(ORI) and the Assistant Secretary for Health have taken final action in  the following case:</p><p>    Jusan Yang, M.S., M.D., University of Iowa: Based on the report of 
an investigation conducted by the University of Iowa (UI) and 
additional analysis conducted by the Office of Research Integrity (ORI) 
in its oversight review, this settlement resolves proposed U.S. Public 
Health Service (PHS) findings that Dr. Jusan Yang, former Assistant 
Research Scientist, UI, engaged in scientific misconduct in research 
supported by National Heart, Lung, and Blood Institute (NHLBI),  National Institutes of Health (NIH), grant R01 HL48058.</p><p>    PHS finds the Respondent engaged in scientific misconduct by 
falsifying and fabricating data that were reported in a scientific 
manuscript intended for publication entitled ``Increased renin 
transcription after inhibition of NFYA with RNAi reveals through

meeting of the Secretary's Advisory Committee on Genetics, Health, and 
Society (SACGHS), U.S. Public Health Service. The meeting will be held 
from 8 a.m. to approximately 5:30 p.m. on Monday, December 1, 2008, and 
8 a.m. to approximately 3 p.m. on Tuesday, December 2, 2008, at the 
Hubert H. Humphrey Building, 200 Independence Avenue, SW., Washington, 
DC 20201. The meeting will be open to the public with attendance

MD, Chairman) will hold its thirtyfifth meeting, at which it will 
discuss three topics: exercises of conscience in the practice of the 
health professions, the problem of medical futility, and the future of 
public bioethics and national bioethics commissions in the United 
States. Subjects discussed at past Council meetings (although not on 
the agenda for the November 2008 meeting) include: therapeutic and 
reproductive cloning, assisted reproduction, reproductive genetics, 
neuroscience, aging retardation, organ transplantation, personalized 
medicine, standards for the determination of death, children and

Public Health and Science, is announcing the availability of a guidance 
document entitled, ``OHRP Guidance on Engagement of Institutions in 
Human Subjects Research.'' The guidance document describes: (1) 
Scenarios that, in general, would result in an institution being 
considered engaged in a human subjects research project; (2) scenarios 
that would result in an institution being considered not engaged in a 
human subjects research project; and (3) IRB review considerations for 
cooperative research in which multiple institutions are engaged in the 
same nonexempt human subjects research project. The guidance document 
is intended primarily for institutional review boards (IRBs), research 
administrators and other relevant institutional officials, 
investigators, and funding agencies that may be responsible for the 
conduct, review and oversight of human subject research that is

</p><p>    Notice is hereby given that in furtherance of the delegation of 
authority to the Assistant Secretary for Health on September 28, 1979, 
by the Secretary of Health, Education and Welfare, the Assistant 
Secretary for Health has delegated to the Deputy Assistant Secretary 
for Women's Health all of the authorities under Title XVII of the 
Public Health Service Act, as amended, pertaining to the mission of the 
Office on Women's Health, OSOPHS. The delegation excludes the 
authorities to issue regulations and to submit reports to the 
President. The delegation includes, but is not limited to, the 
authorities under sections 1702(a)(1), (2), (3), and (4), sections 
1703(a)(1), (2), (3), and (4), and sections 1704(1) and (2).
</p><p>    In addition, I have affirmed and ratified any actions taken by the 
Deputy Assistant Secretary for Women's Health which in effect involve

nominations of qualified candidates to be considered for appointment as 
members to the National Vaccine Advisory Committee (NVAC). The 
activities of this Committee are governed by the Federal Advisory  Committee Act (FACA).</p><p>    Consistent with the National Vaccine Plan, the Committee advises 
and makes recommendations to the Assistant Secretary for Health in his 
capacity as the Director of the National Vaccine Program, on matters 
related to the Program's responsibilities. Specifically, the Committee 
studies and recommends ways to encourage the availability of an 
adequate supply of safe and effective vaccination products in the

employees at the Y12 Plant in Oak Ridge, Tennessee, as an addition to 
the Special Exposure Cohort (SEC) under the Energy Employees 
Occupational Illness Compensation Program Act of 2000. On August 15, 
2008, as provided for under 42 U.S.C. 7384q(b), the Secretary of HHS 
designated the following class of employees as an addition to the SEC:
</p><p>    All employees of the Department of Energy (DOE), its predecessor 
agencies, and DOE contractors or subcontractors who worked at the Y

(HHS) is issuing this notice pursuant to section 564(b)(4) of the

to justify the emergency use of doxycycline hyclate tablets accompanied 
by emergency use information, contained in emergency kits for eligible 
United States Postal Service (USPS) Cities Readiness Initiative (CRI) 
participants and their household members in advance of a potential 
attack involving Bacillus anthracis. Bacillus anthracis is a biological 
agent known to cause anthrax. The Secretary, HHS, provides notice of 
the determination of the Secretary of Homeland Security on September 
23, 2008 that there is a significant potential for a domestic emergency 
involving a heightened risk of attack with a specified biological, 
chemical, radiological, or nuclear agent or agentsin this case,

National Toxicology Program (NTP); Center for the Evaluation of  Risks to Human Reproduction (CERHR); Announcement of]]></title>

  <description><![CDATA[ The CERHR plans to convene an expert panel to conduct updated  evaluations of the scientific evidence<br/> [[Page 57361]]<br/>
regarding the potential reproductive and/or developmental toxicity 
associated with exposure to genistein and soy formula begun in 2006. 
The expert panel will consist of approximately 1012 scientists 
selected for their scientific expertise in various aspects of 
reproductive and developmental toxicology and other relevant areas of 
science. CERHR invites the submission of information about ongoing 
studies or upcoming publications on these substances that might be 
considered for inclusion in the evaluations and the nomination of 
scientists to serve on the expert panel (see SUPPLEMENTARY INFORMATION 
below). This meeting is tentatively scheduled for spring or summer 
2009, although the exact date and location are not yet set. As plans 
are finalized, they will be announced in the Federal Register and

announces the sixth in a series of federal advisory committee meetings 
regarding the national health promotion and disease prevention 
objectives for 2020 to be held in Washington, DC. This meeting will be 
open to the public. The Secretary's Advisory Committee on National 
Health Promotion and Disease Prevention Objectives for 2020 will review 
the nation's health promotion and disease prevention objectives and 
efforts to develop goals and objectives to improve the health status 
and reduce health risks for Americans by the year 2020. The Committee 
will provide to the Secretary of Health and Human Services advice and 
consultation for developing and implementing the next iteration of 
national health promotion and disease prevention goals and objectives 
and provide recommendations for initiatives to occur during the initial

  <title><![CDATA[  Testimony by Employees and the Production of Documents in  Proceedings Where the United States Is Not a Party]]></title>

  <description><![CDATA[ This rule amends Part 2 of Title 45 of the Code of Federal 
Regulations, which provides that employees and former employees of the 
Department of Health and Human Services (HHS or Department) may not 
provide testimony as part of their official duties in litigation where 
the United States or a federal agency is not a party, without the 
approval of the head of the agency. The purpose of these amendments is 
to modify the definition of ``employee'' contained in 45 CFR part 2. 
Under these amendments, the definition of employee will be revised to 
reflect changes in Medicare contracting, including changes brought 
about by the Medicare Prescription Drug, Improvement, and Modernization 
Act of 2003 (MMA) (Pub. L. 108173). In addition, the definition of 
employee will be modified to include employees of a state agency 
performing survey, certification, or enforcement functions under Title 
XVIII of the Social Security Act or Section 353 of the Public Health

National Toxicology Program (NTP) Center for the Evaluation of  Risks to Human Reproduction (CERHR) Announces the]]></title>

  <description><![CDATA[ In December 2005, the CERHR announced its intention to conduct 
an evaluation of the potential for bisphenol A to cause adverse effects 
on reproduction and development in humans (Federal Register: December 
21, 2005: Vol. 70, No. 244, page 75827). The final results of this 
evaluation are now available in the NTPCERHR Monograph on Bisphenol A 
that includes the (1) NTP Brief on Bisphenol A and (2) CERHR Expert 
Panel Report on the Reproductive and Developmental Toxicity of 
Bisphenol A. The NTP Brief provides the public, as well as government 
health, regulatory, and research agencies, with the NTP's conclusions 
regarding the potential for bisphenol A to adversely affect human 
reproductive health or children's development. The NTP Brief is based 
on information about bisphenol A provided in the expert panel report, 
public comments, comments from peer reviewers of the draft NTP Brief, 
and additional scientific information available since the expert panel 
meeting.

Reduction Act of 2005 (DRA), States may provide asset disregards (and 
related estate recovery offsets) for Medicaid applicants who receive 
benefits under qualified long term care insurance policies (Partnership 
policies) that were purchased in the same State. This notice sets forth 
standards for states that choose to enter into a reciprocity agreement 
under section 6021(b) of the DRA, under which they agree to provide the 
same disregards and offsets for qualified Partnership policies that a 
Medicaid applicant purchased in another State that participates in the 
reciprocity agreement.

Oak Ridge, Tennessee, as an addition to the Special Exposure Cohort 
(SEC) under the Energy Employees Occupational Illness Compensation 
Program Act of 2000. On August 15, 2008, the Secretary of HHS 
designated the following class of employees as an addition to the SEC:

promulgate regulations to ensure that Department funds do not support 
morally coercive or discriminatory practices or policies in violation 
of federal law, pursuant to the Church Amendments (42 U.S.C. 300a7), 
Public Health Service (PHS) Act Sec.  245 (42 U.S.C. 238n), and the 
Weldon Amendment (Consolidated Appropriations Act, 2008, Pub. L. 110
161, Sec.  508(d), 121 Stat. 1844, 2209). This notice of proposed 
rulemaking proposes to define certain key terms. Furthermore, in order 
to ensure that recipients of Department funds know about their legal 
obligations under these nondiscrimination provisions, the Department 
proposes to require written certification by certain recipients that 
they will comply with all three statutes, as applicable.

  <title><![CDATA[  Notice of Interest Rate on Overdue Debts ]]></title>

</p><p>    Section 30.13 of the Department of Health and Human Services' 
claims collection regulations (45 CFR Part 30) provides that the 
Secretary shall charge an annual rate of interest as fixed by the 
Secretary of the Treasury after taking into consideration private 
consumer rates of interest prevailing on the date that HHS becomes 
entitled to recovery. The rate generally cannot be lower than the 
Department of Treasury's current value of funds rate or the applicable 
rate determined from the ``Schedule of Certified Interest Rates with 
Range of Maturities.'' This rate may be revised quarterly by the 
Secretary of the Treasury and shall be published quarterly by the 
Department of Health and Human Services in the Federal Register.
</p><p>    The Secretary of the Treasury has certified a rate of 11\1/8\% for 
the quarter ended June 30, 2008. This interest rate will remain in

consultation for developing and implementing the next iteration of

and Bill of Rights Act of 2000 (DD Act of 2000). During the comment 
period there were instances when the electronic system was not

  <description><![CDATA[ The Health Resources and Services Administration (HRSA) 
received many substantive comments on the proposed rule and will 
consider these comments carefully. Based on a preliminary review of the 
comments, it appears that HRSA will need to make a number of changes in 
the proposed rule. Instead of issuing a final regulation as the next 
step, HHS will issue a new Notice of Proposed Rulemaking for further 
review and public comment prior to issuing a final rule.

  <description><![CDATA[ Notice is hereby given that the Office of Research Integrity 
(ORI) and the Assistant Secretary for Health have taken final action in  the following case:</p><p>    Roxana Gonzalez, Carnegie Mellon University: Based on reports 
submitted by Carnegie Mellon University's (CMU) inquiry and 
investigation committees, the Respondent's own admission in sworn 
testimony, and additional analysis conducted by the Office of Research 
Integrity (ORI) during its oversight review, the U.S. Public Health 
Service (PHS) found that Roxana Gonzalez, graduate student, Department 
of Social and Decision Sciences and Psychology, CMU, engaged in 
scientific misconduct in research supported by National Institute of 
Mental Health (NIMH), National Institutes of Health (NIH), grants R01  MH56880, R03 MH62376, and R24 MH67346.</p><p>    Specifically, PHS found that Ms. Gonzalez engaged in the following  acts of scientific misconduct:</p><p>    1. Respondent altered the main dependent variable (life events;
