  <title><![CDATA[  Fisheries Off West Coast States; West Coast Salmon Fisheries;  Amendment 14; Essential Fish Habitat Descriptions for]]></title>

  <description><![CDATA[ NMFS issues this final rule to implement Essential Fish 
Habitat (EFH) identifications and descriptions for Pacific salmon 
included in Amendment 14 to the Pacific Salmon Fishery Management Plan 
(Salmon FMP). This final rule codifies the EFH identifications and 
descriptions for freshwater and marine habitats of Pacific salmon 
managed under the Salmon FMP, including Chinook, coho, and pink salmon. 
This action is necessary to comply with an order issued by the U.S. 
District Court for the District of Idaho which directed NMFS to codify 
the EFH identifications and descriptions contained in Amendment 14 to 
the Salmon FMP.

  <title><![CDATA[  Taking of the Cook Inlet, Alaska Beluga Whale Stock by Alaska  Natives]]></title>

  <description><![CDATA[  NMFS issues final regulations establishing long-term limits 
on the maximum number of Cook Inlet beluga whales that may be taken by 
Alaska Natives for subsistence and handicraft purposes. These 
regulations were developed after proceedings and public comment 
connected to an ontherecord rulemaking and hearings before 
Administrative Law Judge (ALJ) Parlen L. McKenna (Judge McKenna); 
consultations with the parties to the hearings, including Alaska Native 
Organizations; and comments received from the public on the Cook Inlet 
Beluga Whale Subsistence Harvest Draft Supplemental Environmental 
Impact Statement (SEIS). These regulations are intended to conserve and 
manage Cook Inlet belugas under applicable provisions of the Marine 
Mammal Protection Act ( MMPA) until the whales are no longer depleted 
under the MMPA.

  <description><![CDATA[ NMFS announces the availability of Amendment 4 to the Spiny 
Lobster Fishery Management Plan (FMP) of Puerto Rico and the U.S. 
Virgin Islands and Amendment 8 to the Joint Spiny Lobster FMP of the 
Gulf of Mexico and South Atlantic prepared by the Caribbean, South 
Atlantic, and Gulf of Mexico Fishery Management Councils (Councils). 
Amendments 4 and 8 would establish minimum conservation standards for 
imported spiny lobster. The intended effect of Amendments 4 and 8 is to 
eliminate the primary market for lobster that do not meet the minimum 
size limit or mean size at sexual maturity, which is expected to result 
in a reduction in the foreign harvest of these undersized animals and 
increase the spawning stock biomass and longterm potential yield 
within the panCaribbean spiny lobster fishery.

measures in the Pacific Coast groundfish fisheries including: trip

limit increases; and modifications to the trawl Rockfish Conservation 
Areas. These routine actions, are authorized by the Pacific Coast 
Groundfish Fishery Management Plan (FMP), and are intended to allow 
fisheries to access more abundant groundfish stocks while protecting 
overfished and depleted stocks.

  <title><![CDATA[  Sea Turtle Conservation; Shrimp Trawling Requirements ]]></title>

  <description><![CDATA[  NMFS issues this temporary rule for a period of 30 days, to 
allow shrimp fishermen to use limited tow times as an alternative to 
Turtle Excluder Devices (TEDs) in state and Federal waters offshore of 
Texas (from the Texas/Louisiana boundary southward to the boundary 
shared by Matagorda and Brazoria Counties; approximately 95[deg] 32'W. 
long.) extending offshore 20 nautical miles. This action is necessary 
because environmental conditions resulting from Hurricane Ike are 
preventing some fishermen from using TEDs effectively.

announces temporary restrictions consistent with the requirements of 
the Atlantic Large Whale Take Reduction Plan's (ALWTRP) implementing 
regulations. These regulations apply to lobster trap/pot and anchored 
gillnet fishermen in an area totaling approximately 1,445 nm\2\ (4,956 
km\2\), southeast of Portland, Maine for 15 days. The purpose of this 
action is to provide protection to an aggregation of northern right 
whales (right whales).

of no more than 10 knots applying to all vessels 65 ft (19.8 m) or 
greater in overall length in certain locations and at certain times of 
the year along the east coast of the U.S. Atlantic seaboard. The 
purpose of the regulations is to reduce the likelihood of deaths and 
serious injuries to endangered North Atlantic right whales that result 
from collisions with ships.

  <description><![CDATA[ NMFS suspends the minimum size limit of 4.75 inches (120 mm) 
for Atlantic surfclams for the 2009 fishing year. This action is taken 
under the authority of the implementing regulations for this fishery, 
which allow for the annual suspension of the minimum size limit based 
upon set criteria. The intended effect is to relieve the industry from 
a regulatory burden that is not necessary, as the majority of surfclams 
harvested are larger than the minimum size limit.

  <title><![CDATA[  Taking of Marine Mammals Incidental to Commercial Fishing  Operations; Atlantic Large Whale Take Reduction Plan]]></title>

  <description><![CDATA[ Pursuant to a preliminary injunction issued in the case, The 
Humane Society of the Unites States, et al. v. Gutierrez, et al., in 
U.S. District Court for the District of Columbia (Civil Action No. 08
cv1593 (ESH)), NMFS is reinstating the Dynamic Area Management (DAM) 
program that was terminated by the October 5, 2007, final rule amending 
the Atlantic Large Whale Take Reduction Plan (ALWTRP). The DAM program 
will be implemented consistent with the previous regulations for this 
program, except that it will only be reinstated north of the pre
existing Seasonal Area Management boundaries (i.e., north of 42[deg]30' 
N. latitude). DAM zones will be established through future notice in 
the Federal Register. The restrictions will be announced to state 
officials, fishermen, Atlantic Large Whale Take Reduction Team (ALWTRT) 
members, and other interested parties through email, phone contact, 
NOAA website, and other appropriate media immediately upon issuance of 
a rule by the AA.

vessels (including vessels issued an IFQ letter of authorization (LOA) 
to fish under appeal), is projected to be landed. This action is being 
taken to prevent IFQ scallop vessels from exceeding the 2008 third 
quarter TAC, in accordance with the regulations implementing Amendment 
11 to the Atlantic Sea Scallop Fishery Management Plan (FMP), enacted 
by Framework 19 to the FMP, and the MagnusonStevens Fishery 
Conservation and Management Act.

satellite data emphasis, and provide the scientific expertise and the

and Thematic Climate Data Records, and is initially focused on 
Fundamental CDRs and lower complexity Thematic CDRs. The SDS Project is 
managed by NOAA, but is informed by other government agencies such that 
its results represent a governmentwide contribution to climate change 
detection, assessment, understanding, adaptation and/or mitigation.

  <description><![CDATA[ NMFS reopens the commercial fishery for deepwater grouper 
(misty grouper, snowy grouper, yellowedge grouper, warsaw grouper, and 
speckled hind) and tilefishes in the exclusive economic zone (EEZ) of 
the Gulf of Mexico. NMFS previously determined that the quotas for 
these commercial fisheries would be reached by May 10, 2008. The latest 
estimates for deepwater grouper and tilefish landings indicate the 
quotas were not reached by that date. Consequently, NMFS will reopen 
these fisheries for 10 days. The purpose of this action is to allow the 
fisheries to maximize harvest benefits and at the same time protect the 
deepwater grouper and tilefish resources.

90day finding for a petition to revise Hawaiian monk seal (Monachus 
schauinslandi) critical habitat under the Endangered Species Act (ESA) 
of 1973, as amended. The Hawaiian monk seal is listed as endangered 
throughout its range, and currently designated critical habitat 
consists of all beach areas, sand spits, and islets, including all 
beach crest vegetation to its deepest extent inland, lagoon waters, 
inner reef waters, and ocean waters out to a depth of 20 fathoms 
(36.6m) around specific areas in the Northwestern Hawaiian Islands. The 
petition seeks to include key beach areas, sand spits, and islets, 
including all beach crest vegetation to its deepest extent inland, 
lagoon waters, inner reef waters, and ocean waters out to a depth of 
200 meters around the main Hawaiian Islands, and to extend critical 
habitat designation in the Northwestern Hawaiian Islands to Sand Island

(HIHWNMS or sanctuary) is seeking applicants for both primary and

Shipping, Conservation, Ocean Recreation, Tourism, and Whale Watching. 
The HIHWNMS is also seeking applicants for alternate members of the 
Native Hawaiian seat and the Fishing seat. Applicants are chosen based 
upon their particular expertise and experience in relation to the seat 
for which they are applying; community and professional affiliations; 
philosophy regarding the protection and management of marine resources; 
and possibly the length of residence in the area affected by the 
Sanctuary. Applicants who are chosen as members should expect to serve 
2year terms, pursuant to the Council's Charter with the exception of

Louisiana boundary) extending offshore 20 nautical miles. This action 
is necessary because environmental conditions resulting from Hurricanes

  <title><![CDATA[  Characterization of the West Coast Deep-set Longline Fishery  Operating Outside of the U.S. Exclusive Economic Zone]]></title>

  <description><![CDATA[ Pursuant to the National Environmental Policy Act (NEPA), the 
National Marine Fisheries Service (NMFS) announces its intent to issue 
an environmental assessment (EA) which analyzes the management options 
for the westcoastbased deepset longline (DSLL) pelagic tuna fishery 
operating on the high seas. The preferred alternative is to allow for 
the continued operation and possible minor expansion of the westcoast
based DSLL pelagic tuna fishery operating on the high seas. Impacts to 
the human environment (e.g., effects of the proposed action on 
protected species, finfish, seabirds, and socioeconomics) were found to 
be insignificant for both alternatives being considered. In 2005 a 
single commercial vessel began participating in the DSLL fishery on the 
high seas; therefore, this EA will provide the needed analysis to 
manage the fishery based on the best available science to ensure that 
the fishery is consistent with all Federal statutes and management 
objectives.

  <title><![CDATA[  NOAA Community-based Restoration Program Guidelines ]]></title>

  <description><![CDATA[ On August 24, 2005 NOAA published a notice in the Federal 
Register that announced revisions to guidelines for the Communitybased 
Restoration Program (Program). The notice requested public comment on 
proposed updates to the guidelines that describe how the Program is 
implemented, and notified the public about a constituent feedback 
meeting that was scheduled for September 13, 2005 in Washington DC. 
This notice makes minor changes to the previously published guidelines 
and responds generally to the comments received, summarizes the 
constituent feedback meeting in Washington, D.C., and highlights 
specific authorization for the Program established in the Magnuson
Stevens Fishery Conservation and Management Reauthorization Act of 
2006. NOAA expects to periodically update these guidelines every 3 to 5 
years to reflect the evolution of the Program. This is not a 
solicitation of project proposals.

Department of Commerce has approved the revised management plan for the  Padilla Bay National Estuarine Research Reserve.</p><p>    The Padilla Bay Reserve was designated in 1980 pursuant to Section 
315 of the Coastal Zone Management Act of 1972, as amended, 16 U.S.C. 
1461. The reserve has been operating under a management plan approved 
in 1980. Pursuant to 15 CFR Section 921.33(c), a state must revise

  <title><![CDATA[  Fisheries of the Exclusive Economic Zone Off Alaska; Revised  Management Authority for Dark Rockfish in the Bering Sea]]></title>

  <description><![CDATA[ NMFS issues a proposed rule that would implement Amendment 73 
to the Fishery Management Plan for Groundfish of the Bering Sea and 
Aleutian Islands Management Area and Amendment 77 to the Fishery 
Management Plan for Groundfish of the Gulf of Alaska (collectively, 
Amendments 73/77). If approved, Amendments 73/77 would remove dark 
rockfish (Sebastes ciliatus) from both fishery management plans (FMPs). 
The State of Alaska (State) would then assume management of dark 
rockfish catch by Statepermitted vessels in the Bering Sea and 
Aleutian Islands Management Area and the Gulf of Alaska. This action is 
necessary to allow the State of Alaska to implement more responsive, 
regionally based management of dark rockfish than is currently possible 
under the FMPs. This action would improve conservation and management 
of dark rockfish and is intended to promote the goals and objectives of 
the MagnusonStevens Fishery Conservation and Management Act, the FMPs, 
and other applicable laws.

fishing quota (IFQ) program for the commercial red snapper fishery in 
the Gulf of Mexico, the Administrator, Southeast Region, NMFS (RA) has 
determined that catastrophic conditions exist in those parts of Texas 
and Louisiana from the mouth of the Mississippi River west to Freeport, 
Texas as a result of recent hurricanes. Consistent with those 
regulations, the RA has authorized IFQ participants within this 
affected area to use paperbased forms, if necessary, for basic 
required IFQ administrative functions, e.g., landing transactions, 
until October 24, 2008. This determination of catastrophic conditions 
and allowance of alternative methods for completing required IFQ 
administrative functions is intended to facilitate continuation of IFQ 
operations during the period of catastrophic conditions.

is not authorizing harpoon gear for the harvest of Atlantic tunas in 
the Highly Migratory Species (HMS) Charter/Headboat (CHB) category as 
originally proposed. The purpose of this final rule is to ensure 
fishermen harvest Atlantic tunas within quotas, size limits, or other 
established limitations and to distinguish green[dash]stick fishing 
gear from current definitions of other authorized gear types. This 
final rule also addresses use of sea turtle control devices in the PLL 
and BLL fisheries to achieve and maintain low post[dash]release 
mortality of sea turtles thus maintaining consistency with the 2004 
Biological Opinion (BiOp) for the Atlantic PLL fishery and to increase

action is necessary because the directed harvest allocation total for 
the third allocation period (September 15  December 31) is projected 
to be reached. From the date of closure until the new fishing season 
begins on January 1, 2009, Pacific sardine may only be harvested 
incidental to other fisheries, with incidental harvest constrained by a 
20percent by weight incidental catch rate. Fishing vessels must be in 
the process of offloading at the time of closure.

  <description><![CDATA[ NMFS proposes regulations to implement Amendment 27 to the 
Fishery Management Plan for Bering Sea/Aleutian Islands King and Tanner 
Crabs (FMP). These proposed regulations would amend the Crab 
Rationalization Program to: implement the statutory requirements of 
section 122(e) of the MagnusonStevens Fishery Conservation and 
Management Reauthorization Act that specifically directs NMFS to modify 
how individual processing quota (IPQ) use caps apply to a person who is 
custom processing Chionoecetes opilio crab in the North Region, clarify 
that for other crab fisheries, IPQ crab that is processed at a facility  through contractual<br/> [[Page 54347]]<br/>
arrangements with the facility owners would not be applied against the 
IPQ use cap of the facility owners provided specific conditions are 
met, and modify IPQ use caps that limit the amount of IPQ that may be 
used at a facility by persons processing Eastern Aleutian Islands 
golden king crab and Western Aleutian Islands red king crab. This

relevant Federal laws.

and Management Act (MagnusonStevens Act). NMFS is considering 
modifying the language describing the content and purpose of the Stock 
Assessment and Fishery Evaluation (SAFE) Report or related documents, 
and adding language regarding peer review processes, the role of the 
scientific and statistical committees (SSCs) of the Regional Fishery 
Management Councils (Councils), and the relationship between peer 
reviews and SSCs.

an overfished species, within its 2008 optimum yield (OY).

  <title><![CDATA[  Fisheries of the Exclusive Economic Zone Off Alaska; Revised  Management Authority for Dark Rockfish in the Bering Sea]]></title>

  <description><![CDATA[ The North Pacific Fishery Management Council has submitted 
Amendment 73 to the Fishery Management Plan for Groundfish of the 
Bering Sea and Aleutian Islands Management Area and Amendment 77 to the 
Fishery Management Plan for Groundfish of the Gulf of Alaska 
(collectively, Amendments 73/77) for Secretarial (Commerce) approval. 
If approved, Amendments 73/77 would remove dark rockfish (Sebastes 
ciliatus) from both fishery management plans (FMPs). Consequently, the 
State of Alaska would then assume management of dark rockfish in the 
Bering Sea and Aleutian Islands Management Area and the Gulf of Alaska. 
This action is necessary to allow the State of Alaska to implement more 
responsive, regionally based management of dark rockfish than is 
currently possible under the FMPs. This action would improve 
conservation and management of dark rockfish and is intended to promote 
the goals and objectives of the MagnusonStevens Fishery Conservation 
and Management Act, the FMPs, and other applicable laws.
