the amendatory language and the regulatory text. This document corrects 
those errors.

<p>    A. Migratory Game Bird Hunting. We allow hunting of migratory 
game birds throughout the district in accordance with State  regulations subject to the following conditions:<br/> </p><p>    1. We prohibit the use of motorized boats.</p><p>    2. We prohibit the construction or use of permanent blinds,  stands, or scaffolds.</p><p>    3. You must remove all personal property, which includes boats, 
decoys, and blinds brought onto the WPA each day (see Sec. Sec.   27.93 and 27.94 of this chapter).</p><p>    4. We allow the use of hunting dogs, provided the dog is under 
the immediate control of the hunter at all times during the State

  <title><![CDATA[  Proposed Low Effect Habitat Conservation Plan for Quad Cities  Nuclear Station, Rock Island County, IL]]></title>

  <description><![CDATA[ Exelon Inc. (Applicant) has applied to the U.S. Fish and 
Wildlife Service (us, Service) for an incidental take permit (ITP) 
under the Endangered Species Act of 1973, as amended (Act). The 
proposed permit duration is 24 years. The Applicant has prepared a 
Habitat Conservation Plan (HCP) to address potential impacts to two 
mussel species. We have made a preliminary determination that the HCP 
and permit application are eligible for categorical exclusion under the 
National Environmental Policy Act of 1969 (NEPA). The basis for this 
determination is contained in an Environmental Action Statement and 
loweffect screening form, which are also available for public review.

received an application from the Otay Water District (OWD) for a 5year 
incidental take permit for one covered species under the Endangered 
Species Act of 1973 (Act), as amended. The application addresses the 
potential for ``take'' of the federally threatened coastal California 
gnatcatcher (Polioptila californica californica) associated with the 
construction of a 36inch pipeline (OWD CIP P2009) along Jamacha Road 
in the City of El Cajon and unincorporated community of Rancho San 
Diego in the County of San Diego, California. A habitat conservation 
program (HCP) to mitigate for the project activities would be 
implemented by OWD. We are requesting comments on the HCP and our 
preliminary determination that the proposed plan qualifies as a ``low
effect'' Habitat Conservation Plan, eligible for a categorical 
exclusion under the National Environmental Policy Act (NEPA) of 1969, 
as amended. The basis for this determination is discussed in the

take effect with the 20092010 season, implement portions of the 
Comprehensive Conservation Plan for the refuge approved in 2006, and 
amend other regulations. We also make amendments to reflect recent OMB 
approval of new hunting and fishing application forms and activity 
reports for national wildlife refuges.

  <description><![CDATA[ We, the U.S. Fish and Wildlife Service (USFWS), announce a 90-
day finding on a petition to revise critical habitat for Eriogonum 
pelinophilum (clayloving wild buckwheat) under the Endangered [[Page 29457]]<br/>
Species Act (Act) of 1973, as amended. Following a review of the 
petition, we find that the petition presents substantial scientific or 
commercial information indicating that revision of the critical habitat 
for E. pelinophilum may be warranted. Therefore, with the publication 
of this notice, we are initiating a review of the critical habitat for 
the species, and will subsequently issue a 12month finding to 
determine if revisions to the species' critical habitat are warranted. 
To ensure that the review is comprehensive, we are soliciting 
scientific and commercial data and other information regarding this 
species.

rosmarus divergens) stock and for each of the two polar bear (Ursus 
maritimus) stocks in Alaska: The southern Beaufort Sea polar bear stock 
and the Chukchi/Bering seas polar bear stock. These three SARs are 
available for public review and comment.

  <title><![CDATA[  Proposed Programmatic Safe Harbor Agreement for Oregon Chub,  Willamette Valley, OR]]></title>

  <description><![CDATA[ The Oregon Department of Fish and Wildlife (ODFW) has applied 
to the U.S. Fish and Wildlife Service (Service) for an enhancement of 
survival permit pursuant to section 10(a)(1)(A) of the Endangered 
Species Act of 1973, as amended. The permit application includes a 
proposed Programmatic Safe Harbor Agreement (Agreement) between ODFW 
and the Service. The proposed term of the permit and Agreement is 30 
years. The requested permit would authorize ODFW to extend incidental 
take coverage with assurances to eligible landowners who are willing to 
carry out habitat management measures that would benefit the federally
listed as endangered Oregon chub (Oregonichthys crameri) by enrolling 
them under the Agreement as Cooperators through issuance of 
Certificates of Inclusion. The covered area or geographic scope of this 
Agreement includes all nonFederal properties in the Willamette Valley 
between the cities of Oregon City and Oakridge, Oregon, the estimated

reopening of the public comment period on our proposal to designate 
critical habitat for the southwest Alaska Distinct Population Segment 
(DPS) of the northern sea otter (Enhydra lutris kenyoni) under the 
Endangered Species Act of 1973, as amended (Act). This action will 
provide all interested parties with an additional opportunity to submit 
written comments on our December 16, 2008, proposed rule to designate 
approximately 15,225 square kilometers (km\2\) (5,879 square miles 
(mi\2\)) as critical habitat.

  <description><![CDATA[ We, the U.S. Fish and Wildlife Service (Service), announce the 
reopening of the comment period on the proposed rule (72 FR 70715, 
December 12, 2007) to designate critical habitat for the Salt Creek 
tiger beetle (Cicindela nevadica lincolniana) under the Endangered 
Species Act of 1973, as amended (Act). In this document, we are 
proposing to add a total of 138 acres (ac) (56 hectares (ha)) of 
critical habitat to three of the four previously proposed units. As a 
result, our proposed revised critical habitat designation for the 
species now includes four critical habitat units totaling approximately  1,933 ac (782 ha).</p><p>    The reopened comment period will provide the interested parties 
with an opportunity to submit written comments on our proposal to add 
138 ac (56 ha), determined to be occupied and essential to the Salt 
Creek tiger beetle, to the 1,795 ac (726 ha) proposed as critical

also announce the availability of the draft economic analysis (DEA), a 
revision to proposed critical habitat Unit MEN1, and an amended 
required determinations section of the proposal. We are reopening the 
comment period to allow all interested parties an opportunity to 
comment simultaneously on the proposed revision of critical habitat 
(including the changes to proposed critical habitat Unit MEN1), the 
associated DEA, and the amended required determinations section. 
Comments previously submitted on this rulemaking do not need to be 
resubmitted. These comments have already been incorporated into the 
public record and will be fully considered in preparation of the final

  <title><![CDATA[  Hossain Ahmadi Low-Effect Habitat Conservation Plan, City of San  Jose, Santa Clara County, CA]]></title>

  <description><![CDATA[ We, the U.S. Fish and Wildlife Service, have received an 
application from Hossain Ahmadi (applicant) for a 3year incidental 
take permit for five species under the Endangered Species Act of 1973, 
as amended (Act). The application addresses the potential for ``take'' 
of three listed animals, one listed plant, and one nonlisted plant. 
The applicant would implement a conservation program to minimize and 
mitigate the project activities, as described in the applicant's low
effect habitat conservation plan (plan). We request comments on the 
applicant's application and plan, and the preliminary determination 
that the plan qualifies as a ``loweffect'' habitat conservation plan, 
eligible for a Categorical Exclusion under the National Environmental 
Policy Act of 1969, as amended (NEPA). We discuss our basis for this 
determination in our environmental action statement (EAS), also 
available for public review.

  <title><![CDATA[  Migratory Bird Permits; Revision of Expiration Dates for Double- Crested Cormorant Depredation Orders]]></title>

  <description><![CDATA[ We, the U.S. Fish and Wildlife Service, extend the expiration 
dates for two existing depredation orders for doublecrested cormorants 
(Phalacrocorax auritus) for 5 years so that we can continue to 
authorize take of doublecrested cormorants without a permit under the 
terms and conditions of the depredation orders. This action will 
continue to allow take of depredating doublecrested cormorants to 
protect aquaculture, fish hatcheries, fish resources, other birds, 
vegetation, and habitats.

  <title><![CDATA[  Proposed Safe Harbor Agreement for the Deane Dana Friendship  Community Regional Park in Los Angeles County, CA]]></title>

  <description><![CDATA[ The County of Los Angeles, Department of Parks and Recreation 
(Applicant) has applied to the U.S. Fish and Wildlife Service (Service) 
for an Enhancement of Survival permit pursuant to section 10(a)(1)(A) 
of the Endangered Species Act of 1973, as amended. The Service is 
considering the issuance of a 30year permit to the Applicant that 
would authorize take of the federally endangered Palos Verdes blue 
butterfly (Glaucopsyche lygdamus palosverdesensis; ``PVB'') through a 
Safe Harbor Agreement (SHA). The purpose of this SHA is for the 
Applicant to restore a minimum of 8 acres of habitat for the PVB 
through the implementation of a habitat restoration plan at Deane Dana 
Friendship Community Regional Park (Friendship Park), a known historic 
location for this species. Friendship Park is owned by the County of 
Los Angeles. The Applicant seeks to provide for the longterm recovery 
of PVB in the wild through the restoration of suitable habitat that can

  <title><![CDATA[  Endangered and Threatened Wildlife and Plants; Initiation of 5- Year Reviews of 58 Species in California, Nevada,]]></title>

  <description><![CDATA[ We, the U.S. Fish and Wildlife Service, initiate 5-year 
reviews for 58 species under the Endangered Species Act of 1973, as 
amended (Act). We request any new information on these species that may 
have a bearing on their classification as endangered or threatened (see 
Table 1 below). Based on the results of these 5year reviews, we will 
make a finding on whether these species are properly classified under 
the Act. We also indicate in this notice 42 5year reviews we completed 
for species in California and Nevada in mid to late Fiscal Year (FY) 
2008. Reviews we completed for 16 species in early FY 2008 were 
indicated in our previous initiation notice published in the Federal 
Register on March 5, 2008 (73 FR 11945).

implements the Federal protections provided by the Act for this 
species. We have also determined that critical habitat for P. hispida 
is prudent but not determinable at this time.

anticipates taking about 1.91 acres of Florida scrubjay (Aphelocoma 
coerulescens) (scrubjay) foraging and sheltering habitat incidental to 
lot preparation for the construction of a training facility and 
supporting infrastructure in Charlotte County, Florida (Project). The 
applicant's HCP describes the mitigation and minimization measures 
proposed to address the effects of the Project to the scrubjay.

authorize incidental take of two species currently listed under the 
Act, and 11 species that may become listed under the Act in the future 
(collectively ``covered species''). The proposed incidental take would 
occur in Pima County, Arizona, as a result of impacts on covered 
species and occupied habitat from specified actions conducted under the 
authority of the Town of Marana. We request public comments on the 
application and associated documents, and announce our plan to hold

Plan) for the Hawaiian hawk (Buteo solitarius) and the reopening of the
public comment period for the proposed rule to remove (delist) the
Hawaiian hawk from the Federal List of Endangered and Threatened
Wildlife. If the proposed rule to delist the Hawaiian hawk is made
final, we intend to monitor the hawk, in cooperation with the State of
Hawaii and other conservation partners, through islandwide surveys
every 5 years for a period of 20 years, from 2012 to 2032. We are
soliciting review and comment on this draft PDM plan from local, State,
and Federal agencies, and the public. We are also reopening the comment
period on the proposed rule to ensure that the public has full access
to the draft PDM Plan while commenting on the proposed rule.

Famulari (Applicant). The Applicant has requested an amendment to the 
permits that will change the mitigation option from payment to the 
Florida Scrubjay Conservation Fund administered by The Nature 
Conservancy to providing the Charlotte County conservation lands 
program an option to purchase land that will result in acquisition of 
79 acres of suitable scrubjay habitat. The Applicant has agreed to 
follow all other existing habitat conservation plan (HCP) conditions. 
If amended, no additional take will be authorized.

90day finding on a petition to reclassify the wood bison (Bison bison 
athabascae) from endangered to threatened throughout its range in the 
List of Endangered and Threatened Wildlife established under the 
Endangered Species Act of 1973 (Act), as amended (16 U.S.C. 1531 et 
seq.). We find that the petition presents substantial scientific and 
commercial information indicating that the petitioned action of 
reclassifying the wood bison from endangered to threatened status under 
the Act may be warranted. Therefore, we are initiating a status review 
of the wood bison to determine if reclassification, as petitioned, is 
warranted under the Act. To ensure that the status review is 
comprehensive, we are requesting submission of any new information on 
the wood bison since its original listing as endangered throughout its 
entire range under the predecessor of the Act on June 2, 1970 (35 FR

these 270 species the petition does not present substantial scientific 
or commercial information indicating that listing these species may be 
warranted. Therefore, for these 270 species, we will not initiate a 
further status review in response to this petition. We ask the public 
to submit to us any new information that becomes available concerning
