proposed collection of information, including each proposed extension 
of currently approved collection, and allow 60 days for public comment

final rule setting forth a mechanism for States to obtain payments from 
VA to assist a State veterans home in the hiring and retention of 
nurses for the purpose of reducing nursing shortages at the home. This 
rule implements provisions of the Veterans Health Programs Improvement 
Act of 2004.

  <title><![CDATA[  Medicaid Program; State Flexibility for Medicaid Benefit Packages]]></title>

  <description><![CDATA[ This final rule will implement provisions of section 6044 of 
the Deficit Reduction Act of 2005, which amends the Social Security Act 
by adding a new section 1937 related to the coverage of medical 
assistance under approved State plans. It also provides States 
increased flexibility under an approved State plan to define the scope 
of covered medical assistance by offering coverage of benchmark or 
benchmarkequivalent benefit packages to certain Medicaid recipients. 
In addition, this final rule responds to public comments on the 
February 22, 2008, proposed rule that pertain to the State Medicaid 
benefit package provisions.

  <description><![CDATA[ The Secretary issues final regulations governing the 
Assistance to States for Education of Children with Disabilities 
Program and the Preschool Grants for Children with Disabilities 
Program. These regulations are needed to clarify and strengthen current 
regulations in 34 CFR Part 300 governing the Assistance to States for 
the Education of Children with Disabilities Program and Preschool 
Grants for Children with Disabilities Program, as published in the 
Federal Register on August 14, 2006, in the areas of parental consent 
for continued special education and related services; nonattorney 
representation in due process hearings; State monitoring, technical 
assistance, and enforcement; and allocation of funds. The regulations 
also incorporate a statutory requirement relating to positive efforts 
to employ and advance in employment individuals with disabilities that 
was inadvertently omitted from the 2006 regulations.

  <title><![CDATA[  List of Fisheries for 2009 ]]></title>

  <description><![CDATA[ The National Marine Fisheries Service (NMFS) publishes its 
final List of Fisheries (LOF) for 2009, as required by the Marine 
Mammal Protection Act (MMPA). The final LOF for 2009 reflects new 
information on interactions between commercial fisheries and marine 
mammals. NMFS must categorize each commercial fishery on the LOF into 
one of three categories under the MMPA based upon the level of serious 
injury and mortality of marine mammals that occurs incidental to each 
fishery. The categorization of a fishery in the LOF determines whether 
participants in that fishery are subject to certain provisions of the 
MMPA, such as registration, observer coverage, and take reduction plan 
requirements.

  <title><![CDATA[  Track Safety Standards; Continuous Welded Rail (CWR) ]]></title>

  <description><![CDATA[ FRA is proposing to amend the Federal Track Safety Standards 
to promote the safety of railroad operations over continuous welded 
rail (CWR). In particular, FRA is proposing specific requirements for 
the qualification of persons designated to inspect CWR track, or 
supervise the installation, adjustment, or maintenance of CWR track. 
FRA is also proposing to clarify the procedures associated with the 
submission of CWR plans to FRA by track owners. FRA proposes that these 
plans focus on inspecting CWR for pullapart prone conditions, and 
focus more specifically on CWR joint installation and maintenance 
procedures. This proposed rule would also make other changes to the 
requirements governing CWR.

  <title><![CDATA[  National Registry of Certified Medical Examiners ]]></title>

  <description><![CDATA[ The FMCSA proposes to establish and maintain a National 
Registry of Certified Medical Examiners (NRCME) and to require that all 
medical examiners who conduct medical examinations for interstate 
commercial motor vehicle drivers complete certain training concerning 
FMCSA physical qualification standards, pass a test to verify an 
understanding of those standards, and maintain competence by periodic 
training and testing. Following establishment of the NRCME and a 
transition period, FMCSA would accept as valid only medical examiners' 
certificates issued by medical examiners listed on the NRCME. The FMCSA 
is developing the NRCME program to improve highway safety and driver 
health by requiring that medical examiners be trained and certified to 
determine effectively whether a commercial motor vehicle driver's 
health meets FMCSA standards. The program implements requirements in 49 
U.S.C. 31149 and supports FMCSA's goal to improve safety and reduce 
fatalities on our Nation's highways.

  <title><![CDATA[  Medical Certification Requirements as Part of the CDL ]]></title>

  <description><![CDATA[ FMCSA amends the Federal Motor Carrier Safety Regulations 
(FMCSRs) to require interstate commercial driver's license (CDL) 
holders subject to the physical qualification requirements of the 
FMCSRs to provide a current original or copy of their medical 
examiner's certificates to their State Driver Licensing Agency (SDLA). 
The Agency also requires the SDLA to record on the Commercial Driver 
License Information System (CDLIS) driver record the selfcertification 
the driver made regarding the applicability of the Federal driver 
qualification rules and, for drivers subject to those requirements, the 
medical certification status information specified in this final rule. 
Other conforming requirements are also implemented. This action is 
required by section 215 of the Motor Carrier Safety Improvement Act of 
1999 (MCSIA).

Law 92463 (Federal Advisory Committee Act) that a meeting of the 
Clinical Science Research and Development Service Cooperative Studies 
Scientific Evaluation Committee will be held on January 7, 2009, at the 
St. Gregory Hotel, 2033 M Street, NW., Washington, DC. The session is  scheduled to begin at 8 a.m. and end at 4 p.m.</p><p>    The Committee advises the Chief Research and Development Officer 
through the Director of the Clinical Science Research and Development 
Service on the relevance and feasibility of proposed projects and the

  <description><![CDATA[ The Environmental Protection Agency (EPA or the Agency) is 
finalizing an alternative set of generator requirements applicable to 
laboratories owned by eligible academic entities, as defined in this 
final rule. The rule provides a flexible and protective set of 
regulations that address the specific nature of hazardous waste 
generation and accumulation in laboratories at colleges and 
universities, as well as other eligible academic entities formally 
affiliated with colleges and universities. This final rule is optional 
and colleges and universities and other eligible academic entities 
formally affiliated with a college or university have the choice of 
managing their hazardous wastes in accordance with the new alternative 
regulations as set forth in this final regulation or remaining subject 
to the existing generator regulations.

Standards of Performance for New Stationary Sources and Emission  Guidelines for Existing Sources:]]></title>

  <description><![CDATA[ On September 15, 1997, EPA adopted new source performance 
standards (NSPS) and emission guidelines (EG) for hospital/medical/
infectious waste incinerators (HMIWI). The NSPS and EG were established 
under sections 111 and 129 of the Clean Air Act (CAA or Act). The 
Sierra Club and the Natural Resources Defense Council (Sierra Club) 
filed suit in the U.S. Court of Appeals for the District of Columbia 
Circuit (the Court) challenging EPA's methodology for adopting the 
regulations. On March 2, 1999, the Court remanded the rule to EPA for 
further explanation of the Agency's reasoning in determining the 
minimum regulatory ``floors'' for new and existing HMIWI. The Court did 
not vacate the regulations, so the NSPS and EG remain in effect and  were fully implemented by September 2002.</p><p>    On February 6, 2007, EPA published a proposed response to the 
Court's remand and a proposed response to the CAA section 129(a)(5) 
requirement to review the NSPS and EG every 5 years. However, following

regulations which set forth a mechanism for paying per diem to State 
homes providing nursing home care to eligible veterans. More

Information Technology Act of 2006, and to make several other changes 
to better ensure that veterans receive quality care in State homes.

Effluent Limitations Guidelines and Standards for the  Construction and Development Point Source Category]]></title>

  <description><![CDATA[ The Environmental Protection Agency is proposing a regulation 
that would strengthen the existing regulatory program for discharges 
from construction sites by establishing technologybased Effluent 
Limitations Guidelines and New Source Performance Standards for the 
Construction and Development (C&D) point source category. This 
proposal, if implemented, would significantly reduce the amount of 
sediment and other pollutants discharged from construction sites. EPA 
estimates that this proposed rule would cost $1.9 billion dollars per 
year with annual monetized benefits of $332.9 million. This proposed 
rule requests comment and information on the proposed regulation and an 
alternate option with a different numeric limit based on different 
technologies, as well as specific aspects of the proposal such as 
technologies, costs, loading reductions, and economic achievability.

                 Proclamation 8323 of November 25, 2008<br/>
  <br/>
                To Provide for Duty-free Treatment Under the 
                Earned Import Allowance Program, And for Other Purposes

                By the President of the United States of America
                 A Proclamation<br/>

                 1. Section 404 of the Dominican Republic-Central 
                America-United States Free Trade Agreement 
                Implementation Act (the ``CAFTA-DR Act''), as added by 
                section 2 of Public Law 110-436, 122 Stat. 4976, 
                provides for preferential tariff treatment of eligible 
                apparel articles wholly assembled in an eligible 
                country and imported directly from an eligible country, 
                if such articles are accompanied by an earned import 
                allowance certificate issued under a program                  established by the Secretary of Commerce.<br/>

                 2. Section 404(e)(1) of the CAFTA-DR Act, as amended, 
                provides that the program providing this preferential 
                treatment shall be in effect for the 10-year period 
                beginning on the date on which the President certifies 
                to the appropriate congressional committees that 
                sections A, B, C, and D of the Annex to Presidential 
                Proclamation 8213 of December 20, 2007, have taken                  effect.<br/>

                 3. On August 7, 2008, the United States Trade 
                Representative (USTR) published a notice in the Federal 
                Register (73 FR 46057) announcing that August 15, 2008, 
                would be the effective date for sections A, B, C, and D 
                of the Annex to Presidential Proclamation 8213.

                 4. I have determined, and hereby certify, that the 
                provisions of Proclamation 8213 referenced in section 
                404(e)(1) of the CAFTA-DR Act, as amended, have taken                  effect.<br/>

                 5. Section 6002 of the Africa Investment Incentive Act 
                of 2006 (division D, title VI of Public Law 109-432) 
                (the ``2006 Act'') amended section 112(c) of the 
                African Growth and Opportunity Act (AGOA) (19 U.S.C. 
                3721(c)) to modify the preferential tariff treatment 
                accorded to designated lesser developed beneficiary                  sub-Saharan African countries.<br/>

                 6. Pursuant to section 6002 of the 2006 Act, in 
                Proclamation 8114 of March 19, 2007, I proclaimed 
                modifications to the Harmonized Tariff Schedule of the 
                United States (HTS) to provide the tariff treatment 
                authorized by the 2006 Act. The HTS provisions 
                proclaimed in Proclamation 8114 were modified by 
                Proclamation 8157 of June 28, 2007, and Proclamation 
                8240 of April 17, 2008, to provide the tariff treatment                  authorized by the 2006 Act.<br/>

                 7. Section 3 of Public Law 110-436 amends section 
                112(c) of the AGOA to modify the tariff treatment 
                applicable to lesser developed beneficiary sub-Saharan 
                African countries, and to provide that Mauritius is to 
                be treated as a lesser developed beneficiary sub-
                Saharan African country for purposes of the AGOA.

                 8. Accordingly, in order to reflect the amendments to 
                section 112(c) of the AGOA, I have determined that it 
                is appropriate to modify the HTS to reflect the tariff 
                treatment provided to lesser developed beneficiary sub-
                Saharan African countries and to provide that Mauritius 
                is to be treated as a lesser developed beneficiary sub-
                Saharan African country for purposes of the AGOA.

                 9. Section 203(e)(1)(A)(i) of the Andean Trade 
                Preference Act, as amended (ATPA) (19 U.S.C. 
                3202(e)(1)(A)(i)), authorizes the President to withdraw 
                or suspend the designation of any country as a 
                beneficiary country for purposes of the ATPA if, after 
                such designation, the President determines that as a 
                result of changed circumstances such country should be 
                barred from designation as a beneficiary country.

                10. Section 3103 of the Andean Trade Promotion and Drug 
                Eradication Act (Title XXXI of the Trade Act of 2002, 
                Public Law 107-210) (ATPDEA) amended section 203(e)(1) 
                of the ATPA (19 U.S.C. 3202(e)(1)) by adding a new 
                subparagraph (B)(i) authorizing the President to 
                withdraw or suspend the designation of any country as a 
                beneficiary country for purposes of the ATPDEA if, 
                after such designation, the President determines that, 
                as a result of changed circumstances, the performance 
                of such country is not satisfactory under the 
                eligibility criteria set forth in section 204(b)(6)(B) 
                of the ATPA, as amended (19 U.S.C. 3203(b)(6)(B)).

                 11. Section 203(e)(2)(A) of the ATPA, as amended (19 
                U.S.C. 3202(e)(2)(A)) requires the President to publish 
                notice of the action he proposes to take at least 30 
                days before taking action under section 203(e)(1) (19                  U.S.C. 3202(e)(1)).<br/>

                 12. On October 1, 2008, the USTR, at my direction, 
                published a notice in the Federal Register (73 FR 
                57158) announcing that I proposed to suspend the 
                designation of Bolivia as a beneficiary country for 
                purposes of the ATPA and the ATPDEA based on Bolivia's 
                failure to satisfy the eligibility criteria set forth 
                in section 203(d)(11) and section 204(b)(6)(B)(v) of 
                the ATPA, as amended (19 U.S.C. 3202(d)(11),                  3203(b)(6)(B)(v)).<br/>

                 13. I have determined that Bolivia no longer satisfies 
                the eligibility criterion in section 203(d)(11) of the 
                ATPA, as amended. Therefore, pursuant to section 
                203(e)(1)(A)(i) of the ATPA, I have determined that, as 
                a result of this changed circumstance, Bolivia's 
                designation as an ATPA beneficiary country should be                  suspended.<br/>

                 14. I have determined that Bolivia is no longer 
                performing satisfactorily under the eligibility 
                criterion in section 204(b)(6)(B)(v) of the ATPA, as 
                amended. Therefore, pursuant to section 203(e)(1)(B)(i) 
                of the ATPA, I have determined that, as a result of 
                this changed circumstance, Bolivia's designation as an 
                ATPDEA beneficiary country should be suspended.

                 15. Presidential Proclamation 6641 of December 15, 
                1993, implemented the North American Free Trade 
                Agreement (NAFTA) with respect to the United States 
                and, pursuant to the North American Free Trade 
                Agreement Implementation Act (Public Law 103-182) (the 
                ``NAFTA Implementation Act''), incorporated in the HTS 
                the tariff modifications and rules of origin necessary                  or appropriate to carry out the NAFTA.<br/>

                 16. Section 202 of the NAFTA Implementation Act (19 
                U.S.C. 3332) provides rules for determining whether 
                goods imported into the United States originate in the 
                territory of a NAFTA country and thus are eligible for 
                the tariff and other treatment contemplated under the 
                NAFTA. Section 202(q) of the NAFTA Implementation Act 
                (19 U.S.C. 3332(q)) authorizes the President to 
                proclaim, as a part of the HTS, the rules of origin set 
                out in the NAFTA, and to proclaim modifications to such 
                previously proclaimed rules of origin, subject to the 
                consultation and layover requirements of section 103(a) 
                of the NAFTA Implementation Act (19 U.S.C. 3313(a)).

                 17. The United States and Canada have agreed to modify 
                certain NAFTA rules of origin and to apply the modified 
                rules to their bilateral trade. It is therefore 
                necessary to modify the NAFTA rules of origin set out                  in Proclamation 6641.<br/>

                 18. Section 1230 of the Tax Relief and Health Care Act 
                of 2006 (Public Law 109-432) temporarily modified the 
                rate of duty on triphenyl phosphine. Modifications to 
                the HTS are necessary to provide the intended tariff                  treatment.<br/>

                19. Presidential Proclamation 7011 of June 30, 1997, 
                implemented the World Trade Organization Ministerial 
                Declaration on Trade in Information Technology Products 
                for the United States. Annex 1 to that proclamation 
                failed to include certain products. Technical 
                corrections and conforming changes to the HTS are 
                necessary to provide the intended tariff treatment for                  those products.<br/>

                 20. Section 604 of the Trade Act of 1974, as amended 
                (19 U.S.C. 2483) (the ``1974 Act''), authorizes the 
                President to embody in the HTS the substance of 
                relevant provisions of that Act, or other acts 
                affecting import treatment, and of actions taken                  thereunder.<br/>

                NOW, THEREFORE, I, GEORGE W. BUSH, President of the 
                United States of America, acting under the authority 
                vested in me by the Constitution and the laws of the 
                United States of America, including section 404 of the 
                CAFTA-DR Act, as amended, section 104 of the AGOA, 
                section 202 of the NAFTA Implementation Act, section 
                203 of the ATPA, as amended, section 604 of the 1974 
                Act, and section 301 of title 3, United States Code, do                  proclaim that:<br/>

                (1) In order to provide the tariff treatment for 
                eligible articles provided for in section 404 of the 
                CAFTA-DR Act, as added by Public Law 110-436, the HTS 
                is modified as set forth in Annex A to this                  proclamation.<br/>

                 (2) In order to reflect changes to the tariff 
                treatment for certain apparel products under the AGOA, 
                U.S. note 5 to subchapter XIX of chapter 98 of the HTS, 
                subheadings 9819.15.10 through 9819.15.42, inclusive, 
                and the superior text thereto are deleted from the HTS, 
                effective with respect to articles entered, or 
                withdrawn from warehouse for consumption, on or after                  October 31, 2008.<br/>

                (3) For purposes of section 112(c) of the AGOA, as 
                amended, Mauritius is included as a lesser developed 
                beneficiary sub-Saharan African country effective with 
                respect to articles entered, or withdrawn from 
                warehouse for consumption, on or after October 31,                  2008.<br/>

                 (4) The designation of Bolivia as a beneficiary 
                country for purposes of the ATPA and ATPDEA is 
                suspended effective on December 15, 2008. Accordingly, 
                effective on that date, general note 11(a) to the HTS 
                is modified by deleting ``Bolivia'' from the list of 
                ATPA beneficiary countries. Further, general note 11(d) 
                to the HTS is modified by deleting ``Bolivia'' from the 
                list of ATPDEA beneficiary countries. In addition, U.S. 
                note 1 to subchapter XXII of chapter 98 of the HTS is 
                modified by removing ``Bolivia'' from the list of                  ATPDEA beneficiary countries.<br/>

                (5) In order to modify the rules of origin under the 
                NAFTA, general note 12 to the HTS is modified as set                  forth in Annex B to this proclamation.<br/>

                (6) (a) The modifications to the HTS set forth in Annex 
                A to this proclamation shall be effective with respect 
                to articles entered, or withdrawn from warehouse for 
                consumption, on or after the date set forth in Annex A.

                     (b) The modifications to the HTS set forth in 
                Annex B to this proclamation shall enter into effect on 
                the date that the USTR announces in a notice published 
                in the Federal Register that Canada has completed its 
                applicable domestic procedures to give effect to 
                corresponding modifications to be applied to goods of 
                the United States and shall be effective with respect 
                to goods of Canada entered, or withdrawn from warehouse 
                for consumption, on or after the date indicated in the                  notice.<br/>

                (7) In order to provide the intended tariff treatment 
                to triphenyl phosphine and to correct the error 
                identified in paragraph 19, the HTS is modified as                  provided in Annex C to this proclamation.<br/>

                (8) The modifications to the HTS made in Annex C to 
                this proclamation shall be effective with respect to 
                articles entered, or withdrawn from warehouse for 
                consumption, on or after the date set out in that                  Annex.<br/>

                (9) The USTR shall notify the Congress of this 
                proclamation and my certification as provided in 
                section 404(e) of the CAFTA-DR Act, as amended.

                (10) Any provisions of previous proclamations and 
                Executive Orders that are inconsistent with the actions 
                taken in this proclamation are superseded to the extent                  of such inconsistency.<br/>

                Provision of Marine War Risk Insurance Coverage

                Memorandum for the Secretary of State[,] the Secretary 
                of Transportation [and] the Director of the Office of                  Management And Budget<br/>

                By virtue of the authority vested in me by the 
                Constitution and laws of the United States, including 3 
                U.S.C. 301 and 46 U.S.C. chapter 539, I hereby approve 
                the provision by the Secretary of Transportation of 
                insurance or reinsurance of vessels (including cargo 
                and crew) against loss or damage from war risks in the 
                manner and to the extent provided in chapter 539 of 
                title 46, United States Code, for trade in the Black 
                Sea, whenever, after consultation with the Secretary of 
                State, it appears to the Secretary of Transportation 
                that such insurance adequate for the needs of the 
                water-borne commerce of the United States cannot be 
                obtained on reasonable terms and conditions from 
                companies authorized to do insurance business in a 
                State of the United States. To the extent individual 
                policies involve an exposure in excess of the amounts 
                available in the War Risk Revolving Fund, such policies 
                may be issued only after consultation with the Office 
                of Management and Budget. This approval to provide 
                insurance or reinsurance is effective for 90 days, 
                except that existing policies shall remain in force 
                pursuant to the terms of these policies. I hereby 
                delegate to the Secretary of Transportation, in 
                consultation with the Secretary of State, the authority                  vested in me by 46 U.S.C. 53902 and 53905.<br/>

                The Secretary of Transportation is directed to bring 
                the approval to the immediate attention of all U.S.-

final rule to enhance the security of our Nation's rail transportation 
system. This rule establishes security requirements for freight 
railroad carriers; intercity, commuter, and shorthaul passenger train 
service providers; rail transit systems; and rail operations at 
certain, fixedsite facilities that ship or receive specified hazardous 
materials by rail. This rule codifies the scope of TSA's existing 
inspection program and requires regulated parties to allow TSA and 
Department of Homeland Security (DHS) officials to enter, inspect, and 
test property, facilities, conveyances, and records relevant to rail 
security. This rule also requires that regulated parties designate rail 
security coordinators and report significant security concerns.

  <title><![CDATA[  Endangered and Threatened Species; Critical Habitat for  Threatened Elkhorn and Staghorn Corals]]></title>

  <description><![CDATA[  We, the National Marine Fisheries Service (NMFS), issue a 
final rule designating critical habitat for elkhorn (Acropora palmata) 
and staghorn (A. cervicornis) corals, which we listed as threatened 
under the Endangered Species Act of 1973, as amended (ESA), on May 9, 
2006. Four specific areas are designated: the Florida area, which 
comprises approximately 1,329 square miles (3,442 sq km) of marine 
habitat; the Puerto Rico area, which comprises approximately 1,383 
square miles (3,582 sq km) of marine habitat; the St. John/St. Thomas 
area, which comprises approximately 121 square miles (313 sq km) of 
marine habitat; and the St. Croix area, which comprises approximately 
126 square miles (326 sq km) of marine habitat. We are excluding one 
military site, comprising approximately 5.5 square miles (14.3 sq km), 
because of national security impacts.

issued senior unsecured debt, and the Transaction Account Guarantee

                Thanksgiving is a time for families and friends to 
                gather together and express gratitude for all that we 
                have been given, the freedoms we enjoy, and the loved 
                ones who enrich our lives. We recognize that all of 
                these blessings, and life itself, come not from the                  hand of man but from Almighty God.<br/>

                Every Thanksgiving, we remember the story of the 
                Pilgrims who came to America in search of religious 
                freedom and a better life. Having arrived in the New 
                World, these early settlers gave thanks to the Author 
                of Life for granting them safe passage to this abundant 
                land and protecting them through a bitter winter. Our 
                Nation's first President, George Washington, stated in 
                the first Thanksgiving proclamation that ``It is the 
                duty of all nations to acknowledge the providence of 
                Almighty God, to obey His will, to be grateful for His 
                benefits, and humbly to implore His protection and 
                favor.'' While in the midst of the Civil War, President 
                Abraham Lincoln revived the tradition of proclaiming a 
                day of thanksgiving, asking God to heal our wounds and                  restore our country.<br/>

                Today, as we look back on the beginnings of our 
                democracy, Americans recall that we live in a land of 
                many blessings where every person has the right to 
                live, work, and worship in freedom. Our Nation is 
                especially thankful for the brave men and women of our 
                Armed Forces who protect these rights while setting 
                aside their own comfort and safety. Their courage keeps 
                us free, their sacrifice makes us grateful, and their 
                character makes us proud. Especially during the 
                holidays, our whole country keeps them and their 
                families in our thoughts and prayers. Americans are 
                also mindful of the need to share our gifts with 
                others, and our Nation is moved to compassionate 
                action. We pay tribute to all caring citizens who reach 
                out a helping hand and serve a cause larger than                  themselves.<br/>

                On this day, let us all give thanks to God who blessed 
                our Nation's first days and who blesses us today. May 
                He continue to guide and watch over our families and                  our country always.<br/>

                NOW, THEREFORE, I, GEORGE W. BUSH, President of the

Community Residential Care Program ]]></title>

  <description><![CDATA[ The Department of Veterans Affairs (VA) proposes to amend its 
Community Residential Care regulations to update the standards for VA 
approval of facilities, including standards that would be adopted for 
fire safety and heating and cooling systems. This rule would also 
establish a single 12month duration for VA approvals and would 
authorize provisional approval of certain facilities. Finally, this 
rule would eliminate the VA statement of needed care requirement in 
current regulations and clarify that it is the care providers at the 
facility that determine the services needed by a particular veteran. VA 
intends that the proposed amendments would help ensure that veterans 
are provided appropriate care at facilities that receive VA referrals.

U.S.C. 35013521), the Department of Veterans Affairs (VA) published a 
collection of information notice in the Federal Register on October 23, 
2008, at 73 FR 63229, announcing an opportunity for public comment on 
the proposed collection of certain information by the agency. The 
notice solicited comments on information needed to determine 
servicemembers' eligibility requirements for payment of traumatic 
injury protection benefits covered under Servicemembers' Group Live 
Insurance. With respect to the collection of information in that 
notice, we are withdrawing our request for comments because it was 
necessary to seek an immediate OMB approval on an emergency basis under 
44 U.S.C. 3507(j). VA has submitted a copy of the amended TSGLI form 
(Servicemembers' Group Life Insurance Traumatic Injury Protection 
Application for TSGLI Benefits) to OMB for an emergency approval. This 
document withdraws the October 23, 2008 notice.

</p><p>    The Department of Veterans Affairs gives notice under Public Law 
92463 (Federal Advisory Committee Act) that the Advisory Committee on 
Disability Compensation will meet on December 8, 2008. The meeting will 
be held at the St. Regis Washington DC, 923 16th and K Streets, NW., in 
the Carlton Room, from 8:30 a.m. to 5:30 p.m. The meeting is open to  the public.</p><p>    The purpose of the Committee is to advise the Secretary of Veterans 
Affairs on establishing and supervising a schedule to conduct periodic  reviews of the VA Schedule for Rating Disabilities.</p><p>    The Committee will receive briefings about studies on compensation 
for veterans with serviceconnected disabilities and other veteran 
benefits programs. An open forum for verbal statements from the public 
will be available in the afternoon. People wishing to make verbal 
statements before the Committee will be accommodated on a firstcome, 
firstserved basis and will be provided three minutes per statement.

Revised National Pollutant Discharge Elimination System Permit  Regulation and Effluent Limitations Guidelines for]]></title>

  <description><![CDATA[ Under the Federal Water Pollution Control Act (Clean Water Act 
or CWA), EPA is revising the National Pollutant Discharge Elimination 
System (NPDES) permitting requirements and Effluent Limitations 
Guidelines and Standards (ELGs) for concentrated animal feeding 
operations (CAFOs) in response to the order issued by the U.S. Court of 
Appeals for the Second Circuit in Waterkeeper Alliance et al. v. EPA, 
399 F.3d 486 (2d Cir. 2005). This final rule responds to the court 
order while furthering the statutory goal of restoring and maintaining 
the nation's water quality by ensuring that CAFOs properly manage  manure generated by their operations.</p><p>    This final rule revises several aspects of EPA's current 
regulations governing discharges from CAFOs. EPA is modifying the 
requirement to apply for a permit by specifying that an owner or 
operator of a CAFO that discharges or proposes to discharge must apply 
for an NPDES permit. The final rule also includes an option for an

  <description><![CDATA[ The National Oceanic and Atmospheric Administration (NOAA) is 
issuing final revised management plans and revised regulations for the 
Gulf of the Farallones, Cordell Bank, and Monterey Bay national marine 
sanctuaries (GFNMS, CBNMS, and MBNMS respectively). This final rule 
updates the existing regulations for these three sanctuaries and 
establishes new regulatory prohibitions for them. New prohibitions 
contained in this final rule include restrictions on: the introduction 
of introduced species; discharges from cruise ships and other vessels; 
attracting or approaching white sharks in GFNMS; anchoring vessels in 
seagrass in Tomales Bay; deserting vessels; motorized personal 
watercraft use in the MBNMS (definition revision); and, possessing, 
moving, or injuring historic resources. This final rule also codifies 
three dredge disposal sites in the MBNMS that existed prior to the 
MBNMS designation in 1992 and expands the boundaries of the MBNMS to 
include the Davidson Seamount and surrounding area.

physician fee schedule and other Medicare Part B payment policies to 
ensure that our payment systems are updated to reflect changes in 
medical practice and the relative value of services. It also finalizes 
the calendar year (CY) 2008 interim relative value units (RVUs) and 
issues interim RVUs for new and revised codes for CY 2009. In addition, 
as required by the statute, it announces that the physician fee 
schedule update is 1.1 percent for CY 2009, the preliminary estimate 
for the sustainable growth rate for CY 2009 is 7.4 percent, and the 
conversion factor (CF) for CY 2009 is $36.0666. This final rule with 
comment period also implements or discusses certain provisions of the 
Medicare Improvements for Patients and Providers Act of 2008 (MIPPA).

  <description><![CDATA[ This final rule amends existing deep gas royalty relief 
regulations to reflect statutory changes enacted in the Energy Policy 
Act of 2005. It provides additional royalty relief for certain ultra
deep wells on Outer Continental Shelf leases in shallow water in the 
Gulf of Mexico. It extends both the existing and the additional deep 
gas royalty relief to Outer Continental Shelf leases in deeper water 
than before. Finally, this final rule applies discretionary royalty 
relief procedures that have been used by deepwater leases in the Gulf 
of Mexico to leases offshore of Alaska.

  <description><![CDATA[ This Notice is to inform the public of the Secretary's 
decision to increase the Department of Veterans Affairs (VA) 
Beneficiary Travel program mileage reimbursement rate under 38 U.S.C. 
111 for travel of eligible beneficiaries in connection with VA health 
care and for other purposes. Effective November 17, 2008, the 
beneficiary travel mileage reimbursement rate is increased from 28.5 
cents to 41.5 cents based upon mileage traveled to or from a Department 
facility or other place in connection with vocational rehabilitation, 
counseling required by the Secretary pursuant to 38 U.S.C. Chapter 34, 
``Educational Assistance'' or Chapter 35, ``Survivors and Dependents'  Education Assistance'' or for the<br/> [[Page 68499]]<br/>
purpose of examination, treatment or care. The deductible requirements 
for purposes of beneficiary travel of mileage reimbursement will remain 
at $7.77 oneway; $15.54 round trip; with a monthly cap of $46.62.

  <title><![CDATA[  Oil Shale Management--General ]]></title>

  <description><![CDATA[ The Bureau of Land Management (BLM) is finalizing regulations 
to set out the policies and procedures for the implementation of a 
commercial leasing program for the management of federallyowned oil 
shale and any associated minerals located on Federal lands. The Energy 
Policy Act of 2005 (EP Act) directs the Secretary of the Interior 
(Secretary) to: Make public lands available for conducting oil shale 
research and development activities; Complete a Programmatic 
Environmental Impact Statement (PEIS) for a commercial leasing program 
for both oil shale and tar sands resources on the BLMadministered 
lands in Colorado, Utah, and Wyoming; and Issue regulations  establishing a commercial oil shale leasing program.</p><p>    These final regulations incorporate specific provisions of the 
Mineral Leasing Act of 1920 (MLA) and the EP Act relating to: Oil shale 
lease size; Acreage limitations; Rental; and Lease diligence.

</p><p>    The Department of Veterans Affairs (VA) gives notice under Public 
Law 92463 (Federal Advisory Committee Act) that a meeting of the 
Advisory Committee on Homeless Veterans will be held on December 1516, 
2008, at the Ritz Carlton New Orleans, 921 Canal Street, New Orleans, 
Louisiana, in room Union Terrace A. The sessions will start at 8 a.m. 
and end at 4 p.m. each day. The meeting is open to the public.
</p><p>    The purpose of the Committee is to provide the Secretary of 
Veterans Affairs with an ongoing assessment of the effectiveness of 
the policies, organizational structures, and services of the Department 
in assisting homeless veterans. The Committee shall assemble and review 
information relating to the needs of homeless veterans and provide 
advice on the most appropriate means of offering assistance to homeless

National Ambient Air Quality Standards for Lead ]]></title>

  <description><![CDATA[ Based on its review of the air quality criteria and national 
ambient air quality standards (NAAQS) for lead (Pb), EPA is making 
revisions to the primary and secondary NAAQS for Pb to provide 
requisite protection of public health and welfare, respectively. With 
regard to the primary standard, EPA is revising the level to 0.15 
[mu]g/m<SUP>3</SUP>. EPA is retaining the current indicator of Pb in 
total suspended particles (PbTSP). EPA is revising the averaging time 
to a rolling 3month period with a maximum (nottobeexceeded) form, 
evaluated over a 3year period. EPA is revising the secondary standard 
to be identical in all respects to the revised primary standard.
</p><p>    EPA is also revising data handling procedures, including allowance 
for the use of PbPM<INF>10</INF> data in certain circumstances, and 
the treatment of exceptional events, and ambient air monitoring and 
reporting requirements for Pb, including those related to sampling and 
analysis methods, network design, sampling schedule, and data

                Continuation of National Emergency with Respect                  to Weapons of Mass Destruction<br/>

                On November 14, 1994, by Executive Order 12938, the 
                President declared a national emergency with respect to 
                the unusual and extraordinary threat to the national 
                security, foreign policy, and economy of the United 
                States posed by the proliferation of nuclear, 
                biological, and chemical weapons (weapons of mass 
                destruction) and the means of delivering such weapons. 
                On July 28, 1998, the President issued Executive Order 
                13094 amending Executive Order 12938 to respond more 
                effectively to the worldwide threat of weapons of mass 
                destruction proliferation activities. On June 28, 2005, 
                I issued Executive Order 13382 that, inter alia, 
                further amended Executive Order 12938 to improve our 
                ability to combat proliferation. The proliferation of 
                weapons of mass destruction and the means of delivering 
                them continues to pose an unusual and extraordinary 
                threat to the national security, foreign policy, and 
                economy of the United States; therefore, the national 
                emergency first declared on November 14, 1994, and 
                extended in each subsequent year, must continue. In 
                accordance with section 202(d) of the National 
                Emergencies Act (50 U.S.C. 1622(d)), I am continuing 
                for 1 year the national emergency declared in Executive                  Order 12938, as amended.<br/>

Veterans Affairs (VA), is announcing an opportunity for public comment 
on the proposed collection of certain information by the agency. Under 
the Paperwork Reduction Act (PRA) of 1995, Federal agencies are 
required to publish notice in the Federal Register concerning each 
proposed collection of information, including each proposed extension 
of currently approved collection, and allow 60 days for public comment 
in response to the notice. This notice solicits comments for 
information needed to determine a claimant's continued eligibility for 
educational benefits.
