The Act requires the Commission to publish notice of any amendments issued, or proposed to be issued and grants the Commission the authority to issue and make immediately effective any amendment to an operating license upon a determination by the Commission that such amendment involves no significant hazards consideration, notwithstanding the pendency before the Commission of a request for a hearing from any person.

This notice includes notices of amendments containing sensitive unclassified nonsafeguards information (SUNSI).

Office of New Reactors; Final Interim Staff Guidance on Finalizing Licensing Basis Information

The NRC is issuing its Final Interim Staff Guidance (ISG) DC/ COLISG011 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML092890623). This ISG is to clarify the NRC staff position on finalizing licensing basis information at a point during the licensing review, a socalled freeze point, and the control of licensing basis information during and following the initial review of applications for design certifications (DCs) or combined licenses (COLs). The NRC staff issues COL/DCISGs to facilitate timely implementation of current staff guidance and to facilitate activities associated with review of applications for DCs and COLs by the Office of New Reactors (NRO). The NRC staff intends to incorporate the final approved DC/COLISG011 into the next revision of Regulatory Guide 1.206, ``Combined License Applications for Nuclear Power Plants.''

Draft Safety Culture Policy Statement: Request for Public Comments

The NRC is issuing a draft policy statement that sets forth the Commission's expectation that all licensees and certificate holders \1\ establish and maintain a positive safety culture that protects public health and safety and the common defense and security when carrying out licensed activities. The Commission defines safety culture as that assembly of characteristics, attitudes, and behaviors in organizations and individuals which establishes that as an overriding priority, nuclear safety and security issues \2\ receive the attention warranted by their significance. The Commission also considers nuclear safety and security issues to be equally important in a positive safety culture. The importance of treating safety and security in an equal manner within NRC's regulatory framework is clearly evident in our mission and strategic goals. The purpose of this ISG is to modify and provide early site permit (ESP), design certification (DC) and combined license (COL) applicants additional clarity and guidance for the application of Section C.III.4 of Regulatory Guide (RG) 1.206. In addition, the ISG provides additional clarity to the guidance in NUREG0800, Standard Review Plan Chapter 1.0, for NRC review of DC and COL applications. While reviewing DC and COL applications, the NRC staff determined that the guidance in Section C.III.4 of RG 1.206 on COL information items that cannot be resolved before the issuance of a license needed some additional clarification and guidance. The Nuclear Regulatory Commission (NRC) is confirming the effective date of October 19, 2009, for the direct final rule that was published in the Federal Register on August 5, 2009. This direct final rule amended the NRC's regulations on governing vessel head inspection requirements. This amendment revised the upper range of the percentage of axial flaws permitted in a specimen set used for the qualification of nondestructive examination systems (procedures, personnel and equipment), which are used in the performance of inservice inspection (ISI) of pressurized water reactor (PWR) upper vessel head penetrations. This amendment was made as a result of the withdrawal of a stakeholder's recommendation necessitated by a typographical error in the original recommendation with respect to the maximum percentage of flaws that should be oriented axially.

Revisions to Environmental Review for Renewal of Nuclear Power Plant Operating Licenses

On July 31, 2009, the Nuclear Regulatory Commission (NRC) published a proposed rule for public comment that would amend its environmental protection regulations by updating the NRC's 1996 findings on the environmental impacts related to the renewal of operating licenses for nuclear power plants. The NRC stated that it intends to review the assessment of impacts and update it on a 10year cycle, if necessary. The proposed rule redefines the number and scope of the environmental impact issues that must be addressed by the NRC in conjunction with the review of applications for nuclear power facility license renewal. On August 10, 2009, the Nuclear Regulatory Commission (NRC) published for public comment a supplemental proposed rule that would amend the requirements that govern domestic licensing of production and utilization facilities and licenses, certifications, and approvals for nuclear power plants to allow current and certain future power reactor licensees and applicants to choose to implement a riskinformed alternative to the current requirements for analyzing the performance of emergency core cooling systems (ECCS) during lossofcoolant accidents (LOCA). The proposed amendments would also establish procedures and acceptance criteria for evaluating certain changes in plant design and operation based upon the results of the new analyses of ECCS performance.

By letter dated March 19, 2009 (Agency Documents Access Management System [ADAMS] Accession No. ML091600258), USEI requested an exemption from the requirements in 10 CFR Part 110, ``Export and Import of Nuclear Equipment and Material,'' for a specific license to import waste from Canada.

An inspection of the Licensee's activities was conducted on September 22 and 23, 2008, at its Noblesville, Indiana office. The results of this inspection indicated that the Licensee had not conducted its activities in full compliance with NRC requirements. Introduction

The U.S. Nuclear Regulatory Commission (NRC) is proposing to exempt all NRC medical use licensees from certain requirements in 10 CFR 35.60(b), 10 CFR 35.100(a)(1) and 35.200(a)(1), and 10 CFR 32.72. These requirements govern calibration tests that use technetium99m, and distribution of molybdenum99/technetium99m generators and technetium 99m radioactive drugs to and from medical use licensees. NRC is issuing these exemptions to ensure that available technetium99 is being used for patient administrations during any period of United States and worldwide shortages of molybdenum99, which is used to produce molybdenum99/technetium99m generators for medical use.

These exemptions will be effective only when there are United States shortages of technetium99m caused by production shortages of molybdenum99, as documented in writing by the supplier of molybedenum 99/technetium99m generators or technetium99m.

On January 6, 1982 (47 FR 596 and 47 FR 600), the U.S. Nuclear Regulatory Commission (NRC) published in the Federal Register final amendments to 10 CFR Parts 71 and 73 (effective July 6, 1982), that require advance notification to Governors or their designees by NRC licensees prior to

The NBSR is a tanktype, heavywatermoderatedandcooled test reactor licensed to operate at a steadystate power level of 20 megawatts thermal power. Renewed Facility Operating License No. TR5 will expire at midnight 20 years from its date of issuance.

The NRC is issuing its Final Interim Staff Guidance (ISG) DC/ COLISG007 (ML091490565). This ISG provides clarification of the NRC position on identifying winter precipitation events as site characteristics and site parameters for determining normal and extreme winter precipitation loads on the roofs of Seismic Category I structures.

The NRC staff issues ISGs to facilitate timely implementation of the current staff guidance and to facilitate activities associated with review of applications for early site permits and combined licenses for the Office of New Reactors. On May 18, 2009 (74 FR 23254), the Nuclear Regulatory Commission (NRC) published for public comment a proposed rule that would amend certain emergency preparedness (EP) requirements in its regulations that govern domestic licensing of production and utilization facilities. A conforming provision would also be added in the regulations that govern licenses, certifications, and approvals for new nuclear power plants. The proposed amendments would codify certain voluntary protective measures contained in NRC Bulletin 200502, ``Emergency Preparedness and Response Actions for SecurityBased Events,'' and other generically applicable requirements similar to those previously imposed by Commission orders. The Nuclear Regulatory Commission (NRC) is making available preliminary draft proposed rule language to amend its regulations to add a new part 37 to Title 10 of the Code of Federal Regulations. This new part 37 will contain the security (physical protection) requirements that are designed to provide reasonable assurance of preventing the theft or diversion of category 1 and category 2 quantities of radioactive material as designated by the International Atomic Energy Agency (IAEA). The new provisions will address background investigations, access control, physical security during use, and physical security during any transport of category 1 and category 2 quantities of radioactive material. At this time, the staff is only posting the preliminary draft language for the background
investigations and access control program. These requirements will be contained in subpart B of the new part 37. The draft preliminary language for the transportation security was noticed in November 2008 (73 FR 69590

The Nuclear Regulatory Commission (NRC) will consider the issues raised in a petition for rulemaking (PRM) submitted by Bob Christie (petitioner) in the NRC's rulemaking process. The petition was dated May 2, 2002, and was docketed as PRM5077. The petitioner requested that the NRC amend its regulations at 10 CFR Part 50, Appendix A, to eliminate the requirement for assuming a lossofoffsite power (LOOP) coincident with postulated accidents. The petitioner believes this requirement is detrimental to safety because it results in fast start time requirements for emergency diesel generators (EDG) and because it requires operator training to focus on unrealistic events.

Keith Davis (Mr. Davis) was previously employed as a Senior Reactor Operator (SRO) at PPL Corporation's Susquehanna Steam Electric Station (SSES or the facility), located in Berwick, Pennsylvania. Mr. Davis was the holder of SRO License Number SOP11801, issued by the Nuclear Regulatory Commission (NRC or Commission) pursuant to 10 CFR part 55. The license authorized Mr. Davis to direct the licensed activities of SSES licensed operators, and to manipulate the controls of the facility. The license was terminated on August 1, 2006.

The Nuclear Regulatory Commission (NRC) is considering whether to propose to amend its rule governing annual fees to establish a variable annual fee structure for power reactors based on licensed power limits. Current regulations governing annual fees require that each operating power reactor pay the same annual fee, regardless of the size of the reactor. The final rule implements the U.S. Environmental Protection Agency's (EPA's) revised standards for doses that could occur after 10,000 years, but within the period of geologic stability. The final rule also specifies a range of values for the deep percolation rate to be used to represent climate change after 10,000 years, as called for by EPA, and specifies that calculations of radiation doses for workers use the same weighting factors that EPA is using for calculating individual doses to members of the public.

I. Background

Pursuant to section 189a.(2) of the Atomic Energy Act of 1954, as amended (the Act), the U.S. Nuclear Regulatory Commission (the Commission or NRC staff) is publishing this regular biweekly notice. The Act requires the Commission publish notice of any amendments issued, or proposed to be issued and grants the Commission the authority to issue and make immediately effective any amendment to an operating license upon a determination by the Commission that such amendment involves no significant hazards consideration,
notwithstanding the pendency before the Commission of a request for a hearing from any person.

This biweekly notice includes all notices of amendments issued, or proposed to be issued from December 18, 2008 to December 30, 2008. The last biweekly notice was published on December 30, 2008 (73 FR 79928). The Nuclear Regulatory Commission (NRC) is confirming the effective date of January 12, 2009 for the direct final rule that was published in the Federal Register on October 27, 2008 (73 FR 63621). This direct final rule amended the NRC's regulations to revise the NAC UMS cask system listing to include Amendment No. 5 to Certificate of Compliance (CoC) No. 1015.

Notice is hereby given that the staff of the Nuclear Regulatory Commission (NRC) has prepared a model safety evaluation (SE) relating to the modification of technical specification (TS) 3.6.3, Containment Isolation Valves associated with implementation of BAW 2461A, ``RiskInformed Justification for Containment Isolation Valve Allowed Outage Time Change.'' The NRC staff has also prepared a model license amendment request and a model nosignificanthazards consideration (NSHC) determination relating to this matter. The purpose of these models is to permit the NRC to efficiently process amendments that propose to modify TS Completion Times (CTs) for CIVs. Licensees of nuclear power reactors to which the models apply can then request amendments after confirming

The U.S. Nuclear Regulatory Commission (the Commission) is considering issuance of an amendment to Facility Operating License No. DPR20 issued to Entergy Nuclear Operations, Inc. (ENO, the licensee), for operation of the Palisades Nuclear Plant located in Covert, Michigan.
