  <title><![CDATA[  Agency Information Collection Activities: Proposed Collection,  Comment Request]]></title>

  <description><![CDATA[ To comply with the Paperwork Reduction Act of 1995 (PRA), we 
are inviting comments on a collection of information that we will 
submit to the Office of Management and Budget (OMB) for review and 
approval. This information collection request (ICR) pertains to onshore 
and offshore royalty and production reporting on oil, gas, and 
geothermal leases on Federal and Indian lands. We changed the title of 
this ICR to reflect current regulatory actions. The new title of this 
ICR is ``30 CFR Parts 210 and 212, Royalty and Production Reporting.''
</p><p>    Publication of the final rule, RIN 1010AD20, Reporting Amendments, 
on March 26, 2008 (73 FR 15885), changed a number of citations, 
primarily under 30 CFR part 210. The final rule removed 30 CFR part 216 
and replaced part 210 in its entirety. In this revision, we also 
consolidated the following ICRs to allow programwide review of both 
aspects of reportingremittance of royalties and production accounting  on oil, gas, and geothermal leases:<br/>

  <title><![CDATA[  Outer Continental Shelf (OCS), Gulf of Mexico OCS Region, Mid- Atlantic Proposed Oil and Gas Lease Sale 220]]></title>

  <description><![CDATA[ This Call for Information and Interest/Nominations 
(hereinafter referred to as ``Call'') and the NOI are the initial 
informationgathering steps in a process that incorporates planning and 
analysis for proposed OCS Oil and Gas Lease Sale 220 in the Mid
Atlantic Planning Area in the area offshore the Commonwealth of 
Virginia. The program area is that subarea of the MidAtlantic Planning 
Area offshore Virginia, identified in the OCS Oil and Gas Leasing 
Program, 20072012, that may be offered in proposed Sale 220. Readers 
are cautioned that this announcement is not a commitment to hold a 
lease sale but rather a continuation of the informationgathering and  evaluation process.</p><p>    Simultaneously with this Call, the MMS is giving notice of its 
intent to prepare an EIS for Sale 220 in the MidAtlantic Planning 
Area, scheduled for 2011. The EIS analysis will focus on the potential 
environmental effects of oil and gas exploration, development, and

  <title><![CDATA[  Revisions to Subpart A--General; Subpart I--Platforms and  Structures; and Subpart J--Pipelines and Pipeline]]></title>

  <description><![CDATA[ The MMS is amending its regulations to require lessees, lease 
operators, and pipeline rightofway holders to submit a report if a 
facility or pipeline is damaged by a hurricane or other natural 
phenomena. The final rule also requires operators to provide assessment 
information on the structural integrity of Outer Continental Shelf 
platforms; information on the use of unbonded flexible pipe for 
pipelines; and additional information when installing pipeline risers 
on floating platforms. The rule also incorporates an industrydeveloped 
standard concerning the inservice inspection of mooring hardware for 
floating drilling units. These changes will allow MMS to better 
regulate the safety of the oil and gas infrastructure, and to promptly 
assess damage resulting from hurricanes or other natural phenomena.

  <title><![CDATA[  Royalty Relief for Deepwater Outer Continental Shelf Oil and Gas  Leases--Conforming Regulations to Court Decision]]></title>

  <description><![CDATA[ MMS is delaying until December 8, 2008, 60 days from the date 
of publication, the effective date of a rule that will conform the 
regulations at 30 CFR parts 203 and 260 to the Federal Court's decision 
in Santa Fe Snyder Corp. v. Norton, 385 F.3d 884 (5th Cir. 2004). This 
delay of effective date is necessary to comply with the Congressional 
review provisions of the Small Business Regulatory Enforcement Fairness 
Act of 1996, 5 U.S.C. 801 et seq. (the Congressional Review Act).

from Federal and Indian leases. This docutment corrects the final rule, 
which contained a clerical error in the tables identifying OMBapproved

regulations to the decision of the United States Court of Appeals for 
the Fifth Circuit in Santa Fe Snyder Corp., et al. v. Norton. That 
decision found that certain provisions of the MMS regulations 
interpreting section 304 of the Deep Water Royalty Relief Act are 
contrary to the requirements of the statute. MMS will determine 
lessees' royalty under leases subject to Deep Water Royalty Relief Act 
section 304, for both past and future periods, in a manner consistent 
with the Fifth Circuit's decision in the Santa Fe Snyder case and this  rule.<br/>

  <title><![CDATA[  Gulf of Mexico (GOM), Outer Continental Shelf (OCS), Central  Planning Area (CPA) and Western Planning Area (WPA), Oil]]></title>

  <description><![CDATA[ The MMS has prepared a SEIS on oil and gas lease sales 
tentatively scheduled in 20092012 in the CPA and WPA offshore the 
States of Texas, Louisiana, Mississippi, and Alabama. As mandated in 
the Gulf of Mexico Energy Security Act of 2006 (GOMESA) (Pub. L. 109
432, December 20, 2006), MMS shall offer, as soon as practicable, 
approximately 5.8 million acres located in the southeastern part of the 
CPA (``181 South Area''). The CPA Sale 208 (March 2009) will be the 
first sale to include the ``181 South Area.'' The SEIS analyzed newly 
available information for the potential environmental effects of oil 
and natural gas leasing, exploration, development, and production in  the ``181 South Area.''</p><p>    Authority: This NOA is published pursuant to the regulations (40 
CFR 1503) implementing the provisions of the National Environmental 
Policy Act (NEPA) of 1969, as amended (42 U.S.C. 4321 et seq.

Sale for proposed Sale 208 in the CPA. This Notice is published

With regard to oil and gas leasing on the OCS, the Secretary of the 
Interior, pursuant to section 19 of the OCS Lands Act, provides the 
affected States the opportunity to review the proposed Notice. The 
proposed Notice sets forth the proposed terms and conditions of the 
sale, including minimum bids, royalty rates, and rentals.

would eliminate the need for MMS to grant waivers to the reporting 
requirements in certain situations. The proposed rule would also add 
new definitions providing clarity in the training regulations, which 
should lead to improved training of Outer Continental Shelf workers.

  <title><![CDATA[  Bonus or Royalty Credits for Relinquishing Certain Leases  Offshore Florida]]></title>

  <description><![CDATA[ This final rule amends regulations for oil and gas leases on 
the Outer Continental Shelf to implement a mandate in the Gulf of 
Mexico Energy Security Act of 2006. These amendments (1) provide a 
credit to lessees who relinquish certain eligible leases in the Gulf of 
Mexico; (2) define eligible leases as those within 125 miles of the 
Florida coast in the Eastern Planning Area, and certain leases within 
100 miles of the Florida coast in the Central Planning Area; and (3) 
allow lessees to use the credits in lieu of monetary payment for either 
a lease bonus bid or royalty due on oil and gas production from most 
other leases in the Gulf of Mexico, or to transfer the credits to other 
Gulf of Mexico lessees for their use.

  <title><![CDATA[  Electronic Payment of Fees for Outer Continental Shelf Activities]]></title>

  <description><![CDATA[ This final rule requires that all lessees, operators, 
permittees, and rightofway holders pay all fees for processing plans, 
applications, and permits electronically. This rule will aid industry 
in payment processing and reduce payment processing errors. This rule 
will improve MMS processing efficiency and facilitate the correction of 
industry payment errors. The MMS will not accept checks, money orders, 
or cashier's checks for payment of fees after the effective date of 
this final rule. The final rule also adjusts certain cost recovery fees 
for inflation.

  <title><![CDATA[  Request for Comments on the Preparation of a 5-Year Outer  Continental Shelf (OCS) Oil and Gas Leasing Program]]></title>

  <description><![CDATA[ Section 18 of the OCS Lands Act (43 U.S.C. 1344) requires the 
Department of the Interior to solicit information from interested and 
affected parties during the preparation of a 5year OCS oil and gas 
leasing program. The current 5year program covers the period July 2007 
to June 30, 2012. The Department's MMS is soliciting information on 
whether to begin a new Program for mid2010 to mid2015 (approximate  dates) to succeed the current one.</p><p>    Section 18 requires completion of a multistep process of public 
consultation and analysis before the Secretary of the Interior may 
approve a new 5Year Program. The section 18 process includes the 
following required steps: This initial solicitation of comments; 
development of a draft proposed program, a proposed program, a proposed 
final program; and Secretarial approval. If the decision is made to 
prepare a new 5Year Program, the MMS will also prepare appropriate 
NEPA analysis documents. The public will have opportunities to comment

two potential ``specialinterest'' sales for the Cook Inlet Planning

but past industry interest in the federal offshore area has been  limited.</p><p>    The amount of oil and gas produced in Cook Inlet continues to 
decline and with changing economic conditions there is renewed interest 
in finding additional hydrocarbon resources for the South Central  Alaska.</p><p>    This Request for Information (RFI) seeks to determine the level of 
industry interest, whether it is focused on a few blocks or prospects 
or if there is industry interest in a larger portion of the planning  area.</p><p>    We are also seeking comments from tribal, local, State, and Federal 
agencies, and the general public to evaluate whether MMS should proceed 
with further evaluations pursuant to the Outer Continental Shelf Lands

Director of the Minerals Management Service by the joint bidding 
provisions of 30 CFR 256.41, as a matter of information to the public, 
the MMS published in the Federal Register the current List of 
Restricted Bidders. Under this authority, MMS determined that each 
entity within one of the following groups is restricted from bidding 
with any entity in any other of the following groups at Outer 
Continental Shelf oil and gas lease sales to be held during the bidding 
period May 1, 2008 through October 31, 2008. We inadvertently omitted a 
new group, ``Group IX.,'' that shall be restricted from bidding with 
any entity in any other group of restricted bidders during this bidding

ensure that pipeline companies provide open and nondiscriminatory 
access to their pipelines.

American Petroleum Institute's Specification for Subsurface Safety 
Valve Equipment (API Spec 14A), into the regulations. The rule also 
proposes that lessees and operators provide supporting design 
verification information for subsurface safety valves intended for use 
in high pressure high temperature environments. The MMS proposes to 
incorporate the Eleventh Edition of API Spec 14A because it updated the 
design validation and functional testing requirements, incorporated new  design changes, and corrected ambiguous areas open to <br/>
misinterpretation. These proposed changes would ensure that lessees and 
operators use the best available and safest technologies while  operating in the Outer Continental Shelf.<br/>

  <title><![CDATA[  Allocation and Disbursement of Royalties, Rentals, and Bonuses-- Oil and Gas, Offshore]]></title>

  <description><![CDATA[ The MMS proposes to amend the regulations on distribution and 
disbursement of royalties, rentals, and bonuses to include the 
allocation and disbursement of revenues from certain leases on the Gulf 
of Mexico Outer Continental Shelf in accordance with the provisions of 
the Gulf of Mexico Energy Security Act of 2006. The regulations would 
set forth the formula and methodology for calculating and allocating 
revenues to the States of Alabama, Louisiana, Mississippi, and Texas 
and their eligible political subdivisions. This proposed rule seeks to 
establish and ensure that the process for implementing the Gulf of 
Mexico Energy Security Act of 2006 provisions and the resulting 
distribution of revenues is accurate, transparent, and fully complies 
with our statutory responsibilities.

published in the Federal Register (72 FR 214, pp. 6267362675) a 
request for information and nominations of areas for leases authorizing  alternative energy<br/> [[Page 21153]]<br/>
resource assessment and technology testing activities pursuant to  subsection 8(p) of the OCS Lands Act, as amended.</p><p>    We received over 40 nominations of areas for limited leases 
authorizing such activities relating to wind, wave, and ocean current 
energy resources on the OCS. The MMS has considered the nominations in 
light of relevant criteria for proceeding with the issuance of leases. 
As required by subsection 8(p), MMS must issue such leases on a 
competitive basis unless we determine after public notice that there is 
no competitive interest. Subsection 8(p) also requires MMS to 
coordinate and consult with relevant Federal agencies and affected 
State and local governments concerning the issuance of OCS alternative

  <title><![CDATA[  Incorporate American Petroleum Institute Hurricane Bulletins]]></title>

  <description><![CDATA[ The direct final rule will incorporate by reference three 
American Petroleum Institute hurricane bulletins into MMS's 
regulations. The three bulletins supplement the American Petroleum 
Institute's Recommended Practice 2AWSD, Recommended Practice for 
Planning, Designing, and Constructing Fixed Offshore PlatformsWorking 
Stress Design, which contains engineering design principles and good 
practices for new platforms and assessments of existing platforms. 
These bulletins are needed to increase survivability during hurricane 
events by imposing more stringent design and assessment criteria for 
both new and existing structures located within particular Gulf of 
Mexico areas. By increasing survivability during hurricane conditions, 
fewer platforms will be damaged, thereby, protecting critical oil and 
gas resources and making those resources available after hurricane 
events.

  <title><![CDATA[  Gulf of Mexico (GOM), Outer Continental Shelf (OCS), Central  Planning Area (CPA) and Western Planning Area (WPA), Oil]]></title>

  <description><![CDATA[ The MMS has prepared a draft SEIS on oil and gas lease sales 
tentatively scheduled in 20092012 in the CPA and WPA offshore the 
States of Texas, Louisiana, Mississippi, and Alabama. As mandated in 
the Gulf of Mexico Energy Security Act of 2006 (GOMESA) (Pub. L. 109
432, December 20, 2006), the MMS shall offer, as soon as practicable, 
approximately 5.8 million acres located in the southeastern part of the 
CPA (``181 South Area''). The CPA Sale 208 (March 2009) will be the 
first sale to include the ``181 South Area.'' The draft SEIS analyzed 
the potential environmental effects of oil and natural gas leasing, 
exploration, development, and production in the ``181 South Area'' and  newly available information.</p><p>    Authority: This NOA and notice of public hearings is published

collection of civil penalties and referrals for the consideration of 
criminal penalties, the program is designed to encourage compliance 
with applicable statutes and regulations. The purpose of publishing the

Alternative Energy and Alternate Use (AEAU) proposed rule. The MMS is 
issuing this notice to facilitate public involvement. The preparation 
of this EA is an important step in the rulemaking process. An Advanced 
Notice of Proposed Rulemaking was published in the Federal Register on 
December 30, 2005. A Final Programmatic Environmental Impact Statement 
(FEIS) analyzed the establishment of the MMS AEAU program, of which 
rulemaking is a component. The Programmatic Environmental Impact 
Statement for Alternative Energy Development and Production and 
Alternate Use of Facilities on the Outer Continental Shelf was 
published on November 6, 2007 (OCS EIS/EA MMS 2007046).

  <title><![CDATA[  Bonus or Royalty Credits for Relinquishing Certain Leases  Offshore Florida]]></title>

  <description><![CDATA[ The MMS proposes to amend its regulations for oil and gas 
leases on the Outer Continental Shelf to implement a mandate in the 
Gulf of Mexico Energy Security Act of 2006. This proposed rule would 
(1) provide a credit to lessees who relinquish certain eligible leases 
in the Gulf of Mexico; (2) define eligible leases as those within 125 
miles of the Florida coast in the Eastern Planning Area and certain 
leases within 100 miles of the Florida coast in the Central Planning 
Area; and (3) allow lessees to use the credits in lieu of monetary 
payment for either a lease bonus bid or royalty due on oil and gas 
production from most other leases in the Gulf of Mexico or to transfer 
the credits to other Gulf of Mexico lessees for their use.

  <title><![CDATA[  Cape Wind Energy Project ]]></title>

  <description><![CDATA[ The Minerals Management Service (MMS) is announcing the 
availability of a draft environmental impact statement (EIS) for the 
Cape Wind Energy Project. Cape Wind Associates, LLC (CWA) has requested 
a lease, easement or rightofway pursuant to section 8(p) of the Outer 
Continental Shelf Lands Act (OCSLA) (43 U.S.C 1337) as amended, and 
proposes to construct and operate a wind energy facility on the Outer 
Continental Shelf (OCS) in Nantucket Sound, Massachusetts. The purpose 
of the proposed project is to provide a renewable energy facility that 
utilizes the unique wind resources offshore of New England, using a 
technology that is currently available, technically feasible, and 
economically viable. The project ostensibly is designed to interconnect 
with and deliver electricity to the New England Power Pool (NEPOOL) 
grid, making a substantial contribution to enhancing the region's 
electrical reliability and achieving renewable energy requirements

  <title><![CDATA[  Royalty-in-Kind (RIK) Eligible Refiner, Determination of Need]]></title>

  <description><![CDATA[ The Minerals Management Service (MMS), an agency of the U.S. 
Department of the Interior, is requesting written comments from 
interested parties, particularly refiners who qualify under the RIK 
eligible refiner program, regarding their experiences in the crude oil 
marketplace. Specifically, we are interested in eligible refiners' 
experiences in gaining access to adequate supplies of crude oil at 
equitable prices. This Determination of Need process will assist the 
Secretary of the Interior in deciding whether or not to continue with 
sales of Federal Government royalty crude oil under the RIK eligible 
refiner program.

  <title><![CDATA[  Record of Decision for the Final ``Programmatic Environmental  Impact Statement for Alternative Energy Development and]]></title>

  <description><![CDATA[ MMS prepared the ROD for the establishment of an alternative 
energy and alternate use (AEAU) program on the Outer Continental Shelf 
(OCS), as authorized by Section 388 of the Energy Policy Act of 2005 
(EPAct), and codified in subsection 8(p) of the OCS Lands Act. In 
accordance with the regulations implementing the National Environmental 
Policy Act (NEPA), the MMS is announcing the availability of this ROD. 
The decision is to select the Preferred Alternative described in the 
Final Programmatic Environmental Impact Statement (EIS). This decision 
establishes an AEAU program for the issuance of leases, easements and 
rightsofway (ROW) for alternative energy activities and the alternate  use of<br/> [[Page 1895]]<br/>
structures on the OCS and the promulgation of regulations to govern the 
program. Selection of the Preferred Alternative also provides MMS the 
option to authorize individual projects on a casebycase basis before 
promulgation of the final rule. The Director, MMS signed the ROD on 
December 21, 2007.
