  <title><![CDATA[  Worker Visibility ]]></title>

  <description><![CDATA[ The FHWA is revising its regulations to address safety  concerns<br/> [[Page 70594]]<br/>
raised by the firefighting community regarding highvisibility safety 
apparel. Due to imminent safety implications to firefighters, the FHWA 
has determined that there is good cause under the Administrative 
Procedure Act to dispense with notice and opportunity for comment as it 
would be contrary to the public interest. Therefore, we are issuing an 
Interim Final Rule, effective immediately, pursuant to the 
Administrative Procedure Act, and revising FHWA regulations 
accordingly.

  <title><![CDATA[  National Tunnel Inspection Standards ]]></title>

  <description><![CDATA[ The FHWA is soliciting comments concerning the creation of a 
regulation establishing National Tunnel Inspection Standards (NTIS). 
The FHWA is considering the establishment of NTIS by adding Subpart E 
to 23 CFR Part 650. The NTIS would set minimum tunnel inspection 
standards that apply to all Federalaid highway tunnels on public 
roads. The FHWA anticipates that NTIS could be modeled after the 
existing National Bridge Inspection Standards (NBIS) regulation, found 
at 23 CFR Part 650, Subpart C, as applicable. The NTIS likely would 
include requirements for inspection procedures for structural, 
mechanical, electrical, hydraulic and ventilation systems, and other 
major elements specific to tunnels such as tunnel finishes; the 
qualification and training of inspectors; and a National Tunnel 
Inventory.

  <title><![CDATA[  Fair Market Value and Design-Build Amendments ]]></title>

  <description><![CDATA[ The FHWA is re-opening the comment period for the notice of 
proposed rulemaking (NPRM) and request for comments, which was 
published on October 8, 2008, at 73 FR 58908. That NPRM proposes to 
amend existing regulations to clarify that fair market value must be 
negotiated for and received under a concession agreement, and to amend 
the designbuild regulations to allow contracting agencies to 
incorporate unsuccessful proposers' ideas into a contract upon payment  of a stipend.</p><p>    The original comment period closed on November 7, 2008. The 
extension is based on the FHWA's desire to receive the fullest and most 
comprehensive comments possible from the broadest group of 
stakeholders. During the comment period, the FHWA received requests for 
additional time to analyze and submit comments regarding the 
rulemaking. The FHWA recognizes that those interested in commenting on 
this important program may not have had the opportunity to provide

Environmental Impact Statement is being prepared for a proposed highway 
improvement project on State Trunk Highway 15 in Outagamie County,  Wisconsin, to be conducted by the Wisconsin Department of <br/>
Transportation. The Notice of Intent (NOI) was originally prepared in 
2003 but was inadvertently overlooked for submittal to the Federal 
Register for publication. Environmental activities, including 
involvement of state and federal agencies and other stakeholders, 
proceeded since the initiation of the project in 2003. Over five years 
have passed, and the process is now at the final Environmental Impact 
Statement stage. FHWA acknowledges the oversight and has now begun 
activities to recover from the inadvertent omission. The Environmental 
process will be brought up to date and made compliant with the 2005 
SAFETEALU Environmental Review process, including development of a

  <title><![CDATA[  Notice of Final Federal Agency Actions on Proposed Transportation  Project in Washington State]]></title>

139(l)(1). The actions relate to the proposed Interstate 90 (I90) 
Snoqualmie Pass East Project, located between Hyak and Easton (Milepost 
55.1 to 70.3) in the County of Kittitas, within the State of 
Washington. Those actions grant licenses, permits, and approvals for 
the project. The project will add one additional lane eastbound and 
westbound within a 15mile section of I90. Specific actions include 
acquiring additional easement and rightofway, replacing the existing 
snowshed, replacing and adding new bridges and culverts, adding snow 
support structures (avalanche control), extending chain up/off areas, 
adding wildlife overcrossings, removing and placing fill, removing 
vegetations and trees, and providing stormwater treatment for both new 
and existing surfaces. The project also includes extensive mitigation 
and restoration actions which are compatible with land use plans.

  <title><![CDATA[  Projects of National and Regional Significance Evaluation and  Rating]]></title>

  <description><![CDATA[ Section 1301 of the Safe, Accountable, Flexible, Efficient 
Transportation Equity Act: A Legacy for Users (SAFETEALU) (Pub. L. 
10959; 119 Stat. 1144) established a program to provide grants to 
States for Projects of National and Regional Significance (PNRS) to 
improve the safe, secure, and efficient movement of people and goods 
throughout the United States and to improve the health and welfare of 
the national economy. Section 1301 requires the Secretary of 
Transportation (Secretary) to establish regulations on the manner in 
which the proposed projects will be evaluated and rated, in order to 
determine which projects shall receive grant funding. This rule 
establishes the required evaluation and rating guidelines for proposed 
projects. Under this rule, a proposed project would be eligible for 
funding under the PNRS Program (Program) only if the Secretary finds 
that the project meets the eligibility requirements of the rule. The

Congestion Mitigation and Air Quality Improvement (CMAQ) Program, and 
authorize $8.6 billion to support the CMAQ program in 20052009. The 
interim guidance went into effect October 31, 2006; however, we 
solicited comments on the interim guidance on December 19, 2006, at 71 
FR 76038. This notice describes and discusses comments we received and 
announces the publication of the final CMAQ guidance. The notice also 
describes the effect of a provision of the Energy Independence and 
Security Act of 2007, Pub. L. 110140 that affects CMAQ funding. This 
provision became effective on December 20, 2007, beyond the time for  submitting comments on the interim guidance.<br/>

Statement (EIR/EIS) that evaluates the environmental effects of the 
proposed MCP project. The MCP project will construct a new westeast 
parkway between Interstate 15 (I15) on the west and State Route 79 
(SR79) on the east which will provide a direct and continuous route 
connecting existing and planned major population/employment centers in 
the County of Riverside and the cities of Corona, Perris, and San 
Jacinto, a distance of approximately 51 kilometers (km) (32 miles 
[mi]). The project alternatives consist of five Build Alternatives (4, 
5, 6, 7 and 9) and two No Build Alternatives (1A and 1B).

Pilot Program, 23 U.S.C. 327(g) mandates semiannual audits during each 
of the first 2 years of State participation. This final report presents 
the findings from the first FHWA audit of the California Department of 
Transportation (Caltrans) under the pilot program.

of the expedited process, utilizing standardized documents and terms, 
as well as meet standard closing conditions, the DOT will commit to 
execute a final loan agreement within 45 days of the applicant's 
agreement to all of the terms and conditions contained in a template 
term sheet and a template loan agreement, drafts of which are published 
for comment on the docket for this notice and at the TIFIA Web site

States to improve the condition of their highway bridges over 
waterways, other topographical barriers, other highways, and railroads. 
Section 1114(f) amends 23 U.S.C. 144 by adding subsection (r), 
requiring the Secretary of Transportation (Secretary) to publish in the 
Federal Register a report describing construction materials used in new 
Federalaid bridge construction and bridge rehabilitation projects.

  <description><![CDATA[ The FHWA is revising its regulation for advance construction 
of Federalaid projects by: (a) Removing the restriction that a State 
must obligate all of its allocated or apportioned funds, or demonstrate 
that it will use all obligation authority allocated to it for Federal
aid highways and highway safety construction, prior to the approval of 
advance construction projects; and (b) clarifying that advance 
construction procedures may be used for all categories of Federalaid 
highway funds, and that any available Federalaid funds for which a 
project is eligible may be used when a project is converted to a 
Federalaid project. These revisions make the regulation consistent 
with the advance construction statute, which was amended by a provision 
enacted in the Safe, Accountable, Flexible, Efficient Transportation 
Equity Act: A Legacy for Users (SAFETEALU).

  <description><![CDATA[ The Federal Highway Administration (FHWA) is issuing this 
notice to advise the public that FHWA will prepare an Environmental 
Assessment (EA) to determine the need and feasibility of improvements 
to the Ohio River Crossing along U.S. 421 in Jefferson County, Indiana 
and Trimble County, Kentucky. This project will adhere to the 
requirements of section 6002 of SAFETEALU. The existing bridge 
connects the historic communities of Milton, Kentucky and Madison, 
Indiana. The objectives of this study are to assess the feasibility of 
rehabilitating or replacing the bridge, as well as other alternatives, 
for improving safety and mobility in the general project vicinity.
</p><p>    Comments on the scope of the EA for the proposed project should be 
forwarded no later than September 12, 2008.

  <title><![CDATA[  Environmental Impact Statements: National Summary of Rescinded  Notices of Intent]]></title>

  <description><![CDATA[ The FHWA is issuing this notice to advise the public that 11 
States have rescinded Notices of Intent (NOI) to prepare 19 
Environmental Impact Statements (EISs) for proposed highway projects. 
FHWA Division Offices, in consultation with the State Departments of 
Transportation (State DOT), determined that 15 of these projects were 
no longer viable projects and have formally cancelled the projects. No 
resources will be expended on these projects; the environmental review 
process has been terminated. Four projects in four States have been 
reduced in scope and now meet the criteria for an Environmental 
Assessment (EA) rather than an EIS, or a revised NOI will be issued 
restarting the EIS process.

  <title><![CDATA[  Exploratory Advanced Research Program ]]></title>

  <description><![CDATA[ Section 502 of title 23 of the United States Code directs the 
Secretary of Transportation (Secretary) to establish an Exploratory  Advanced Research Program (EARP).</p><p>    The stated purpose of the EARP is to address longerterm and 
higherrisk research with potentially dramatic breakthroughs for 
improving the durability, efficiency, environmental impact,  productivity and safety aspects of highway and intermodal </p>
<h3>transportation systems.</h3>
<p>    The purpose of this notice is to announce exploratory advanced 
research that will take place under the EARP, to encourage interest in 
such work by organizations or individuals conducting related work or 
anticipating the results of such work, and to solicit comments about 
the longterm impact of such work on future research, technical 
innovation, or transportation industry practices.

are no federal or state funds identified to make the proposed 
transportation improvements in the corridor for the next 20 years. It 
is not known when federal or state funds may become available for these 
improvements therefore an Environmental Impact Statement will not be 
prepared until further notice.

  <title><![CDATA[  Surface Transportation Environment and Planning Cooperative  Research Program (STEP)]]></title>

  <description><![CDATA[ Section 5207 of the Safe, Accountable, Flexible, Efficient 
Transportation Equity Act: A Legacy for Users (SAFETEALU) established 
the Surface Transportation Environment and Planning Cooperative 
Research Program (STEP). The general objective of the STEP is to 
improve understanding of the complex relationship between surface 
transportation, planning, and the environment. SAFETEALU provides 
$16.875 million per year for fiscal years (FY) 20062009 to implement 
this new cooperative research program. The STEP is the primary source 
of funds to conduct all Federal Highway Administration research on 
planning and environmental issues. In addition, Congress mandated 
several special studies and STEP will be the funding source for those  projects.</p><p>    The purpose of this notice is to announce revisions to the STEP 
implementation strategy for FY 2009 and to request suggested lines of
