  <title><![CDATA[  Metal and Nonmetal Dams ]]></title>

  <description><![CDATA[ Dam failures at metal and nonmetal mines have exposed miners 
to lifethreatening hazards. The Mine Safety and Health Administration 
(MSHA) is reviewing its existing metal and nonmetal standards for dams. 
The Agency is concerned that some dams pose hazards because they are 
not designed, constructed, operated, and maintained to accepted dam 
safety practices. MSHA is considering approaches to better protect 
miners from the hazards of dam failures and is soliciting information 
to help determine how best to proceed.

</p><p>    This notice amends the petition for modification submitted by Lone 
Mountain Processing, Inc., on July 15, 2009, (Docket Number M2009024
C). The amendment assigns a separate docket number for each of the 
mines listed. Lone Mountain Processing, Inc., filed a petition for 
modification of existing standard 30 CFR 75.503 (Permissible electric 
face equipment; maintenance) and 30 CFR 18.35 (Portable trailing cables 
and cords) for the Clover Fork No. 1 Mine, (MSHA I.D. No. 1518647), 
Huff Creek No. 1 Mine (MSHA I.D. No. 1517234), and Darby Fork No. 1 
Mine, MSHA I.D. No. 1502263). MSHA published the notice in the Federal 
Register on December 21, 2009 (74 FR 67915). Initially, this petition 
for modification was assigned one docket number. After investigating 
these mines it has been determined that the conditions at the mines are 
different and a separate decision and order will be issued for each 
mine. This requires having separate docket numbers for each mine. A

  <title><![CDATA[  Proposed Information Collection Request Submitted for Public  Comment and Recommendations]]></title>

  <description><![CDATA[ The Department of Labor, as part of its continuing effort to 
reduce paperwork and respondent burden conducts a preclearance 
consultation program to provide the general public and Federal agencies 
with an opportunity to comment on proposed and/or continuing 
collections of information in accordance with the Paperwork Reduction 
Act of 1995 (PRA95) [44 U.S.C. 3506(c)(2)(A)]. This program helps to 
ensure that requested data can be provided in the desired format, 
reporting burden (time and financial resources) is minimized, 
collection instruments are clearly understood, and the impact of 
collection requirements on respondents can be properly assessed. 
Currently, the Mine Safety and Health Administration (MSHA) is 
soliciting comments concerning the proposed extension of the 
information collection related to the applications for a permit to fire

  <description><![CDATA[ Section 101(c) of the Federal Mine Safety and Health Act of 
1977 and 30 CFR Part 44 govern the application, processing, and 
disposition of petitions for modification. This notice is a summary of 
petitions for modification filed by the parties listed below to modify 
the application of existing mandatory safety standards published in  Title 30 of the Code of Federal Regulations.<br/>

  <title><![CDATA[  Proposed Information Collection Request Submitted for Public  Comment and Recommendations; Ventilation Plans, Tests,]]></title>

  <description><![CDATA[ The Department of Labor, as part of its continuing effort to 
reduce paperwork and respondent burden conducts a preclearance 
consultation program to provide the general public and Federal agencies 
with an opportunity to comment on proposed and/or continuing 
collections of information in accordance with the Paperwork Reduction 
Act of 1995 (PRA95) [44 U.S.C. 3506 (c)(2)(A)]. This program helps to 
ensure that requested data can be provided in the desired format, 
reporting burden (time and financial resources) is minimized, 
collection instruments are clearly understood, and the impact of 
collection requirements on respondents can be properly assessed.
</p><p>    Currently, the Mine Safety and Health Administration (MSHA) is 
soliciting comments concerning the extension of the information 
collection related to the 30 CFR Sections 75.310, 312, 342, 351, 360, 
361, 362, 363, 364, 370, 371, and 382.
