  <description><![CDATA[ The United States Mint is setting prices for the Martin Van  Buren First Spouse Gold Proof and Uncirculated Coins.</p><p>    Pursuant to 31 U.S.C. 5112(o), and in accordance with 31 U.S.C. 
9701(b)(2)(B), the United States Mint is setting the price of these 
coins to reflect the market price of gold. These prices are consistent 
with recently repriced, previously introduced 2008 First Spouse Gold  Coins.</p><p>    Effective November 25, 2008, the United States Mint will commence 
selling Van Buren First Spouse Gold Proof and Uncirculated Gold Coins  according to the following price schedule:<br/>

  <description><![CDATA[ The United States Mint is adjusting prices for its American 
Eagle Gold and Platinum Coins, American Buffalo Gold Coins, and First  Spouse Gold Coins.</p><p>    Pursuant to the authority that 31 U.S.C. 5111(a) and 5112(k) grant 
the Secretary of the Treasury to mint and issue gold and platinum 
coins, and to prepare and distribute numismatic items, the United 
States Mint mints and issues 2008 American Eagle Gold and Platinum 
Coins, American Buffalo Gold Coins, and First Spouse Gold Coins. In 
accordance with 31 U.S.C. 9701(b)(2)(B), the United States Mint is

land. This rule allows the Secretary to further fulfill his fiduciary 
responsibilities to federally recognized tribes and individual Indians 
and to meet the Indian trust management policies articulated by 
Congress in the Indian Land Consolidation Act (ILCA), as amended by the 
American Indian Probate Reform Act of 2004 (AIPRA).

Compliance Agreement ]]></title>

  <description><![CDATA[ This notice is being published in the Federal Register 
consistent with section 457(b)(2) of the General Education Provisions 
Act (GEPA). Section 457 of GEPA authorizes the U.S. Department of 
Education (the Department) to enter into a compliance agreement with a 
recipient that is failing to comply substantially with Federal program 
requirements. In order to enter into a compliance agreement, the 
Department must determine, in written findings, that the recipient 
cannot comply with the applicable program requirements until a future 
date and that a compliance agreement is a viable means of bringing  about such compliance.</p><p>    On August 29, 2008, the Department entered into a compliance 
agreement with the Hawaii Department of Education (HIDOE). Section 
457(b)(2) of GEPA requires the Department to publish written findings 
leading to a compliance agreement, with a copy of the compliance 
agreement, in the Federal Register.

beginning January 12, 2009, all nonimmigrant aliens traveling to the 
United States under the Visa Waiver Program (VWP) must obtain an 
approved travel authorization from the Department's Electronic System 
for Travel Authorization (ESTA). To comply with ESTA, VWP travelers 
must provide electronically to U.S. Customs and Border Protection (CBP) 
the information currently collected on the I94W Nonimmigrant Alien 
Arrival/Departure (Form I94W) through the CBP ESTA Web site and 
receive authorization to travel before embarking on travel to the 
United States.

                Continuation of the National Emergency with                  Respect to Iran<br/>

                On November 14, 1979, by Executive Order 12170, the 
                President declared a national emergency with respect to 
                Iran pursuant to the International Emergency Economic 
                Powers Act (50 U.S.C. 1701-1706), to deal with the 
                unusual and extraordinary threat to the national 
                security, foreign policy, and economy of the United 
                States constituted by the situation in Iran. Because 
                our relations with Iran have not yet returned to 
                normal, and the process of implementing the January 19, 
                1981, agreements with Iran is still underway, the 
                national emergency declared on November 14, 1979, must 
                continue in effect beyond November 14, 2008. Therefore, 
                consistent with section 202(d) of the National 
                Emergencies Act (50 U.S.C. 1622(d)), I am continuing 
                for 1 year this national emergency with respect to                  Iran.<br/>

  <description><![CDATA[ The U.S. Fish and Wildlife Service (hereinafter Service or we) 
is proposing to establish the 200809 earlyseason hunting regulations 
for certain migratory game birds. We annually prescribe frameworks, or 
outer limits, for dates and times when hunting may occur and the 
maximum number of birds that may be taken and possessed in early 
seasons. Early seasons may open as early as September 1, and include 
seasons in Alaska, Hawaii, Puerto Rico, and the U.S. Virgin Islands. 
These frameworks are necessary to allow State selections of specific 
final seasons and limits and to allow recreational harvest at levels 
compatible with population status and habitat conditions. This proposed 
rule also provides the final regulatory alternatives for the 200809 
duck hunting seasons.

preliminarily determined that: Each of the 19 chemical substances 
included in this proposed rule is produced in substantial quantities 
and that there is or may be substantial human exposure to each of them; 
there are insufficient data to reasonably determine or predict the 
effects on health or the environment of the manufacture, distribution 
in commerce, processing, use, or disposal of the chemicals, or of any 
combination of these activities; and the testing program proposed here

regulations for Fitness for Duty (FFD) programs to update these
requirements and enhance consistency with advances in other relevant
Federal rules and guidelines, including the U.S. Department of Health
and Human Services (HHS) Mandatory Guidelines for Federal Workplace
Drug Testing Programs, and other Federal drug and alcohol testing
programs that impose similar requirements on the private sector. The
amendments require nuclear power plant licensees and other entities,
including facilities possessing Category 1A material, to strengthen the
effectiveness of their FFD programs. In addition, the amendments
require nuclear power plant licensees and other entities to enhance
consistency between with the FFD programs with NRC's access
authorization requirements for nuclear power plants. The amendments
also require nuclear power plant licensees to ensure against worker
fatigue adversely affecting public health and safety and the common

proof denominations with the following weights: Oneounce, onehalf

  <title><![CDATA[  Mandatory Reliability Standards for Critical Infrastructure  Protection]]></title>

  <description><![CDATA[ Pursuant to section 215 of the Federal Power Act (FPA), the 
Commission approves eight Critical Infrastructure Protection (CIP) 
Reliability Standards submitted to the Commission for approval by the 
North American Electric Reliability Corporation (NERC). The CIP 
Reliability Standards require certain users, owners, and operators of 
the BulkPower System to comply with specific requirements to safeguard 
critical cyber assets. In addition, pursuant to section 215(d)(5) of 
the FPA, the Commission directs NERC to develop modifications to the 
CIP Reliability Standards to address specific concerns.

  <description><![CDATA[ We are proposing to amend temporary rules that were published 
on December 21, 2006, in Release No. 338760 [71 FR 76580]. These 
temporary rules require companies that are nonaccelerated filers to 
include in their annual reports, pursuant to rules implementing Section 
404(b) of the SarbanesOxley Act of 2002, an attestation report of 
their independent auditor on internal control over financial reporting 
for fiscal years ending on or after December 15, 2008. Under the 
proposed amendments, a nonaccelerated filer would be required to 
provide the auditor's attestation report on internal control over 
financial reporting in an annual report filed for fiscal years ending 
on or after December 15, 2009.

                Continuation of the National Emergency Relating 
                to Cuba and of the Emergency Authority Relating to the 
                Regulation of the Anchorage and Movement of Vessels

                On March 1, 1996, by Proclamation 6867, a national 
                emergency was declared to address the disturbance or 
                threatened disturbance of international relations 
                caused by the February 24, 1996, destruction by the 
                Cuban government of two unarmed U.S.-registered 
                civilian aircraft in international airspace north of 
                Cuba. In July 1996 and on subsequent occasions, the 
                Cuban government stated its intent to forcefully defend 
                its sovereignty against any U.S.- registered vessels or 
                aircraft that might enter Cuban territorial waters or 
                airspace while involved in a flotilla or peaceful 
                protest. Since these events, the Cuban government has 
                not demonstrated that it will refrain from the future 
                use of reckless and excessive force against U.S. 
                vessels or aircraft that may engage in memorial 
                activities or peaceful protest north of Cuba. On 
                February 26, 2004, by Proclamation 7757, the scope of 
                the national emergency was expanded in order to deny 
                monetary and material support to the repressive Cuban 
                government, which had taken a series of steps to 
                destabilize relations with the United States, including 
                threatening to abrogate the Migration Accords with the 
                United States and to close the United States Interests 
                Section. Further, Cuba's most senior officials 
                repeatedly asserted that the United States intended to 
                invade Cuba, despite explicit denials from the U.S. 
                Secretaries of State and Defense that such action is 
                planned. Therefore, in accordance with section 202(d) 
                of the National Emergencies Act (50 U.S.C. 1622(d)), I 
                am continuing the national emergency with respect to 
                Cuba and the emergency authority relating to the 
                regulation of the anchorage and movement of vessels set 
                out in Proclamation 6867 as amended and expanded by                  Proclamation 7757.<br/>
