  <description><![CDATA[ In accordance with the Marine Mammal Protection Act of 1972, 
as amended (MMPA), the U.S. Fish and Wildlife Service (Service, or we), 
has issued letters of authorization for the nonlethal take of polar 
bears and Pacific walrus incidental to oil and gas industry 
exploration, development, and production activities in the Beaufort Sea 
and the adjacent northern coast of Alaska and incidental to oil and gas 
industry exploration activities in the Chukchi Sea and the adjacent 
western coast of Alaska. These letters of authorization stipulate 
conditions and methods that minimize impacts to polar bears and Pacific 
walrus from these activities.

  <title><![CDATA[Endangered and Threatened Wildlife and Plants:]]></title>

  <description><![CDATA[ We, the U.S. Fish and Wildlife Service, announce the reopening 
of the public comment period on our July 26, 2012, proposed listing and 
designation of critical habitat for the diamond darter (Crystallaria 
cincotta) under the Endangered Species Act of 1973, as amended (Act). 
We also announce the availability of a draft economic analysis (DEA) of 
the proposed designation of critical habitat and an amended required 
determinations section of the proposal. We are reopening the comment 
period to allow all interested parties an opportunity to comment 
simultaneously on the proposed rule, associated DEA, and amended 
required determinations section. Comments previously submitted on the 
proposed rule need not be resubmitted, as they will be fully considered 
in preparation of the final rule.

  <title><![CDATA[Subsistence Management Regulations for Public Lands in Alaska:]]></title>

  <description><![CDATA[ This final rule establishes regulations for seasons, harvest 
limits, methods, and means related to taking of fish for subsistence 
uses in Alaska during the 20132014 and 20142015 regulatory years. The 
Federal Subsistence Board (Board) completes the biennial process of 
revising subsistence hunting and trapping regulations in evennumbered 
years and subsistence fishing and shellfish regulations in oddnumbered 
years; public proposal and review processes take place during the 
preceding year. The Board also addresses customary and traditional use 
determinations during the applicable biennial cycle. This rulemaking 
replaces the fish taking regulations that expire on March 31, 2013.

mammal stock assessment reports (SAR) for two West Indian manatee 
stocks: the Puerto Rico stock of Antillean manatees and the Florida 
manatee stock. We now make the SARs available for public review and 
comment.

12month finding on a petition to list the Rosemont talussnail as 
endangered or threatened and to designate critical habitat under the 
Endangered Species Act of 1973, as amended (Act). After a review of the 
best available scientific information, we find that listing the 
Rosemont talussnail as an endangered or threatened species is not 
warranted, and, therefore, we are removing this species from the 
candidate list.

</p><p>    Department of the Interior is issuing a public notice of its intent 
to create the Department of the Interior system of records titled, 
``Office of Insular Affairs Programs.'' The system will assist the 
Department of the Interior Office of Insular Affairs with overseeing 
programs in certain United States territories and increasing 
communication and economic development of the U.S. Insular Areas, 
including administering grants and scholarships, providing business, 
employment and entrepreneurial opportunities, and locating support and 
services for individuals and businesses in need. This newly established 
system will be included in the Department of the Interior's inventory 
of record systems.

availability of a draft Revised Supplement to the Grizzly Bear Recovery 
Plan. Specifically, this supplement proposes to revise the demographic 
recovery criteria for the Yellowstone Ecosystem. In the lower 48 
States, Grizzly bears (Ursus arctos horribilis) are federally listed as 
threatened under the Endangered Species Act of 1973, as amended (Act). 
The Service solicits review and comment from the public on this draft 
revised plan.

Princeton, Codora, Glenn & Provident Irrigation Districts (PCGIDPID) 
Pumping Plan/Fish Screen Facility Protection Project is now available. 
The final EIS/EIR, which we prepared and now announce in accordance 
with the National Environmental Policy Act of 1969 (NEPA), describes 
the alternatives identified to protect the pumping plant and fish 
screen facility located at river mile 178.5 on the Sacramento River, 
and to restore the Riparian Sanctuary Unit of the Sacramento River 
National Wildlife Refuge.

that the Department made in FY 2012. The information is organized by 
function to show how contracted resources are distributed throughout

Contract inventory is summarized in the FY 2011 Service Contract 
Inventory report. The 2012 inventory and 2011 report were developed in 
accordance with guidance issued on December 19, 2011 and November 5,

Cedarville Rancheria, Ordinance No. 201205. The Ordinance regulates 
and controls the possession, sale and consumption of liquor within the 
Indian Country of the Cedarville Rancheria. The land is trust land and 
this Ordinance allows for the possession and sale of alcoholic 
beverages within the jurisdiction of the Cedarville Rancheria. This 
Ordinance will increase the ability of the tribal government to control 
the distribution and possession of liquor within their jurisdiction, 
and at the same time will provide an important source of revenue, 
strengthen the tribal government and improve the delivery of tribal 
services.

of the Bishop Paiute Tribe. The Ordinance regulates and controls the 
possession, sale and consumption of liquor within the Indian Country of 
the Bishop Paiute Tribe. The land is trust land and this Ordinance 
allows for the possession and sale of alcoholic beverages within the 
jurisdiction of the Bishop Paiute Tribe. This Ordinance will increase 
the ability of the tribal government to control the distribution and 
possession of liquor within their jurisdiction, and at the same time 
will provide an important source of revenue, the strengthening of the 
tribal government and the delivery of tribal services.

comment period for an additional 60 days to allow all interested 
parties an opportunity to comment on the revised proposed rule, the

pallidicinctus) (LEPC) in Oklahoma, as well as the final environmental 
assessment (EA) and the draft Finding of No Significant Impact (FONSI) 
under the National Environmental Policy Act of 1969 (NEPA). The 
Oklahoma Department of Wildlife Conservation (ODWC) applied for an 
enhancement of survival permit pursuant to Section 10(a)(1)(A) of the 
Endangered Species Act of 1973, as amended (Act). The permit 
application included a draft CCAA between the Service and ODWC for the 
Lesser Prairie Chicken (LEPC) in 14 Oklahoma counties. Our decision is 
to authorize the issuance of an enhancement of survival permit to the 
ODWC for implementation of the CCAA (Preferred Alternative described 
below).

regulations regarding the approval of nontoxic shot types to make the 
regulations easier to understand. The language governing determination 
of Expected Environmental Concentrations (EECs) in terrestrial and 
aquatic ecosystems is altered to make clear the shot size and number of 
shot to be used in calculating the EECs. We propose to specify the pH 
levels to be used in calculating the EEC in water. We also propose to 
move the requirement for in vitro testing to Tier 1, which will allow 
us to better assess applications and minimize the need for Tier 2 
applications. We propose to add language for withdrawal of alloys that 
have been demonstrated to have detrimental environmental or biological 
effects, or for which no suitable fieldtesting device is available. We  expect these changes to reduce the time<br/> [[Page 14061]]<br/>
required for nontoxic shot approvals. Finally, we propose to charge

  <description><![CDATA[ We, the U.S. Fish and Wildlife Service (Service), are issuing 
this final rule to comply with a court order that has the effect of 
reinstating the removal of the Virginia northern flying squirrel 
(Glaucomys sabrinus fuscus) from the List of Endangered and Threatened 
Wildlife under the Endangered Species Act of 1973 (ESA), as amended. 
Pursuant to the District of Columbia District Court of Appeals order 
dated August 17, 2012, and mandate dated November 13, 2012, this rule 
again removes the Virginia northern flying squirrel from the List of 
Endangered and Threatened Wildlife.

application addresses the potential for ``take'' of the federally  endangered Morro shoulderband snail (= banded dune snail; <br/>
Helminthoglypta walkeriana) that is likely to occur incidental to the 
construction, maintenance, and occupation of a singlefamily residence 
on an existing legal singlefamilyzoned parcel in the unincorporated 
community of Los Osos, San Luis Obispo County, California. The 
applicants would implement a conservation program to minimize and 
mitigate project activities that are likely to result in take of the 
Morro shoulderband snail as described in their plan. We invite comments 
from the public on the application package that includes the Jennings 
LowEffect Habitat Conservation Plan for the Morro Shoulderband Snail.

as endangered under the Endangered Species Act of 1973, as amended 
(Act). Both rules were published in the Federal Register on July 6, 
2012. We are reopening the comment periods to allow all interested 
parties an opportunity to provide additional comments on these proposed 
rules and to submit information on the status of the species. Comments 
previously submitted need not be resubmitted, as they will be fully 
considered in preparation of the final rule.

  <title><![CDATA[Migratory Bird Subsistence Harvest in Alaska:]]></title>

  <description><![CDATA[ The U.S. Fish and Wildlife Service (Service or we) is 
establishing migratory bird subsistence harvest regulations in Alaska 
for the 2013 season. These regulations enable the continuation of 
customary and traditional subsistence uses of migratory birds in Alaska 
and prescribe regional information on when and where the harvesting of 
birds may occur. These regulations were developed under a comanagement 
process involving the Service, the Alaska Department of Fish and Game, 
and Alaska Native representatives. The rulemaking is necessary because 
the regulations governing the subsistence harvest of migratory birds in 
Alaska are subject to annual review. This rulemaking establishes 
regionspecific regulations that go into effect on April 2, 2013, and 
expire on August 31, 2013.

Environmental Policy Act of 1969, make available the final 
environmental impact statement (EIS) and record of decision analyzing 
the impacts of the issuance of an incidental take permit for 
implementation of the final Edwards Aquifer Recovery Implementation 
Program (EARIP) Habitat Conservation Plan (HCP). Our decision is to 
issue a 15year incidental take permit to the EARIP for implementation 
of the preferred alternative (described below), which authorizes 
incidental take of animal species and impacts to plant species listed 
under the Endangered Species Act of 1973, as amended. The EARIP has 
agreed to implement avoidance, minimization, and mitigation measures to 
offset impacts to these species, as described in their HCP.

(Act). The applicant anticipates taking about 2.99 acres of foraging, 
breeding, and sheltering habitat used by the Florida scrubjay 
(Aphelocoma coerulescens) (scrubjay), Eastern indigo snake (Drymarchon 
courais cooperii) (indigo snake), and gopher tortoise (Gopherus 
polyphemus), incidental to land preparation and for the construction of 
the Sandy Pines Residential Treatment Center Addition in Martin County, 
Florida. The applicant's HCP describes the minimization and mitigation 
measures proposed to address the effects of the project on the covered 
species.

approximately 12,156 acres (4,920 hectares) in Del Norte, Humboldt, 
Mendocino, Sonoma, Marin, San Mateo, Santa Cruz, Monterey, San Luis 
Obispo, Santa Barbara, Ventura, Los Angeles, Orange, and San Diego 
Counties, California, fall within the boundaries of the critical 
habitat designation.

  <description><![CDATA[ In accordance with the Oil Pollution Act of 1990 (OPA), the 
National Environmental Policy Act (NEPA), and the Framework Agreement 
for Early Restoration Addressing Injuries Resulting from the DEEPWATER 
HORIZON Oil Spill (Framework Agreement), notice is hereby given that 
the Federal and State natural resource trustee agencies (Trustees) have 
approved the Phase II Early Restoration Plan and Environmental Review 
(Phase II ERP/ER) describing the second set of restoration projects 
selected by the Trustees to continue the process of restoring natural 
resources and services injured or lost as a result of the DEEPWATER 
HORIZON oil spill, which occurred on or about April 20, 2010 in the 
Gulf of Mexico. The purpose of this notice is to inform the public of 
the availability of the Phase II ERP/ER.

best scientific and commercial data available at the time of the 
review; therefore, we are requesting submission of any new information 
on these species that has become available since the last review for 
that particular species.

the reopening of comment on the August 16, 2012, proposed designation 
of critical habitat for the six west Texas aquatic invertebrate species 
and the availability of a draft economic analysis of the proposed 
designation and amended required determinations in the proposed rule. 
We are reopening the comment period to allow all interested parties an 
opportunity to comment simultaneously on the proposed rules, the 
associated draft economic analysis, and the amended required 
determinations. Comments previously submitted need not be resubmitted, 
as they will be fully considered in preparation of the final rules.

records, ``National Irrigation Information Management System (NIIMS), 
Interior, BIA34,'' to update the system location, categories of 
individuals covered by the system, categories of records in the system, 
authority for maintenance of the system, routine uses, storage, 
safeguards, retention and disposal, system manager and address, and 
records source categories. The National Irrigation Information 
Management System is a collection, debt management, and billing system 
utilized by various Indian irrigation projects operated by the Bureau 
of Indian Affairs. The system facilitates the revenue and collections 
business cycle, including billing for the construction, operation and 
maintenance costs of the project which are reimbursable to the Federal 
government.

  <description><![CDATA[ We, the U.S. Fish and Wildlife Service, propose to list the 
distinct population segment of the North American wolverine occurring 
in the contiguous United States, as a threatened species under the 
Endangered Species Act. If we finalize this rule as proposed, it would 
extend the Act's protections to this species. The effect of this 
regulation is to add the distinct population segment of the North 
American wolverine occurring in the contiguous United States to the 
List of Endangered and Threatened Wildlife in our regulations. We also 
propose a special rule under section 4(d) of the Act to apply the 
specific prohibitions of the Act necessary to protect the wolverine. We 
find that critical habitat is not determinable at this time. The 
Service seeks data and comments from the public on this proposed 
listing rule, the proposed special rule under section 4(d) of the Act, 
and our finding that the designation of critical habitat for the 
species is not determinable at this time.

  <description><![CDATA[ We, the U.S. Fish and Wildlife Service (Service), advise the 
public that we intend to prepare a draft environmental impact statement 
(EIS) to evaluate the impacts of, and alternatives to, the proposed 
General Conservation Plan (GCP) for incidental take of the federally 
listed American burying beetle (ABB) resulting from activities 
associated with construction, maintenance, operation, and repair of oil 
and gas pipelines, and related well field activities. Individual oil 
and gas companies would apply for an Endangered Species Act 10(a)(1)(B) 
permit and agree to implement the approved GCP. A GCP is a conservation 
plan suitable for the needs of a local area where the NEPA requirements 
and permit issuance criteria are met. After approval of the GCP, 
individuals apply for a permit for incidental take associated with 
activities covered in the GCP and agree to comply with the terms and 
conditions of the GCP. We notice these permit applications and request 
comments from the public.

the No Child Left Behind Act of 2001, the Secretary will select 
representatives of Indian tribes for the Committee from among 
individuals nominated by tribes whose students attend BIEfunded 
schools operated by either the Bureau or by the tribe through a 
contract or grant and who would be affected by a final rule. The BIE 
solicits comments on this proposal to establish the Committee, 
including comments on additional interests not identified in this 
notice of intent, and invites tribes to nominate representatives for 
membership on the Committee.

response to an application from PacifiCorp (applicant) for a 10year 
incidental take permit for two species under the Endangered Species Act 
of 1973, as amended (16 UDC 1531, et seq; Act). We request data, 
comments, new information or suggestions from the public, other 
concerned governmental agencies, the scientific community, Tribes, 
industry, or any other interested party on the applicant's permit 
application and associated habitat conservation plan (plan), and also 
on the associated draft EA.

  <description><![CDATA[ Vermejo Park, LLC, d/b/a Vermejo Park Ranch (Applicant), has 
applied for an enhancement of survival permit pursuant to Section 
10(a)(1)(A) of the Endangered Species Act of 1973, as amended. The 
permit application includes a draft Candidate Conservation Agreement 
with Assurances (CCAA) between the U.S. Fish and Wildlife Service 
(Service) and Vermejo Park Ranch for the Rio Grande cutthroat trout in 
Taos County, New Mexico, and Costilla County, Colorado. If the Rio 
Grande cutthroat trout becomes listed in the future, the enhancement of 
survival permit will become effective, authorizing incidental take of 
Rio Grande cutthroat trout resulting from ongoing, otherwise lawful 
activities on enrolled lands. The draft CCAA and the draft 
environmental assessment are available for public review, and we seek 
public comment on the potential issuance of the above permit.

petition finding and proposed rule to remove the valley elderberry 
longhorn beetle (Desmocerus californicus dimorphus) from the List of 
Endangered and Threatened Wildlife. The 60day comment period for our 
proposed rule ended on December 3, 2012. This notice announces a 30day 
reopening of the comment period to allow all interested parties an 
additional opportunity to comment on the proposed rule and to submit 
information on the status of the species. If you submitted comments 
previously, you do not need to resubmit them because we have already 
incorporated them into the public record and will fully consider them 
in preparation of the final rule.

Habitat Conservation Plan (HCP). Palmetto Lake HamiltonHighway 17, LLC 
(the applicant) requests an ITP under the Endangered Species Act of 
1973, as amended (Act). The applicant anticipates taking about 1.71 
acres of sand skink (Neopseps reynoldsi) and bluetail mole skink 
(Eumeces egregius lividus) (skinks) foraging, breeding, and sheltering 
habitat incidental to land preparation and construction of a Dollar 
General Store, including a storm water retention area and parking lot, 
in Polk County, Florida (project). The applicant's HCP describes the 
mitigation and minimization measures proposed to address the effects of 
the project on the skinks.

Santee Sioux Nation Liquor Control Ordinance. The Ordinance regulates 
and controls the possession, sale and consumption of liquor within the 
Indian Country of the Santee Sioux Nation. The land is trust land and 
this Ordinance allows for the possession and sale of alcoholic 
beverages within the jurisdiction of the Santee Sioux Nation. This 
Ordinance will increase the ability of the tribal government to control 
the distribution and possession of liquor within their jurisdiction, 
and at the same time will provide an important source of revenue, the 
strengthening of the tribal government and the delivery of tribal 
services.

intent to prepare comprehensive conservation plans (CCP) and associated 
environmental documents for the Big Oaks, Glacial Ridge, Northern 
Tallgrass Prairie, and Whittlesey Creek National Wildlife Refuges 
(Refuge, NWR). In these CCPs we will describe how we propose to manage 
the refuges for the next 15 years. We also invite public comment on the 
scope of issues that should be considered during the planning process.
</p><p>    We will hold open housestyle meetings to receive comments and 
provide information on the planning process. In addition, we will use 
special mailings, newspaper articles, Internet postings, and other 
media announcements to inform people of opportunities for input.

  <title><![CDATA[Subsistence Management Regulations for Public Lands in Alaska:]]></title>

  <description><![CDATA[ This proposed rule would establish regulations for hunting and 
trapping seasons, harvest limits, methods and means related to taking 
of wildlife for subsistence uses during the 201415 and 201516 
regulatory years. The Federal Subsistence Board is on a schedule of 
completing the process of revising subsistence taking of wildlife 
regulations in evennumbered years and subsistence taking of fish and 
shellfish regulations in oddnumbered years; public proposal and review 
processes take place during the preceding year. The Board also 
addresses customary and traditional use determinations during the 
applicable cycle. When final, the resulting rulemaking will replace the 
existing subsistence wildlife taking regulations. This rule would also 
amend the general regulations on subsistence taking of fish and 
wildlife.

list the bluethroated macaw (Ara glaucogularis) as endangered under 
the Endangered Species Act of 1973, as amended (Act). This species is 
endemic to a small area in Bolivia, and there are estimated to be fewer 
than 150 individuals remaining in the wild. Its population continues to 
decrease despite intense conservation efforts. The primary threat to 
the species is lack of reproductive success (loss of nestlings) due to 
nest failure, which primarily is caused by competition for nest sites 
and predation by larger avian species, in addition to diminished 
availability of suitable habitat. We seek information from the public 
on the proposed listing for this species.

bears (Ursus maritimus) during oil and gas industry (Industry) 
exploration activities in the Chukchi Sea and adjacent western coast of 
Alaska. If adopted as proposed, this rule would be effective for 5  years from the date of issuance of the final rule.</p><p>    We propose a finding that the total expected takings of Pacific 
walruses (walruses) and polar bears during Industry exploration 
activities will impact small numbers of animals, will have a negligible 
impact on these species, and will not have an unmitigable adverse 
impact on the availability of these species for subsistence use by

continental United States (U.S.) breeding population of wood stork from 
endangered to threatened under the Endangered Species Act of 1973, as 
amended (Act). In that publication, we supplied an incorrect docket 
number for commenters to use when they send us comments. The correct 
docket number is FWSR4ES20120020.

  <title><![CDATA[Endangered and Threatened Wildlife and Plants:]]></title>

  <description><![CDATA[ We, the U.S. Fish and Wildlife Service (Service), designate 
revised critical habitat for the southwestern willow flycatcher 
(Empidonax traillii extimus) (flycatcher) under the Endangered Species 
Act. In total, approximately 1,975 stream kilometers (1,227 stream 
miles) are being designated as critical habitat. These areas are 
designated as stream segments, with the lateral extent including the 
riparian areas and streams that occur within the 100year floodplain or 
floodprone areas encompassing a total area of approximately 84,569 
hectares (208,973 acres). The critical habitat is located on a 
combination of Federal, State, tribal, and private lands in Inyo, Kern, 
Los Angeles, Riverside, Santa Barbara, San Bernardino, San Diego, and 
Ventura Counties in California; Clark, Lincoln, and Nye Counties in 
southern Nevada; Kane, San Juan, and Washington Counties in southern 
Utah; Alamosa, Conejos, Costilla, and La Plata Counties in southern

  <description><![CDATA[ We, the U.S. Fish and Wildlife Service (Service), propose to 
list as endangered the Honduran emerald hummingbird (Amazilia luciae) 
under the Endangered Species Act of 1973, as amended (Act). This 
species is endemic to a small area in Honduras, and the population is 
estimated to be less than 1,000 and decreasing. Its suitable habitat 
has decreased in the past 100 years and continues to diminish. This 
document also serves as the completion of the status review (also known 
as the 12month finding). We seek information from the public on the 
proposed listing for this species.
