delegations. Since the January 31, 1989, publication, additional 
delegations and updates have been issued and published independently. 
In order to provide greater guidance to the public concerning 
Secretarial delegations of authority to the General Counsel, this 
delegation of authority consolidates all delegations to the General 
Counsel within and since the January 31, 1989, Federal Register notice.

for review, as required by the Paperwork Reduction Act. The Department  is soliciting public comments on the subject proposal.</p><p>    Each year Congress appropriates funds to approximately 3,200 Public 
Housing Authorities (PHAs) for modernization, development, financing, 
and management improvements. The funds are allocated based on a complex 
formula. The forms in this collection are used to appropriately 
disburse and utilize the funds provided to PHAs. Additionally, these 
forms provide the information necessary to approve a financing 
transaction in addition to any MixedFinance and Capital Fund Financing 
transactions. Respondents include the approximately 3,200 PHA receiving 
Capital Funds and other PHAs wishing to pursue financing.

  <description><![CDATA[ On September 29, 2008, the Department published its FY2009 
Final FMRs for the Housing Choice Voucher Program and Moderate 
Rehabilitation Single Room Occupancy Program. In that notice, HUD 
incorrectly identified Schedule B as proposed FY2009 FMRs when the 
rents published were in fact the final FY2009 Final FMRs. Today's 
Federal Register notice corrects the title of Schedule B to ``FY2009 
Final Fair Market Rents For Existing Housing.''

involving comparisons between data provided by participants in HUD's 
assisted housing programs and applicants for RHS's rural housing 
programs. The matching program will be carried out to identify 
individuals who are receiving excess or duplicate housing assistance as  a result of Hurricanes Katrina and Rita.</p><p>    The matching program will be accomplished by comparing information

to establish a new record system to add to its inventory of systems of 
records subject to the Privacy Act of 1974 (5 U.S.C. 552a), as amended. 
The proposed new system of record is the Single Family Nonprofit Data 
Management System (NPDMS) developed by the Office of Single Family 
Housing. NPDMS will be used as an automated webased tool used to 
manage the Nonprofit program activities. The application will be used 
to improve the application, recertification, and reporting process for 
organizations that participate in HUD Federal Housing Administration 
(FHA) Nonprofit Program activities and will be used to assist HUD staff 
with the daily administration of these programs.

Privacy Act; Notification of an Amendment to an Existing Privacy  Act System of Records, Housing Counseling System]]></title>

  <description><![CDATA[ HUD proposes to amend one of its system of records subject to 
the Privacy Act of 1974 (5 U.S.C. 552a), as amended. HCS/CAR contains 
detailed characteristics of housing counseling clients that receive 
specific services from HUDapproved counseling agencies. The previous 
system of records was published at 78 FR 17366. The Department is 
modifying the system of records to include new capabilities for the 
system and to include a new ``Purpose'' captions, and an expansion on 
other captions for additional clarification purposes, to rename a new 
system manger in order to accurately identify the official responsible 
for managing the system. Additionally, updates are applied to the 
``Routine Use'' caption, to expand the use of data to HUD approved 
entities for the purpose of conducting research and evaluation studies 
directly related to the participation and outcome of HUD's Housing 
Counseling Programs.

Civil Money Penalties: Certain Prohibited Conduct ]]></title>

  <description><![CDATA[ This rule would revise HUD's regulations that govern the 
imposition of civil money penalties. Specifically, the rule would 
revise the definition of ``material or materially'' and add a 
definition of ``ability to pay,'' which is one factor used in 
determining the appropriateness of the amount of any civil money 
penalty. Additionally, the proposed rule would require respondents, in 
their responses to the prepenalty notice, to specifically address the 
factors used in determining the appropriateness and amount of civil 
money penalty. This rule would also allow Government Counsel to file 
complaints on behalf of the Mortgagee Review Board and departmental 
officials. Finally, this rule would make other minor clarifying 
changes.

Public Housing Operating Fund Program; Increased Terms of Energy  Performance Contracts]]></title>

  <description><![CDATA[ This interim rule would make conforming amendments to the 
regulations of the Public Housing Operating Fund Program to reflect 
recent statutory amendments that allow for: The maximum term of an 
energy performance contract (EPC) between a public housing authority 
(PHA) and an entity other than HUD to be up to 20 years, and the 
extension of an existing EPC, without reprocurement, to a period of no 
more than 20 years, to allow additional energy conservation 
improvements. The increase in the maximum EPC term, which is currently 
limited to 12 years, is provided by statutory amendments and will 
enable longer payback periods for energy conservation measures.

below has been submitted to the Office of Management and Budget (OMB) 
for review, as required by the Paperwork Reduction Act. The Department  is soliciting public comments on the subject proposal.</p><p>    The Department of Housing and Urban Development's Congressional 
Grants Division will administer congressionally mandated grants known 
as earmarks. These projects will be identified in HUD's annual 
appropriation legislation and accompanying committee reports. These 
earmarks generally fall into two categories: Economic Development 
InitiativeSpecial Project (EDISP) and Neighborhood Initiative (N) 
grants. Grantees are nonprofit organizations, Tribal entities and 
local governments.

of additional waivers and alternative requirements applicable to the

for the purpose of assisting in the recovery in the most impacted and 
distressed areas related to the consequences of Hurricanes Katrina and 
Rita in 2005. Although the reconsideration period is normally 2 years 
following grant of the waiver, HUD is reconsidering and altering some 
waivers early at the state's request.

Notice of Funding Availability (NOFA) for the Continuum of Care  Homeless Assistance Program: Extension of Application]]></title>

  <description><![CDATA[ On July 10, 2008, HUD published the NOFA for the Continuum of 
Care (CoC) Homeless Assistance Program. Through this NOFA, HUD is 
making available approximately $1.42 billion in Fiscal Year (FY) 2008 
for the CoC program. On August 13, 2008, HUD published a notice that 
established the deadline date for the submission of applications and 
corrected or clarified portions of the CoC NOFA. Since that date, 
Hurricane Ike has greatly impacted Continuums of Care in Texas, 
Louisiana and other places. In response to this disaster, today's 
publication extends the deadline date for the submission of 
applications.

of additional waivers and alternative requirements applicable to the 
CDBG disaster recovery grant provided to the State of Alabama on June 
14, 2006, for the purpose of assisting in the recovery in the most 
impacted and distressed areas related to the consequences of Hurricane 
Katrina in 2005. HUD previously published an allocation and application 
notice on February 13, 2006, applicable to this grant and four others 
under the same appropriation and extended that notice on August 8, 
2008. As described in the Supplementary Information section of this 
notice, HUD is authorized by statute to waive statutory and regulatory 
requirements and specify alternative requirements for this purpose, 
upon the request of the state grantee. This notice for the State of 
Alabama also notes statutory provisions affecting program design and 
implementation. The original notice has been reconsidered and the 
waivers are being retained.

for those entities that administer HUD's Office of Public and Indian

for review, as required by the Paperwork Reduction Act. The Department  is soliciting public comments on the subject proposal.</p><p>    All PHAs are required to submit annual plans, however, PHAs with 
Moving to Work demonstration agreements (29 at the time of submission 
of this request) the annual MTW plan and annual MTW report are  submitted in lieu of the standard annual<br/> [[Page 58254]]<br/>
and 5 year PHA plans. Revisions are being made to this 50900 form so 
that the Department is able to better respond to Congressional and 
other inquiries regarding outcome measures obtained and promising 
practices learned throughout the duration of the demonstration.

review the credit of the assumer and record the approval.

Multifamily Mortgage Insurance Premiums (MIPs) and Credit Subsidy  Obligations for Fiscal Year (FY) 2009]]></title>

  <description><![CDATA[ This notice announces the mortgage insurance premiums (MIPs) 
for Federal Housing Administration (FHA) multifamily mortgage insurance 
programs that have commitments to be issued or reissued in Fiscal Year 
(FY) 2009. The FY2009 MIPs are the same as in FY2008. This annual 
notice includes for the first time two additional MIPs for the hospital 
mortgage insurance programs: (1) Supplemental loans for hospitals; and 
(2) refinancing for existing FHAinsured hospitals. These are not new 
MIPs and the amounts charged for them will be the same as in previous  years.</p><p>    In addition to announcing MIPs for FY2009, this notice announces 
that credit subsidy obligations are required for firm commitments 
issued or reissued for FHA's three positive credit subsidy programs: 
(1) Section 221(d)(3) New Construction/Substantial Rehabilitation for 
Nonprofit/Cooperatives; (2) Section 241(a) Supplemental Loans for 
apartments only; and (3) Section 223(d) Operating Loss Loans. These 
obligations are not new for FY2009.

Notice of Funding Availability (NOFA) for the Continuum of Care  Homeless Assistance Program: Technical Corrections]]></title>

  <description><![CDATA[ On July 10, 2008, HUD published the NOFA for the Continuum of 
Care (CoC) Homeless Assistance Program. Through this NOFA, HUD is 
making available approximately $1.42 billion in Fiscal Year (FY) 2008 
for the CoC program. The purpose of the CoC program is to reduce the 
incidence of homelessness in communities by assisting homeless 
individuals and families to move to self sufficiency and permanent 
housing. On August 13, 2008, HUD published a notice that established 
the deadline date for the submission of applications and corrected or 
clarified portions of the CoC NOFA. Today's publication clarifies the 
CoC NOFA regarding the projects subject to the calculation for housing 
emphasis points. Today's publication also moves the deadline date for 
the submission of applications.

Investigation plans to reclassify its Cleveland; Baltimore; Tampa; and 
Seattle field offices as regional offices. The planned reclassification 
is intended to: (1) Improve the alignment of limited investigative 
resources, to promote more efficient responses to HUD or Congressional 
requests involving critical program issues; (2) redeploy resources to 
prevent and detect fraud in new program delivery of CPD and FHA; and 
(3) improve management control and effectiveness, and reduce travel  costs of management by reducing region size.</p><p>    The HUD/OIG Office of Audit, to the extent that it maintains field 
offices in these locations, has determined that based upon the 
different nature of its responsibilities it does not need to 
reorganize. This notice also includes a costbenefit analysis 
supporting the reclassification of the four field offices.

Home Equity Conversion Mortgages (HECMs): Determination of  Maximum Claim Amount; and Eligibility for Discounted]]></title>

  <description><![CDATA[ This final rule adopts, without change, an interim rule that 
made two technical changes to HUD's Home Equity Conversion Mortgage 
(HECM) program. First, the interim rule extended the date for 
calculating the maximum claim amount in the HECM program from the date 
of the underwriter's receipt of the appraisal report to the date of 
closing. This change provides a more easily verifiable and more easily 
identifiable date. Second, the interim rule corrected an unintended 
consequence that results in a situation where HECM loans that are not 
in default but have been assigned pursuant to regulatory provisions, 
and remain in effect, are not eligible to be refinanced with a 
discounted initial mortgage insurance premium (MIP). The interim rule 
permitted such HECM loans to be eligible for the discounted initial MIP 
upon refinancing, in accordance with the purpose of the HECM program, 
which is to improve the financial situation of elderly homeowners. HUD

statute was subsequently amended to exempt from this restriction 
students with disabilities who were receiving section 8 assistance as 
of November 30, 2005.

  <description><![CDATA[ Since 2005, HUD has required that applicants for HUD's 
discretionary funding submit their applications electronically through 
Grants.gov, unless the applicant previously received a waiver of this 
requirement. Since July 2, 2008, however, applicants for HUD assistance 
have indicated that they have encountered technical difficulties in 
their electronic application submissions. Today's notice announces that 
HUD is taking action to respond to these concerns and is conducting a 
Quality Assurance Review (QAR) to identify applicants that correctly 
followed all electronic application submission instructions, including 
registration for electronic submission, but were unable to submit an 
application because of technical problems related to the use of the 
Adobe Acrobat forms and Grants.gov error messages.

Reconsideration of Waivers Granted to and Alternative  Requirements for Community Development Block Grant Disaster]]></title>

  <description><![CDATA[ This Notice reconsiders and generally affirms the waivers made 
under the three ``common'' Notices governing grant funds for Community 
Development Block Grant (CDBG) disaster recovery grants for the purpose 
of assisting in the recovery in the most impacted and distressed areas 
related to the consequences of Hurricanes Katrina, Rita, and Wilma in 
the Gulf of Mexico in 2005. These prior notices were published in the 
Federal Register on February 13, 2006, October 30, 2006, and August 24, 
2007. The Notice published today addresses the purpose and use of these 
funds, while highlighting unique components of the three notices and 
noting any changes made by HUD as the result of the required 
reconsideration of the waivers. For the most part, HUD is repeating or 
restating the original explanatory text so that grantees and program 
administrators may continue to have the explanation of a changed 
requirement and the requirement itself in a single document.

Streamlining Public Housing Programs ]]></title>

  <description><![CDATA[ This proposed rule would support HUD's overall objective to 
streamline the regulations governing public housing programs and to 
facilitate the transition of public housing agencies (PHAs) to asset 
management. In general, this proposed rule would streamline portions of 
the public housing regulations, and more closely align the regulatory 
framework of public housing with other federally subsidized housing 
programs, providing PHAs greater flexibility within the parameters of 
current law. This proposed rule offers general principles and basic 
guidelines for PHAs to follow, rather than overly prescriptive 
measures, thus allowing PHAs to operate projects more efficiently as 
PHAs move toward asset management.

Notice of Proposed Information Collection: Comment Request;  Customer Satisfaction Surveys]]></title>

  <description><![CDATA[ The proposed information collection requirement described 
below will be submitted to the Office of Management and Budget (OMB) 
for review, as required by the Paperwork Reduction Act. The Department  is soliciting public comments on the subject proposal.</p><p>    Executive Order 12862, ``Setting Customer Service Standards 
``requires that Federal agencies provide the highest quality service to 
our customers by identifying them and determining what they think about 
our services. The surveys covered in the request for a generic 
clearance will provide HUD a means to gather this data directly from 
our customers. HUD will conduct various customer satisfaction surveys 
to gather feedback and data directly from our customers to determine 
the kind and quality of services and products they want and expect to 
receive.

  <title><![CDATA[
Mortgage and Loan Insurance Programs Under the National Housing  Act--Debenture Interest Rates]]></title>

  <description><![CDATA[ This notice announces changes in the interest rates to be paid 
on debentures issued with respect to a loan or mortgage insured by the 
Federal Housing Administration under the provisions of the National 
Housing Act (the Act). The interest rate for debentures issued under 
section 221(g)(4) of the Act during the 6month period beginning July 
1, 2008, is 3\7/8\ percent. The interest rate for debentures issued 
under any other provision of the Act is the rate in effect on the date 
that the commitment to insure the loan or mortgage was issued, or the 
date that the loan or mortgage was endorsed (or initially endorsed if 
there are two or more endorsements) for insurance, whichever rate is 
higher. The interest rate for debentures issued under these other 
provisions with respect to a loan or mortgage committed or endorsed 
during the 6month period beginning July 1, 2008, is 4\5/8\ percent.
