 91.8137 percent, respectively, and the final free and restricted 
percentages of 9.2671 and 90.7329 percent, respectively. The 
percentages allocate the quantity of domestically produced hazelnuts 
which may be marketed in the domestic inshell market (free) and the 
quantity of domestically produced hazelnuts that must be disposed of in 
outlets approved by the Board (restricted). Volume regulation is 
intended to stabilize the supply of domestic inshell hazelnuts to meet 
the limited domestic demand for such hazelnuts with the goal of  providing<br/> [[Page 35889]]<br/>

  <title><![CDATA[  Dairy Product Mandatory Reporting ]]></title>

  <description><![CDATA[ This final rule adopts amendments to the Dairy Product 
Mandatory Reporting Program that was established on August 2, 2007 on 
an interim final basis. The Dairy Market Enhancement Act of 2000, and 
certain provisions of the Farm Security and Rural Investment Act of 
2002, amended the Agricultural Marketing Act of 1946 to provide for 
timely, accurate, and reliable market information to facilitate more 
informed marketing decisions and promote competition in the dairy 
product manufacturing industry.

  <title><![CDATA[  Peanut Standards Board ]]></title>

  <description><![CDATA[ The Farm Security and Rural Investment Act of 2002 requires 
the Secretary of Agriculture to establish a Peanut Standards Board 
(Board) for the purpose of advising the Secretary on quality and 
handling standards for domestically produced and imported peanuts. The 
initial Board was appointed by the Secretary and announced on December 
5, 2002. USDA seeks nominations for individuals to be considered for 
selection as Board members for terms of office ending June 30, 2011. 
Selected nominees sought by this action would replace those six 
producer and industry representatives who are currently serving for the 
term of office that ends June 30, 2008. The Board consists of 18 
members representing producers and industry representatives.

Agriculture (USDA) is soliciting comments on the proposed revision to 
the United States Standards for Grades of Olive Oil. The proposal 
includes two major groups of oil: ``olive oil,'' produced from olives 
by mechanical means; and ``olivepomace oil,'' produced using heat and 
a solvent to separate the oil from the olivepomace remaining after 
olive oil is produced. The proposal includes new product descriptions, 
definitions, and requirements for the following grade designations: 
``U.S. Extra Virgin Olive Oil,'' ``U.S. Virgin Olive Oil,'' ``U.S. 
Lampante Virgin Olive OilNot Fit for Human Consumption,'' ``U.S. 
Refined Olive Oil,'' ``U.S. Olive Oil,'' ``U.S. OlivePomace Oil,''

  <title><![CDATA[  User Fees for 2008 Crop Cotton Classification Services to Growers]]></title>

  <description><![CDATA[ The Agricultural Marketing Service (AMS) will raise the user 
fees for cotton producers for 2008 crop cotton classification services 
under the Cotton Statistics and Estimates Act. These user fees also are 
authorized under the Cotton Standards Act of 1923. The 2007 user fee 
for this classification service was $1.85 per bale. This rule will 
raise the fee for the 2008 crop to $2.00 per bale. This fee and the  existing reserve are sufficient to cover the costs<br/> [[Page 30735]]<br/> of providing classification services, including costs for <br/>
administration and supervision.

  <title><![CDATA[  Pork Promotion, Research, and Consumer Information Program:  Submission of Information; Withdrawal of Proposed Rule]]></title>

13, 2003 [68 FR 11996], issue of the Federal Register, which intended 
to add a section to the regulations implementing the Pork Promotion, 
Research, and Consumer Information Order (Order) that would require 
remitters of pork checkoff assessments, upon request by the Department 
of Agriculture (USDA), to submit to the Agricultural Marketing Service 
(AMS) the names, addresses, and any other information deemed necessary  to identify persons from whom they collected assessments.</p><p>    This information would have been used to establish the total number 
of pork producers and importers in the United States, from which AMS 
would determine the number of respondents necessary to meet a threshold 
requirement of 15 percent to conduct a referendum, as contained in the 
Pork Promotion, Research, and Consumer Information Act. Based upon

  <title><![CDATA[  Pork Promotion, Research, and Consumer Information Program:  Request for Referendum]]></title>

  <description><![CDATA[ The United States Department of Agriculture's (USDA) 
Agricultural Marketing Service (AMS) intends to conduct a Request for 
Referendum among eligible pork producers and importers of hogs, pigs, 
pork, and pork products to determine if those persons want a referendum 
on the Pork Promotion, Research, and Consumer Information Order 
(Order), commonly known as the Pork Checkoff Program, as authorized by 
the Pork Promotion, Research, and Consumer Information Act of 1985.
</p><p>    The Request for Referendum is being conducted as a result of a 
settlement of a lawsuit entered into February 28, 2001, with USDA and 
the Michigan Pork Producers Association, Inc., et al. (Plaintiffs). 
Under the settlement agreement, USDA will conduct a Request for 
Referendum among eligible pork producers and importers to determine 
whether producers and importers favor holding a referendum on the Pork

  <title><![CDATA[  Establishment of Honey Packers and Importers Research, Promotion,  Consumer Education and Industry Information Order]]></title>

Research, Promotion, Consumer Education and Industry Information Order 
(Packers Order). The Packers Order is authorized under the Commodity 
Promotion, Research, and Information Act of 1996 (1996 Act). Under the 
Packers Order, first handlers and importers will pay an assessment of 
$0.01 per pound on honey and honey products. First handlers and 
importers of less than 250,000 pounds of honey and honey products 
annually will be exempt from the assessment. The assessments will be 
remitted to the Honey Packers and Importers Board (Board) to conduct a 
generic program of promotion, research, consumer education, and 
industry information to maintain and expand markets for honey and honey 
products. A referendum was conducted among honey first handlers and

56.54(a)(2), 7 CFR 70.76(a)(2) and 7 CFR 70.77(a)(5). The final 
regulations that are the subject of these corrections were to increase 
the minimum fees for rabbit grading and for nonresident egg and 
poultry grading services that had been effective since September 25, 
2005. Although the increases were included in the supplementary 
information, they were inadvertently omitted in the regulatory 
language.

  <title><![CDATA[  Avocados Grown in South Florida and Imported Avocados; Revision  of the Maturity Requirements]]></title>

  <description><![CDATA[ This rule revises the maturity requirements currently 
prescribed for avocados grown in South Florida and for avocados 
imported into the United States that are shipped to the fresh market. 
The Avocado Administrative Committee (Committee) which locally 
administers the marketing order for avocados grown in South Florida 
recommended the change for Florida avocados. A corresponding change in 
the import regulation is also required under section 8e of the 
Agricultural Marketing Agreement Act of 1937. This rule requires that 
avocados which fail the maturity requirements and are reworked and 
presented for reinspection must meet the maturity requirements which 
correspond to the date of the original inspection. This rule will help 
ensure only mature avocados are shipped to the fresh market.

  <description><![CDATA[ The Department of Agriculture (USDA) is adopting as a final 
rule, without change, an interim final rule which decreased the 
assessment rate established for the California Olive Committee 
(committee) for the 2008 and subsequent fiscal years from $47.84 to 
$15.60 per assessable ton of olives handled. The committee locally 
administers the marketing order which regulates the handling of olives 
grown in California. Assessments upon olive handlers are used by the 
committee to fund reasonable and necessary expenses of the program. The 
fiscal year began January 1 and ends December 31. The assessment rate 
will remain in effect indefinitely unless modified, suspended, or 
terminated.

  <description><![CDATA[ This proposed rule invites comments on revising the 
requirements regarding offgrade raisins under the Federal marketing 
order for California raisins (order). The order regulates the handling 
of raisins produced from grapes grown in California and is administered 
locally by the Raisin Administrative Committee (Committee). This 
proposed rule would revise the requirement that notification handlers 
must provide to the inspection service and the Committee when they 
perform certain functions on offgrade raisins be in writing, thereby 
allowing them to use other means of communication, including email. 
This proposed rule would also remove the requirement that handlers 
submit reports to the Committee regarding transfers of offgrade and 
other failing raisins. This action would bring the order's 
administrative rules and regulations in line with current industry 
practices.

in the Far West, by class that handlers may purchase from, or handle 
for, producers during the 20082009 marketing year, which begins on 
June 1, 2008. This rule establishes salable quantities and allotment 
percentages for Class 1 (Scotch) spearmint oil of 993,067 pounds and 50 
percent, respectively, and for Class 3 (Native) spearmint oil of 
1,184,748 pounds and 53 percent, respectively. The Spearmint Oil 
Administrative Committee (Committee), the agency responsible for local 
administration of the marketing order for spearmint oil produced in the 
Far West, recommended these limitations for the purpose of avoiding 
extreme fluctuations in supplies and prices to help maintain stability 
in the spearmint oil market.

user fee for this classification service was $1.85 per bale. This 
proposal would raise the fee for the 2008 crop to $2 per bale. The

voluntary survey would give customers of the PACA program an 
opportunity to provide feedback to AMS on the quality of the service 
they receive via the PACA Customer Service Line. It would also give

California and is administered locally by the Administrative Committee 
for Pistachios (committee). This rule continues in effect the action 
that suspended the minimum quality requirements, including maximum 
defects and minimum sizes, for California pistachios. This reduces 
handler costs and provides handlers more flexibility in meeting 
customer needs.

2.76% to 7.74% to cover the increase in salaries of Federal employees, 
salary increases of State employees cooperatively utilized in

responsible for local administration of the order. The amendments would 
authorize the establishment of different outgoing quality requirements 
for different markets and would authorize the establishment of bulk

for the marketing of almonds.

the South Texas Onion Committee (Committee) for the 200708 and

order which regulates the handling of onions grown in South Texas. 
Assessments upon onion handlers are used by the Committee to fund 
reasonable and necessary expenses of the program. The fiscal period 
begins August 1 and ends July 31. The assessment rate would remain in 
effect indefinitely unless modified, suspended, or terminated.

  <title><![CDATA[  United States Standards for Grades of Table Grapes (European or  Vinifera Type)]]></title>

  <description><![CDATA[ This proposed rule would revise the United States Standards 
for Grades of Table Grapes (European or Vinifera Type). These standards 
are issued under the Agricultural Marketing Act of 1946. The changes 
being proposed are based on the request of the California Grape and 
Tree Fruit League (CGTFL) to revise the tolerances to include an 
allowance for shattered berries due to the change of pack style from 
mostly plain pack to consumer size units. The Agricultural Marketing 
Service (AMS) of the Department of Agriculture (USDA), is proposing a 
revision to the voluntary standards to add a 5 percent allowance for 
shattered berries in consumer containers for shipment that are en route 
or at destination. The standards provide industry with a common 
language and a uniform basis for trading, thus promoting the orderly 
and efficient marketing of European or Vinifera Type table grapes.

restricted percentages for domestic inshell hazelnuts for the 20072008 
marketing year under the Federal marketing order for hazelnuts grown in

percentages are 8.1863 and 91.8137 percent, respectively, and the final 
free and restricted percentages are 9.2671 and 90.7329 percent, 
respectively. The percentages allocate the quantity of domestically 
produced hazelnuts which may be marketed in the domestic inshell market 
(free) and the quantity of domestically produced hazelnuts that must be 
disposed of in outlets approved by the Board (restricted). Volume 
regulation is intended to stabilize the supply of domestic inshell 
hazelnuts to meet the limited domestic demand for such hazelnuts with

salable quantities and allotment percentages for Class 1 (Scotch) 
spearmint oil of 993,067 pounds and 50 percent, respectively, and for 
Class 3 (Native) spearmint oil of 1,184,748 pounds and 53 percent, 
respectively. The Spearmint Oil Administrative Committee (Committee), 
the agency responsible for local administration of the marketing order 
for spearmint oil produced in the Far West, recommended these 
limitations for the purpose of avoiding extreme fluctuations in 
supplies and prices to help maintain stability in the spearmint oil 
market.

regulates the handling of avocados grown in South Florida. The 
amendments are based on those proposed by the Florida Avocado

administration of the order. The amendments will: Add authority for the 
committee to borrow funds; revise voting requirements for changing the 
assessment rate; allow for District 1 nominations to be conducted by 
mail; and, add authority for the committee to accept voluntary 
contributions. All of the proposals were favored by avocado growers in 
a mail referendum, held July 23 through August 6, 2007. The amendments 
are intended to improve the operation and functioning of the marketing 
order program.

  <title><![CDATA[  Irish Potatoes Grown in Colorado; Modification of the Handling  Regulation for Area No. 2]]></title>

  <description><![CDATA[ This rule modifies the minimum size requirements under the 
Colorado potato marketing order, Area No. 2. The marketing order 
regulates the handling of Irish potatoes grown in Colorado, and is 
administered locally by the Colorado Potato Administrative Committee, 
Area No. 2 (Committee). The minimum size requirements for Area No. 2 
potatoes specify that potatoes handled under the marketing order must 
be at least 2 inches in diameter or 4 ounces in weight, with exceptions 
allowing the handling of round potatoes of any weight, and Russet 
Burbank, Russet Norkotah, and Silverton Russet potato varieties with a 
minimum of 1\7/8\ inches in diameter or 4 ounces in weight. This rule 
removes the exception that Russet Burbank, Russet Norkotah, and 
Silverton Russet potato varieties may be 1\7/8\ inches in diameter, 
thus requiring these varieties to also meet the minimum requirements of 
2 inches in diameter or 4 ounces in weight. This change is intended to

(USDA) determination not to conduct a continuance referendum regarding

of 1990. This determination is based on the results of a signup period 
conducted September 3 through November 30, 2007, during which eligible 
cotton producers and importers were provided an opportunity to request 
a continuance referendum.

  <description><![CDATA[ Notice is hereby given of a public hearing to receive evidence 
on proposed amendments to Marketing Agreement No. 84 and Order No. 905 
(order), which regulate the handling of oranges, grapefruit, 
tangerines, and tangelos (citrus) grown in Florida. Four amendments are 
proposed by the Citrus Administrative Committee (committee), which is 
responsible for local administration of the order. These proposed 
amendments would: modify committee representation by cooperative 
entities; allow additional alternates to represent absent members of 
the committee to better meet quorum requirements; add authority to  conduct committee meetings by telephone or other means of <br/>
communication; and add authority for marketing promotions, including 
paid advertising, and production research for fresh Florida citrus. In 
addition, the Agricultural Marketing Service (AMS) proposes to make any 
such changes as may be necessary to the order to conform to any

  <title><![CDATA[  National Fluid Milk Processor Promotion Program: Invitation To  Submit Comments on Proposed Amendments to the Fluid]]></title>

  <description><![CDATA[ This document invites comments on a proposed amendment to the 
Fluid Milk Promotion Order (Order). The proposed amendment, requested 
by the National Fluid Milk Processor Promotion Board (Board), which 
administers the Order, would reduce the burden of latepayment charges 
applied to processors who underreport the amount of assessments which 
they owe to the Board, provided that the processor has not made more 
than two reporting errors in the prior 12 months. This amendment would 
reduce the burden of latepayment charges on processors who underpay 
assessments due to unintentional errors or miscalculations. The Board 
believes the latepayment charge is a necessary provision of the Order 
to encourage payment by all processors subject to the assessment and 
helps ensure the receipt of assessments owed to the Board. However, the 
Board also believes that there are instances when unintentional errors 
and miscalculations occur, and in such cases, the latepayment charge

  <title><![CDATA[  Domestic Dates Produced or Packed in Riverside County, CA;  Decreased Assessment Rate]]></title>

  <description><![CDATA[ The Department of Agriculture (USDA) is adopting, as a final 
rule, without change, an interim final rule which decreased the 
assessment rate established for the California Date Administrative 
Committee (committee) for the 200708 and subsequent crop years from 
$0.95 to $0.75 per hundredweight of dates handled. The committee 
locally administers the marketing order which regulates the handling of 
dates grown or packed in Riverside County, California. Assessments upon 
date handlers are used by the committee to fund reasonable and 
necessary expenses of the program. The crop year began October 1 and 
ends September 30. The assessment rate will remain in effect 
indefinitely unless modified, suspended, or terminated.

Vegetable Industry Advisory Committee (Committee) meeting that is open

the Committee to examine the full spectrum of issues faced by the fruit 
and vegetable industry and to provide suggestions and ideas to the 
Secretary of Agriculture on how USDA can tailor its programs to meet 
the fruit and vegetable industry's needs. This notice sets forth the
