  <title><![CDATA[  Designation of an Enhanced Driver's License and Identity Document  Issued by the State of New York as a Travel]]></title>

  <description><![CDATA[ This notice announces that the Secretary of Homeland Security 
has designated enhanced driver's licenses and identity documents (EDLs) 
issued by the State of New York (New York) as acceptable documents to 
denote identity and citizenship for purposes of entering the United 
States at land and sea ports of entry upon implementation of Section 
7209 of the Intelligence Reform and Terrorism Prevention Act of 2004. 
U.S. citizens possessing these EDLs will be permitted to present the 
EDLs as acceptable documents under Western Hemisphere Travel Initiative 
(WHTI) when entering the United States at land and sea ports of entry.

  <title><![CDATA[Organization and Operations of Federal Credit Unions; Underserved  Areas (IRPS 08-2)]]></title>

  <description><![CDATA[ NCUA is adopting a final rule implementing four modifications 
to its Chartering and Field of Membership Manual to update and clarify 
the process of approving credit union service to ``underserved areas.'' 
First, the rule clarifies the procedure for establishing that an 
``underserved area'' qualifies as a local community. Second, it makes 
explicit the process for applying the economic distress criteria that 
determine whether an area combining multiple geographic units is 
sufficiently ``distressed'' to qualify as ``underserved.'' Third, it 
updates the documentation and clarifies the scope requirements for 
demonstrating that a proposed area has ``significant unmet needs'' for 
loans and financial services. Finally, the rule utilizes data provided 
by NCUA on the location of depository institution facilities to 
determine whether an area is ``underserved by other depository 
institutions'' according to the presence of their facilities within the 
area.

  <title><![CDATA[  Pipeline Posting Requirements Under Section 23 of the Natural Gas  Act]]></title>

  <description><![CDATA[ In this Final Rule, the Commission adds regulations to require 
certain major noninterstate natural gas pipelines to post daily 
scheduled volume information and design capacity for certain points. 
The Commission also revises its regulations to require interstate 
natural gas pipelines to post information regarding the provision of 
nonotice service. The posting requirements will facilitate price 
transparency in markets for the sale or transportation of physical 
natural gas in interstate commerce to implement section 23 of the 
Natural Gas Act, 15 U.S.C. 717t2 (2000 & Supp. V 2005).

  <title><![CDATA[
Amendment to the Universal Waste Rule: Addition of  Pharmaceuticals]]></title>

  <description><![CDATA[ EPA is proposing to add hazardous pharmaceutical wastes to the 
Universal Waste Rule. The Universal Waste Rule, originally promulgated 
on May 11, 1995, modified the Resource Conservation and Recovery Act's 
hazardous waste regulations by establishing a set of streamlined 
requirements for the collection of certain widely dispersed hazardous 
wastes, called ``universal wastes.'' This proposed rule would 
facilitate better management of pharmaceutical wastes by streamlining 
the generator requirements and encouraging generators of hazardous 
pharmaceutical wastes to manage them under the provisions of the 
Universal Waste Rule, which ensures that these hazardous pharmaceutical 
wastes are properly disposed of and treated as hazardous wastes. In 
addition, this proposed rule would facilitate the implementation of 
pharmaceutical takeback programs by removing RCRA barriers in the 
collection of pharmaceutical wastes from health care and other such 
regulated facilities, as well as facilitate the collection of

  <title><![CDATA[  Endangered and Threatened Wildlife and Plants; 12-Month Finding  on a Petition To List the Northern Mexican]]></title>

  <description><![CDATA[ We, the U.S. Fish and Wildlife Service (Service), announce a 
12month finding on a petition to list the northern Mexican gartersnake 
(Thamnophis eques megalops) as threatened or endangered with critical 
habitat under the Endangered Species Act of 1973, as amended (Act). The 
petitioners provided three listing options for consideration by the 
Service: (1) Listing the U.S. population as a Distinct Population 
Segment (DPS); (2) listing Thamnophis eques megalops throughout its 
range in the United States and Mexico based on its rangewide status; or 
(3) listing Thamnophis eques megalops throughout its range in the 
United States and Mexico based on its status in the United States. On 
the basis of the best scientific and commercial information available, 
we find that listing the northern Mexican gartersnake as threatened or 
endangered throughout its range in the United States and Mexico, based 
on its rangewide status, is warranted under the Act, due to the present

  <title><![CDATA[  Medicaid Program; Premiums and Cost Sharing ]]></title>

  <description><![CDATA[ This final rule implements and interprets the provisions of 
sections 6041, 6042, and 6043 of the Deficit Reduction Act of 2005 
(DRA), and section 405(a)(1) of the Tax Relief and Health Care Act of 
2006 (TRHCA). The DRA was amended by the TRHCA which revised sections 
6041, 6042, and 6043 of the DRA including limitations on cost sharing 
for individuals with family incomes at or below 100 percent of the 
federal poverty line. These sections amended the Social Security Act 
(the Act) by adding a new section 1916A to provide State Medicaid 
agencies with increased flexibility to impose premium and cost sharing 
requirements on certain Medicaid recipients. This flexibility 
supplements the existing authority States have to impose premiums and 
cost sharing under section 1916 of the Act. The DRA provisions also 
specifically address cost sharing for nonpreferred drugs and non
emergency care furnished in a hospital emergency department.

  <title><![CDATA[  Mandatory Guidelines for Federal Workplace Drug Testing Programs]]></title>

  <description><![CDATA[ This Final Notice of Revisions to the Mandatory Guidelines for 
Federal Workplace Drug Testing Programs (Revisions to Mandatory 
Guidelines) addresses collection and testing of urine specimens, the 
requirements for the certification of Instrumented Initial Test 
Facilities (IITFs), and the role of and standards for collectors and 
Medical Review Officers (MROs). Additional notices of Proposed 
Revisions to the Mandatory Guidelines addressing the use of point of 
collection testing (POCT), oral fluid testing, sweat patch testing, 
hair testing, and associated issues will be published at a later date. 
With regard to the use of alternative specimens including hair, oral 
fluid, and sweat patch specimens in Federal Workplace Drug Testing 
Programs, significant issues have been raised by Federal agencies 
during the review process which require further examination, and may

  <description><![CDATA[ To help prevent terrorist weapons from being transported to 
the United States, vessel carriers bringing cargo to the United States 
are required to transmit certain information to Customs and Border 
Protection (CBP) about the cargo they are transporting prior to lading 
that cargo at foreign ports of entry. This interim final rule requires 
both importers and carriers to submit additional information pertaining 
to cargo to CBP before the cargo is brought into the United States by 
vessel. This information must be submitted to CBP by way of a CBP
approved electronic data interchange system. The required information 
is reasonably necessary to improve CBP's ability to identify highrisk 
shipments so as to prevent smuggling and ensure cargo safety and 
security. These regulations specifically fulfill the requirements of 
section 203 of the Security and Accountability for Every (SAFE) Port 
Act of 2006 and section 343(a) of the Trade Act of 2002, as amended by 
the Maritime Transportation Security Act of 2002<script type="text/javascript">

``Regulatory Planning and Review,'' and the Regulatory Flexibility Act, 
as amended, the Department of Commerce (Department), in the spring and 
fall of each year, publishes in the Federal Register an agenda of 
regulations under development or review over the next 12 months. 
Rulemaking actions are grouped according to prerulemaking, proposed 
rules, final rules, longterm actions, and rulemaking actions completed 
since the spring 2008 agenda. The purpose of the agenda is to provide 
information to the public on regulations currently under review, being 
proposed, or issued by the Department. The agenda is intended to 
facilitate comments and views by interested members of the public.
</p><p>    The Department's fall 2008 regulatory agenda includes 
regulatory activities that are expected to be conducted during the 
period October 1, 2008, through September 30, 2009.

  <description><![CDATA[ The Regulatory Flexibility Act requires that agencies publish 
semiannual regulatory agendas in the Federal Register describing 
regulatory actions they are developing that may have a significant 
economic impact on a substantial number of small entities (5 U.S.C. 
602). Executive Order 12866 ``Regulatory Planning and Review,'' signed 
September 30, 1993 (58 FR 51735), as amended, and Office of Management 
and Budget memoranda implementing section 4 of that Order establish 
minimum standards for agencies' agendas, including specific types of 
information for each entry. Section 4 of Executive Order 12866 also 
directs that each agency prepare, as part of its submission to the fall 
edition of the Unified Agenda, a regulatory plan of the most important 
significant regulatory actions that the agency reasonably expects to 
issue in proposed or final form during the upcoming fiscal year. The

  <title><![CDATA[  Advance Information on Private Aircraft Arriving and Departing  the United States]]></title>

  <description><![CDATA[ This rule finalizes, with modifications, amendments to U.S. 
Customs and Border Protection (CBP) regulations pertaining to private 
aircraft arriving and departing the United States. This final rule 
requires private aircraft pilots or their designees arriving in the 
United States from a foreign port or location destined for a U.S. port 
or location, or departing the United States to a foreign port or 
location, to transmit electronically to CBP passenger manifest 
information for each individual traveling onboard the aircraft. This 
final rule requires private aircraft pilots or their designees to 
provide additional data elements when submitting a notice of arrival 
and requires private aircraft pilots or their designees to submit a 
notice of departure. Private aircraft pilots (or their designees) will 
be required to submit the notice of arrival and notice of departure 
information to CBP through an approved electronic data interchange 
system in the same transmission as the corresponding arrival or

July 25, 2008 (73 FR 43385) with comments due on or before September 
23, 2008. The comment period was extended by a notice published in the 
Federal Register on September 8, 2008 (73 FR 51962), to October 23, 
2008. This notice reopens the comment period to afford interested 
parties an opportunity to consider the impact, if any, of the proposed 
rule on the country of origin of their goods in view of the publication 
of a final rule document in today's Federal Register which sets forth 
technical corrections to Sec. Sec.  102.20 and 102.21 of the CBP 
regulations (19 CFR 102.20 and 102.21).

and resource conservation and to respond to several court decisions 
concerning the definition of solid waste.

  <title><![CDATA[  Large Aircraft Security Program, Other Aircraft Operator Security  Program, and Airport Operator Security Program]]></title>

  <description><![CDATA[ The Transportation Security Administration (TSA) proposes to 
amend current aviation transportation security regulations to enhance 
the security of general aviation by expanding the scope of current 
requirements and by adding new requirements for certain large aircraft 
operators and airports serving those aircraft. TSA is proposing to 
require that all aircraft operations, including corporate and private 
operations, with aircraft with a maximum certificated takeoff weight 
(MTOW) above 12,500 pounds (``large aircraft'') adopt a large aircraft 
security program (LASP). This security program would be based on the 
current security program that applies to operators providing scheduled  or charter services.</p><p>    TSA also proposes to require large aircraft operators to contract 
with TSAapproved auditors to conduct audits of the operators' 
compliance with their security programs and with TSAapproved watch
list service providers to verify that their passengers are not on the

  <title><![CDATA[  Importer Self-Assessment Product Safety Pilot ]]></title>

  <description><![CDATA[ This document announces the expansion of the Importer Self-
Assessment Program (ISA) to include the Importer SelfAssessment
Product Safety Pilot (ISAPS). The ISAPS is a partnership that will be 
created among CBP, the Consumer Product Safety Commission (CPSC), and 
importers which will strive to maintain a high level of product safety 
compliance, and to achieve the goals of the Interagency Working Group 
on Import Safety by working collaboratively to prevent unsafe imports. 
The ISAPS is a voluntary approach to product safety compliance, which 
will provide recognition and support to participating companies. 
Application to the ISAPS is open to all importers who are participants 
in the ISA. CBP and CPSC staff will designate a limited number of 
importers from the initial applicants and determine their eligibility 
for participation in the pilot program. This document contains 
information on the application process, the benefits, and continued 
participation requirements.

Revenue Service interest rates used to calculate interest on overdue 
accounts (underpayments) and refunds (overpayments) of customs duties. 
For the calendar quarter beginning October 1, 2008, the interest rates 
for overpayments will be 5 percent for corporations and 6 percent for 
noncorporations, and the interest rate for underpayments will be 6 
percent. This notice is published for the convenience of the importing 
public and Customs and Border Protection personnel.

  <title><![CDATA[  Assessment and Mitigation of Claims for Liquidated Damages for  Nonpayment or Late Payment of Estimated Duties Under]]></title>

  <description><![CDATA[ This document announces guidelines for the assessment of 
claims for liquidated damages and the mitigation of those claims when 
participants in the National Customs Automation Program (NCAP) test for 
the Periodic Monthly Statement Payment Process fail to pay estimated 
duties in the time period prescribed by law. In addition, CBP may 
exercise the authority to suspend any bond principal (the importer of 
record) from participation in the Periodic Monthly Payment Statement 
test and require that the bond principal pay estimated duties and fees 
on an entrybyentry basis. Further, CBP may exercise the authority to 
require the bond principal to file entry summary documentation with 
estimated duties and fees attached before merchandise is released from 
any CBP port.

regulations to provide, on a limited and categorical basis, a more 
streamlined process for nonimmigrant aliens infected with the human 
immunodeficiency virus (HIV) to enter the United States as visitors on 
temporary visas (for business or pleasure) for up to 30 days. 
Nonimmigrant aliens who do not meet the specific requirements of the 
rule or who do not wish to consent to the conditions imposed by this 
rule may elect to seek admission under current procedures and obtain a 
casebycase determination of their eligibility for a waiver of the 
nonimmigrant visa requirements concerning inadmissibility for aliens 
who are infected with HIV.

to foreign private issuers that are intended to enhance the information 
that is available to investors. These amendments are part of a series 
of initiatives that seek to effect changes in our disclosure and other 
requirements applicable to foreign private issuers in light of market 
developments, new technologies and other matters in a manner that 
promotes investor protection and crossborder capital flows. We are 
adopting amendments that would enable foreign issuers to test their 
eligibility to use the special forms and rules available to foreign 
private issuers once a year, rather than continuously. We also are 
adopting amendments to change the deadline for annual reports filed by 
foreign private issuers and to eliminate an option under which foreign 
private issuers are permitted to omit segment data from their U.S. GAAP 
financial statements, and an amendment to the rule pertaining to going

  <description><![CDATA[ EPA is proposing national emissions standards for hazardous 
air pollutants for nine area source categories in the chemical 
manufacturing sector: Agricultural Chemicals and Pesticides 
Manufacturing, Cyclic Crude and Intermediate Production, Industrial 
Inorganic Chemical Manufacturing, Industrial Organic Chemical 
Manufacturing, Inorganic Pigments Manufacturing, Miscellaneous Organic 
Chemical Manufacturing, Plastic Materials and Resins Manufacturing, 
Pharmaceutical Production, and Synthetic Rubber Manufacturing. The 
proposed standards and associated requirements for the nine area source 
categories are combined in one subpart. The proposed emissions 
standards for new and existing sources are based on EPA's determination 
regarding the generally available control technology or management 
practices for the nine area source categories. EPA is coproposing an 
alternative to the requirements for process vents emitting metal 
hazardous air pollutants. The alternative would set a higher size

promulgated under the hazardous waste provisions of the Resource 
Conservation and Recovery Act (RCRA) regarding the export and import of

proposing to modify: The requirements to implement the OECD framework 
concerning the transboundary movement of hazardous waste among 
countries belonging to the Organization for Economic Cooperation and 
Development (OECD), including reducing the number of control levels, 
exempting qualifying shipments sent for laboratory analyses from 
certain paperwork requirements, requiring recovery facilities to submit 
a certificate of recovery, adding provisions for the return or re
export of wastes subject to the Amber control procedures, and 
clarifying certain existing provisions that were identified as

HOPE for Homeowners Program: Program Regulations ]]></title>

  <description><![CDATA[ This final rule sets forth the core requirements for the HOPE 
for Homeowners Program that have been established by the Board of 
Directors (Board) of the HOPE for Homeowners Program (Program). A new 
section 257 of the National Housing Act (NHA) provides the authority 
for this Program and oversight requirements to be performed by the 
Board. Specifically, section 257(c)(1) of the NHA requires the Board to 
prescribe such regulations as may be necessary or appropriate to 
implement the Program. The Board has determined that the regulations 
set forth in this rule are necessary and appropriate for the 
implementation and effective administration of the Program.

                National Breast Cancer Awareness Month, 2008

                 A Proclamation<br/>

                During National Breast Cancer Awareness Month, we 
                underscore our commitment to fighting and preventing 
                this devastating disease. Breast cancer is one of the 
                most common types of cancer among women, and we must 
                strengthen our support of those who are living with 
                this disease while continuing to work toward a cure.

                Breast cancer can be attributed to many factors, 
                including age, genetics, obesity, and family history. 
                Women who exercise regularly, maintain healthy diets, 
                and have yearly visits with their doctors are less 
                likely to get breast cancer. Various screening measures 
                such as mammograms, regular breast self-exams, and 
                clinical breast exams can help detect cancer before it 
                has a chance to spread. Early detection allows for 
                early intervention, helps make treatment more 
                effective, and gives hope to patients and saves lives.

                America leads the world in medical research, and my 
                Administration will continue to support efforts to 
                treat and cure breast cancer. Since 2005, the Cancer 
                Genome Atlas has studied the genetic sources of all 
                types of cancer, and last year, I signed the ``National 
                Breast and Cervical Cancer Early Detection Program 
                Reauthorization Act of 2007,'' which will help millions 
                of low-income and uninsured women get the screenings 
                they need to detect cancer early. First Lady Laura Bush 
                has encouraged women around the world to take charge of 
                their health and emphasized the importance of 
                screenings and early detection. In partnership with 
                Federal agencies, State health agencies, and other 
                medical professionals, my Administration has taken 
                action to improve our Nation's healthcare system and 
                helped promote the prevention, detection, and treatment                  of breast cancer.<br/>

                This month, we honor those currently battling the 
                disease and all who have survived the fight against 
                breast cancer. We are inspired by their strength and 
                determination. We recognize and applaud the hard-
                working caregivers and researchers who are dedicated to 
                providing comfort and assistance to those with breast 
                cancer and to treating and curing this disease. We also 
                remember those lost to breast cancer and extend our                  thoughts and prayers to their families.<br/>

                NOW, THEREFORE, I, GEORGE W. BUSH, President of the 
                United States of America, by virtue of the authority 
                vested in me by the Constitution and the laws of the 
                United States, do hereby proclaim October 2008 as 
                National Breast Cancer Awareness Month. I call upon

                During National Disability Employment Awareness Month, 
                we reaffirm our commitment to ensuring that our 
                Nation's promise extends to all our citizens.

                Millions of Americans live with disabilities, and many 
                other Americans will become disabled at some point in 
                their lives. To integrate people with disabilities more 
                fully into every aspect of life, our country is working 
                to advance greater freedoms at work, in schools, and 
                throughout communities. By expanding employment 
                opportunities and fighting false perceptions that 
                hinder people living with disabilities from joining the 
                workforce, we can uphold America's moral values, 
                strengthen our economy, and make America a more hopeful                  place.<br/>

                More than 7 years ago, my Administration announced the 
                New Freedom Initiative, which expanded upon the 
                landmark reforms of the Americans with Disabilities 
                Act. Since then, the Initiative has increased access 
                for people with disabilities through technology, 
                provided additional educational opportunities for 
                youth, and integrated more Americans into the 
                workforce. My Administration remains committed to 
                empowering all people to reach their full educational,

                National Domestic Violence Awareness Month, 2008

                By the President of the United States of America
                 A Proclamation<br/>

                Our Nation has a moral obligation to work to prevent 
                domestic violence and address its brutal and 
                destructive effects. During National Domestic Violence 
                Awareness Month, we underscore our commitment to 
                helping individuals across our country who face such                  devastating violence.<br/>

                My Administration remains dedicated to eradicating 
                domestic violence and helping victims find the 
                compassion, comfort, and healing they need. In 2003, I 
                announced the creation of the Family Justice Center 
                Initiative to help local communities provide 
                comprehensive services at one location for victims of 
                domestic violence. In 2006, I was proud to sign 
                legislation that reauthorized the Violence Against 
                Women Act to improve criminal justice responses to 
                domestic violence, sexual assault, and stalking. The 
                Department of Justice's Domestic Violence Transitional 
                Housing Assistance Program also offers victims of 
                violence counseling and transitional housing services                  so they can escape the cycle of abuse.<br/>

                During this month, we rededicate ourselves to 
                protecting vulnerable members of our society and 
                ensuring domestic abusers are punished to the full 
                extent of the law. We encourage victims of domestic 
                violence and their families to seek assistance through 
                Family Justice Centers and the National Domestic 
                Violence Hotline at 1-800-799-SAFE. Together, we can 
                help heal hearts and build a culture in which all 
                Americans can pursue their dreams and realize the great                  promise of our Nation.<br/>

                NOW, THEREFORE, I, GEORGE W. BUSH, President of the 
                United States of America, by virtue of the authority

petroleum and petroleum products and organic chemicals for customs 
purposes, in accordance with the provisions of 19 CFR 151.12 and 19 CFR

analyses and gauger services should request and receive written 
assurances from the entity that it is accredited or approved by the 
U.S. Customs and Border Protection to conduct the specific test or

  <title><![CDATA[DEPARTMENT OF THE TREASURY ]]></title>

  <description><![CDATA[ This document amends Customs and Border Protection (CBP) 
regulations to reflect both continuing and new import restrictions on 
certain archaeological material from Cambodia. Import restrictions that 
were previously imposed by CBP Decision 0328 on certain stone, metal, 
and ceramic archaeological materials that are due to expire on 
September 19, 2008, are extended. The Assistant Secretary for 
Educational and Cultural Affairs, United States Department of State, 
has made the requisite determination for the extension of import 
restrictions that previously existed and for amending the agreement so 
that it applies also to archaeological material of the Bronze and Iron 
Ages. Accordingly, these import restrictions will remain in effect 
until September 19, 2013, and title 19 of the CBP regulations is being 
amended to reflect this amended bilateral agreement. These restrictions 
are being extended pursuant to determinations of the United States 
Department of State made under the terms of the 1970 Conventio<script type="text/javascript">

country of origin of a ground fault circuit interrupter (``GFCI'').

determination that China is the country of origin of the GFCI for 
purposes of U.S. Government procurement.

  <title><![CDATA[  Technical Amendment to List of User Fee Airports: Addition of  Valley International Airport, Harlingen, TX]]></title>

  <description><![CDATA[ This document amends the Customs and Border Protection (CBP) 
Regulations by revising the list of user fee airports to reflect the 
recent user fee airport designation for Valley International Airport in 
Harlingen, Texas. User fee airports are those airports which, while not 
qualifying for designation as int
