In accordance with the Privacy Act of 1974, as amended (Privacy Act), the U.S. Department of Education (Department) publishes this notice of a new system of records entitled ``National Longitudinal Transition Study2 (NLTS2)'' (181323).

In 2001, the Department funded the NLTS2 to provide a national picture of the characteristics, experiences, and outcomes of secondary school students with disabilities as they complete secondary school and transition to young adulthood. NLTS2 includes the study of a sample of more than 11,000 youth from the population of 13 through 16 year olds receiving special education services in seventh grade or above in December of 2000. The sample is nationally representative of the types of disabilities, as defined by the 12 Federal special education disability categories, in this population.

Federal Student Financial Assistance Programs Under Title IV of the Higher Education Act of 1965, as Amended

The Secretary of Education invites institutions of higher education that participate in the student assistance programs authorized under title IV of the Higher Education Act of 1965, as amended (the HEA), or consortiums of such institutions, to propose ideas for institutionally based experiments designed to test new ways of administering the student financial assistance programs authorized by title IV of the HEA (the Title IV, HEA programs). This effort is called the Experimental Sites Initiative (ESI). This notice is the first of two notices that the Secretary will publish regarding the ESI.

Under section 487A(b) of the HEA, the Secretary has the authority to grant waivers from specific Title IV, HEA statutory or regulatory requirements to allow institutions to test alternative methods for administering the Title IV, HEA programs. The Secretary of Education requests comments on the Free Application for Federal Student Aid (FAFSA) that the Secretary proposes to use for the 20102011 award year. The FAFSA is completed by students and their families, and the information submitted on the form is used to determine the students' eligibility and need for financial aid under the student financial assistance programs authorized under Title IV of the Higher Education Act of 1965, as amended (Title IV, HEA Programs).

The Department is committed to improving the federal student aid application process for individuals completing the Free Application for Federal Student Aid (FAFSA). Because 99 percent of student applicants opt to apply electronically, much of the Department's recent improvements have focused on FAFSA on the Web which maximizes the use of `skip logic' and previously submitted FAFSA data, to dramatically reduce applicant's burden. The U.S. Secretary of Education (Secretary) proposes requirements for School Improvement Grants authorized under section 1003(g) of Title I of the Elementary and Secondary Education Act of 1965, as amended (ESEA), and funded through both the Department of Education Appropriations Act, 2009 and the American Recovery and Reinvestment Act of 2009 (ARRA). The proposed requirements would define the criteria that a State educational agency (SEA) must use to award school improvement funds to local educational agencies (LEAs) with the lowestachieving Title I schools that demonstrate the greatest need for the funds and the strongest commitment to use those funds to provide adequate resources to their lowestachieving Title I schools in order to raise substantially the achievement of the students attending those schools. The proposed requirements also would require an SEA to give priority, through a waiver under section 9401 of the ESEA, to LEAs that also wish to serve the lowestachieving secondary school

Vocational Rehabilitation Service Projects for American Indians With Disabilities

The Secretary amends the regulations for the American Indian Vocational Rehabilitation Services (AIVRS) program to permit a consortium of Indian Tribes to establish a separate legal entity to apply for a grant under this program. This change is needed to provide the flexibility required by the Department to make grants to Indian Tribes that choose to form a consortium and, rather than authorizing one of the Indian Tribes of the consortium to serve as the grantee, create a separate legal entity that serves as the grantee on behalf of the consortium and that is responsible for using the grant funds to provide services to all the Indian Tribes in the consortium.

The original notice for the FY 2009 DC School Choice Incentive Program competition established a May 26, 2009, deadline date for eligible applicants to apply for funding under this program. The notice in the Federal Register required applicants for this competition to submit their applications in paper format by mail or hand delivery. The application package and instructions on the Department's Web site, however, mistakenly instructed applicants to use the eGrants.ed.gov Web site. Because of the differing instructions, we are reopening and establishing a new deadline for the submission of applications for the FY 2009 competition for the DC School Choice Incentive Program competition. Section 106 of the Higher Education Opportunity Act 2008 (HEOA) suspended the activities of NACIQI and terminated the existing membership on August 14, 2008. The law also stated that the appointment of any new members could not take place until after January 31, 2009. In addition, section 106 restructured the NACIQI's membership to provide for 18 members, six of whom shall be appointed by the Secretary of Education (Secretary). At this time, the Secretary invites interested parties to submit nominations for the six positions to be filled by the Secretary. State Fiscal Stabilization Fund Program

Under the State Fiscal Stabilization Fund (Stabilization) program, authorized in Title XIV of the American Recovery and Reinvestment Act of 2009 (ARRA), Public Law 1115, the U.S. Department of Education (Department) awards grants on a formula basis to Governors to help stabilize State and local government budgets in order to minimize and avoid reductions in education and other essential public services. The Department is awarding Stabilization funds in two phases. In Phase 1, the Department will award 67 percent of the total funds available to a State, unless the State can demonstrate that additional funds are required to restore fiscal year 2009 State support for education. On January 16, 2009, we published in the Federal Register (74 FR 3005) a notice inviting applications for the new awards for fiscal year (FY) 2009 under the Higher Education Disaster Relief Program. On January 26, 2009, we published in the Federal Register (74 FR 4417) a notice correcting the date for transmittal of preapplications and the date for transmittal of applications. The January 26, 2009 notice established a new February 4, 2009 deadline date for eligible applicants to submit a preapplication for this funding. The January 26, 2009 notice also provided that only applicants who timely submitted a preapplication and received an email from

the Department with the applicant's calculated allotment for an award were eligible to submit an application by the new March 19, 2009 application deadline.

Education (Secretary) intends to repay to the Northwest Indian College (NWIC) an amount that represents approximately 57 percent of the amount of funds recovered by the Department of Education (Department) as a result of final audit determinations for audit findings covering fiscal years 19992001. The Department's recovery of funds followed resolution of the audit disallowances identified in a September 30, 2004 Program Determination Letter (PDL) issued by the Office of Vocational and Adult Education (OVAE) for the period of July 1, 1999 through November 26, 2001. The PDL sought recovery of $316,096. On December 1, 2004, NWIC appealed the monetary findings in the September 30, 2004 PDL to the Department's Office of the Administrative Law Judges (OALJ). In accordance with the Privacy Act of 1974, as amended (Privacy Act), the Department of Education (Department) publishes this notice of a new system of records entitled ``Evaluation of Moving High Performing Teachers to LowPerforming Schools'' (181321). The National Center for Education Evaluation and Regional Assistance at the Department's Institute of Education Sciences (IES) commissioned this evaluation.
