  <title><![CDATA[  Railroad Safety Advisory Committee; Notice of Meeting ]]></title>

  <description><![CDATA[ FRA announces the thirty-seventh meeting of the RSAC, a 
Federal advisory committee that develops railroad safety regulations 
through a consensus process. The RSAC meeting topics will include 
opening remarks from the FRA Administrator, and status reports will be 
provided by the Passenger Safety, Locomotive Safety Standards, Railroad 
Bridge Safety, Medical Standards, Railroad Operating Rules, and Track 
Safety Standards Working Groups. FRA may offer several tasks pertaining 
to the mandates contained in the Rail Safety Improvement Act of 2008. 
Subjects to be addressed by these tasks include hours of service 
recordkeeping and reporting, implementing regulations for Positive 
Train Control systems, hours of service limitations and fatigue 
management for employees of intercity and commuter passenger railroads, 
certification of conductors, and potentially other topics. This agenda 
is subject to change.

authorized by the Safe, Accountable, Flexible, Efficient Transportation 
Equity Act: A Legacy for Users (SAFETEALU) for grants to existing 
magnetic levitation (maglev) projects located east of the Mississippi 
River has been appropriated and that project proponents (States or 
State designated authorities) for the three eligible projects may 
submit applications for grants to fund such projects. The three 
eligible projects are the Pittsburgh project, the BaltimoreWashington 
project, and the AtlantaChattanooga project. Funds awarded under this 
section can be used for preconstruction planning activities and capital 
costs of the fixed guideway infrastructure of a maglev project. This

Availability and Solicitation of Applications for the Capital

selection of awardees for the available FY 2008 funding. Therefore, FRA 
is now announcing that it will no longer be accepting applications for 
awards of the FY 2008 funding. FRA is also requesting, in preparation 
for a possible FY 2009 Notice of Funding Availability and Solicitation 
of Applications, that past and prospective applicants (or associations 
representing past and prospective applicants) submit comments regarding

<p>    Applicant: Wheeling & Lake Erie Railway Company, Mr. Dan Reinsel, 
Signal & Communications Supervisor, 100 East First Street, Brewster, OH  44613.</p><p>    The Wheeling & Lake Erie Railway Company seeks approval of the 
proposed discontinuance of the signal system governing movements over 
the Maumee River turn span bridge at MP 2.38, Toledo, Ohio.
</p><p>    The reason given for the proposed changes is that a damaged 
mechanical circuit coupler located on the east end of the turn span is 
no longer in production and attempts to secure a replacement have been

  <title><![CDATA[  Qualification and Certification of Locomotive Engineers ]]></title>

  <description><![CDATA[ FRA is issuing this notice of interpretation to inform 
interested parties of its application and enforcement of the 
requirements for each railroad responsible for controlling joint 
operations territory to maintain a list of person(s) certified as a 
qualified locomotive engineer for the purposes of the joint operations. 
FRA has discovered that a number of controlling railroads are not 
maintaining accurate lists primarily because foreign railroads are not 
providing the controlling railroads with accurate information and the 
controlling railroads are not demanding it. If an accurate list is not 
maintained, a controlling railroad has little chance of preventing an 
uncertified or unqualified person from operating a locomotive or train 
in the joint operations territory. This document is intended to inform 
interested parties of what information is required to be maintained on 
the required list and provides information as to how often the listings 
should be updated.

  <title><![CDATA[  Railroad Safety Advisory Committee; Notice of Meeting ]]></title>

  <description><![CDATA[ FRA announces the 36th meeting of the RSAC, a Federal advisory 
committee that develops railroad safety regulations through a consensus 
process. The RSAC meeting topics will include opening remarks from the 
FRA Administrator, and status reports will be provided by the Passenger 
Safety, Locomotive Safety Standards, Railroad Bridge, Medical 
Standards, Railroad Operating Rules, and Track Safety Standards Working 
Groups. There will be a Committee vote on the acceptance of the report 
from the Railroad Bridge Working Group and a possible vote on an 
expanded task statement for the Track Standards Working Group. 
Accident/incident reporting is on the agenda for discussion by the 
Committee and there may be a vote on a contingent task statement. This 
agenda is subject to change.

Rehabilitation and Improvement Financing (RRIF) Program to ensure the 
longterm sustainability of the program, promote competition in the 
railroad industry, and reduce the risk of default for applicants and 
the Government. Due to an administrative error, a Preliminary 
Regulatory Evaluation (Evaluation) was not included in the docket. This 
notice announces an extension of the comment period until August 26, 
2008 to allow for consideration of the Evaluation.

  <title><![CDATA[  Implementation of Program for Capital Grants for Rail Line  Relocation and Improvement Projects]]></title>

  <description><![CDATA[ Section 9002 of the Safe, Accountable, Flexible, Efficient 
Transportation Equity Act: A Legacy for Users (SAFETEALU) (Pub. L. 
10959, August 10, 2005) amends chapter 201 of Title 49 of the United 
States Code by adding section 20154. Section 20154 authorizesbut does 
not appropriate$350,000,000 per year for each of the fiscal years 
(FY) 2006 through 2009 for the purpose of funding a grant program to 
provide financial assistance for local rail line relocation and 
improvement projects. Section 20154 directs the Secretary of 
Transportation (Secretary) to issue regulations implementing this grant 
program, and the Secretary has delegated this responsibility to FRA. 
This final rule establishes a regulation intended to carry out that 
statutory mandate. As of the publication of this final rule, Congress 
did not appropriate any funding for the program for FY 2006 or FY 2007 
but did appropriate $20,040,200 for fiscal year 2008.

  <title><![CDATA[  Railroad Rehabilitation and Improvement Financing Program ]]></title>

  <description><![CDATA[ The Transportation Equity Act for the 21st Century of 1998 
(TEA21) established the Rail Rehabilitation and Improvement Financing 
(RRIF) Program. The program authorizes the Secretary of Transportation 
to issue direct loans and loan guarantees to state and local 
governments, railroads, interstate compacts, and other specified 
organizations to finance the development of railroad infrastructure. 
The Safe, Accountable, Flexible and Efficient Transportation Equity Act 
of 2005: a Legacy for Users (SAFETEALU) amended and expanded the 
program. SAFETEALU increased the principal amount of the RRIF program 
up to $35.0 billion, and of that amount, $7.0 billion is reserved for

Engineering Design,1400 Douglas Street, Stop 0910, Omaha, Nebraska  68179.</p><p>    The Union Pacific Railroad Company (UP) seeks approval of the 
proposed discontinuance and removal of the electric locks and circuit 
controllers on the Conley frogs on the moveable span bridge over the 
White River at Milepost 298.5, on the UP Memphis Subdivision, near  Augusta, Arkansas.</p><p>    The reason given for the proposed changes is that the Conley frogs  are selfaligning and require no locking device.</p><p>    Any interested party desiring to protest the granting of an

Engineer, Communications and Signals, 500 Water Street, SC J350,  Jacksonville, Florida 32202.</p><p>    The CSX Transportation, Incorporated seeks approval of the proposed 
conversion of two dispatcher controlled poweroperated switches to two 
T21 handoperated clearing switches, switches 486.15, and 486.12, on 
the Huntington Division East, Kanawha Subdivision, at CP Milton,  Milepost CA 486.05.</p><p>    The reason given for the proposed changes is pole line elimination
