Temporary Agricultural Employment of H-2A Aliens in the United States

The Department of Labor (Department or DOL) is further amending its regulations to extend the transition period of the application filing procedures currently in effect for all H2A employers with a date of need before January 1, 2010, as established in the H2A Interim Final Rule (IFR) published on April 16, 2009. The transition period is hereby extended to include all employers with a date of need before June 1, 2010.

In accordance with Section 223 of the Trade Act of 1974, as amended (``Act''), 19 U.S.C. 2273, and Section 246 of the Trade Act of 1974 (26 USC 2813), as amended, the Department of Labor issued a Certification of Eligibility to apply for Worker Adjustment Assistance and Alternative Trade Adjustment Assistance on July 1, 2009, applicable to workers of Ecoquest Holdings Corporation, Greeneville, Tennessee. The notice was published in the Federal Register on August 19, 2009 (74 FR 41932).

At the request of the State agency, the Department reviewed the certification for workers of the subject firm. The workers are engaged in activity related to the production of air and water purification units.

Announcement regarding Colorado, Maryland, and Texas triggering ``on'' to the SecondTier of Emergency Unemployment Compensation (EUC08).

Public law 110449 created a SecondTier of benefits for qualified unemployed workers claiming benefits in high unemployment states. The Department of Labor produces a trigger notice indicating which States qualify for the SecondTier of EUC08 benefits and provides the beginning and ending dates of the SecondTier period for each qualifying state. The trigger notice covering State eligibility for the SecondTier of the EUC08 program can be found at: http:// ows.doleta.gov/unemploy/claims_arch.asp. A new trigger notice is posted at this location each week that the program is in effect.

By application dated February 19, 2009, the petitioner requested administrative reconsideration of the negative determination regarding workers' eligibility to apply for Trade Adjustment Assistance (TAA) and Alternative Trade Adjustment Assistance (ATAA) applicable to workers and former workers of the subject firm. The determination was issued on February 6, 2009. The Notice of Determination was published in the Federal Register on March 3, 2009 (74 FR 9283).

The initial investigation resulted in a negative determination based on the finding that imports of cigarettes did not contribute importantly to worker separations at the subject firm. The investigation revealed that the subject firm shifted production of cigarettes to foreign countries during the period under investigation. However, these products were not likely to be imported back to the United States.

The Department, on its own motion, reopened its investigation for workers and former workers of TeckWashington, Inc., Pend Oreille Mine, Metaline Falls, Washington. The workers produce zinc concentrate.

The initial investigation resulted in a negative determination issued on January 26, 2009, based on the finding that there were no increased imports of zinc concentrate, nor did the subject firm shift production of zinc concentrate to a foreign country. Since the workers were denied eligibility to apply for trade adjustment assistance (TAA) they were also denied eligibility to apply for alternative trade adjustment assistance (ATAA) for older workers. The notice was published in the Federal Register on February 23, 2009 (74 FR 8116).

New information obtained by the Department shows that there was a shift in production of zinc concentrate from the workers' firm to Mexico.

Employment at the subject firm has declined.

Based on these findings, it is determined in this case that the

The Department of Labor, as part of its continuing effort to reduce paperwork and respondent burden conducts a preclearance consultation program to provide the general public and Federal agencies with an opportunity to comment on proposed and/or continuing collections of information in accordance with the Paperwork Reduction Act of 1995 [44 U.S.C. 3506(c)(2)(A)]. This program helps to ensure that requested data can be provided in the desired format, reporting burden (time and financial resources) is minimized, collection instruments are clearly understood, and the impact of collection requirements on respondents can be properly assessed. Currently, the Employment and Training Administration is soliciting comments concerning the collection of data for the Impact Evaluation of the Trade Adjustment Assistance Program.

Under Title I of the Workforce Investment Act (WIA) of 1998 (Pub. L. 105220), the Secretary of Labor annually determines the Lower Living Standard Income Level (LLSIL) for uses described in the law. WIA defines the term ``Low Income Individual'' as one who qualifies under various criteria, including an individual who received income for a sixmonth period that does not exceed the higher level of the poverty line or 70 percent of the LLSIL. This issuance provides the Secretary's annual LLSIL for 2009 and references the current 2009 Health and Human Services ``Poverty Guidelines.''

By application dated February 20, 2009, the Division of Career Services, Trade Program Manager, Massachusetts, requested
administrative reconsideration of the negative determination regarding workers'

eligibility to apply for Trade Adjustment Assistance (TAA) and Alternative Trade Adjustment Assistance (ATAA) applicable to workers and former workers of the subject firm. The determination was issued on February 4, 2009 and will soon be published in the Federal Register.

The initial investigation resulted in a negative determination based on the finding that the worker group engaged in IT sales, consulting and support services, does not produce an article within the meaning of Section 222(a)(2) of the Act.

In the request for reconsideration, the petitioner provided additional information regarding activities of the workers at the subject facility. The petitioners stated that workers of the subject firm produced software which was sold to customers.

Announcement regarding states triggering ``on'' to the Second- Tier of Emergency Unemployment Compensation (EUC08).

Public Law 110449 created a SecondTier of benefits for qualified unemployed workers claiming benefits in high unemployment states. The Department of Labor produces a trigger notice indicating which states qualify for the SecondTier of EUC08 benefits and provides the beginning and ending dates of the SecondTier period for each qualifying state.
