To implement the President's plan, the Department's Office of Vocational and Adult Education (OVAE), as authorized by the Adult Education and Family Literacy Act and through a contract, has developed and created the U.S.A. Learns Web Portal, an online learning environment designed for limited English proficient (LEP) adults whose level of English proficiency is at a low level. On June 26, 2008, we published in the Federal Register (73 FR 36305) a notice inviting applications for the Statewide Longitudinal Data Systems FY 2009 competition. That notice established a September 25, 2008, deadline date for eligible applicants to apply for funding under this program. As a result of the notice published on June 26, 2008, 34 eligible entities submitted applications. A number of applicants, however, experienced difficulty with submitting their applications electronically, and, as a result, a few applications were received shortly after the original deadline.

In order to ensure fairness and afford as many eligible applicants as possible an opportunity to be considered for funding under this program, we are reopening the Statewide Longitudinal Data Systems FY 2009 competition to eligible applicants that were not able to submit applications by the original deadline date. Thus, we will consider as received timely, all of the applications we received through Grants.gov to this

Office of Management; Notice of Membership of the Performance Review Board

The Secretary announces the members of the Performance Review Board (PRB) for the Department of Education for the Senior Executive Service (SES) performance cycle that ends September 30, 2008. Under 5 U.S.C. 4314(c)(1) through (5), each agency is required to establish one or more PRBs.

Composition and Duties

The PRB of the Department of Education for 2008 is composed of career senior executives, noncareer senior executives, and Presidential appointees.

The PRB reviews and evaluates the initial appraisal of each senior executive's performance, along with any comments by that senior executive and by any higherlevel executive or executives. The PRB makes recommendations to the appointing authority relative to the performance of the senior executive, including recommendations on performance awards. The Department of Education's PRB also makes recommendations on SES pay adjustments for career senior executives. Membership

We announce our intention to establish negotiated rulemaking committees to prepare proposed regulations under Title IV and, possibly, Title II of the Higher Education Act of 1965, as amended (HEA). The committees will include representatives of organizations or groups with interests that are significantly affected by the subject matter of the proposed regulations. We also announce six public hearings, at which interested parties may suggest issues that should be considered for action by the negotiating committees. In addition, for anyone unable to attend a public hearing, we announce that the Department will accept written comments.

The Secretary of Education requests comments on the Free Application for Federal Student Aid (FAFSA) that the Secretary proposes to use for the 20092010 award year. The FAFSA is completed by students and their families and the information submitted on the form is used to determine the students' eligibility and financial need for financial aid under the student financial assistance programs authorized under Title IV of the Higher Education Act of 1965, as amended (Title IV, HEA Programs).

The Department acknowledges the recent passage of the Higher Education Opportunity Act (HEOA) of 2008 and its instruction to the Department to simplify the Federal Student Aid application process, to reduce the number of questions on the FAFSA form, to create a FAFSAEZ form, and to revise the form so that it contains consumer friendly language as well as take other measures to streamline the process of applying for federal student aid. The Secretary proposes to continue the use in fiscal year (FY) 2009 of priorities that the Department of Education (Department) previously established for use in any discretionary

grant program competition in FY 2007 and FY 2008. We take this action in order to continue to focus Federal financial assistance on expanding the number of programs and projects Departmentwide that support activities in areas of greatest educational need. We are proposing to continue the use of the priorities on a Departmentwide basis, so that Department offices can use one or more of these priorities in any discretionary grant competition, as appropriate.
