  <title><![CDATA[  Medicare Program; Exclusion of Vendor Purchases Made Under the  Competitive Acquisition Program (CAP) for Outpatient]]></title>

  <description><![CDATA[ This interim final rule with comment period provides 
clarification and solicits comments on the relationship between drugs 
supplied under the Competitive Acquisition Program (CAP) for Part B 
Drugs and Biologicals and the calculation of Average Sales Price (ASP). 
(For purposes of this interim final rule, the term ``drug'' refers to 
drugs and biologicals.) This interim final rule with comment period 
also will exclude units of drugs supplied under the CAP from ASP 
calculations for a period of up to 3 years, at which time the policy 
will be reevaluated. In addition, this rule revises the definition of 
unit to reflect the exclusion of units of CAP drugs administered to 
beneficiaries by participating CAP physicians.

  <description><![CDATA[ This rule addresses Medicare Part B payment policy, including 
the physician fee schedule that are applicable for calendar year (CY) 
2006; and finalizes certain provisions of the interim final rule to 
implement the Competitive Acquisition Program (CAP) for Part B Drugs. 
It also revises Medicare Part B payment and related policies regarding: 
Physician work; practice expense (PE) and malpractice relative value 
units (RVUs); Medicare telehealth services; multiple diagnostic imaging 
procedures; covered outpatient drugs and biologicals; supplemental 
payments to Federally Qualified Health Centers (FQHCs); renal dialysis 
services; coverage for glaucoma screening services; National Coverage 
Decision (NCD) timeframes; and physician referrals for nuclear medicine 
services and supplies to health care entities with which they have 
financial relationships. In addition, the rule finalizes the interim 
RVUs for CY 2005 and issues interim RVUs for new and revised procedure

  <description><![CDATA[ November 17, 2005.</p><p>    It appears to the Securities and Exchange Commission that the 
public interest and the protection of investors require a suspension of 
trading in the securities of Allixon International Corp. (``AXCP''). 
The Commission is concerned that AXCP and/or certain of its 
shareholders may have unjustifiably relied on Rule 504 of Regulation D 
and/or provisions of Regulation S of the Securities Act of 1933 
(``Securities Act'') in conducting an unlawful distribution of AXCP 
securities that failed to comply with the resale restrictions of Rule 
144 and/or Regulation S of the Securities Act. AXCP, a company that has 
made no public filings with the Commission or the NASD, is quoted on 
the Pink Sheets, under the symbol AXCP, and has been the subject of  spam email touting the company's shares.</p><p>    The Commission is of the opinion that the public interest and the 
protection of investors require a suspension of trading in the

Catawba Nuclear Station, Units 1 and 2; Notice of Consideration  of Issuance of Amendment to Facility Operating]]></title>

</p><p>    The U.S. Nuclear Regulatory Commission (the Commission) is 
considering issuance of an amendment to Facility Operating License Nos. 
NFP35 and NFP52 issued to Duke Energy Corporation (the licensee) for 
operation of the Catawba Nuclear Station, Units 1 and 2 located in York  County, South Carolina.</p><p>    The proposed amendment would revise Technical Specifications (TS) 
Sections 3.7.16, ``Spent Fuel Assembly Storage,'' and 4.3, ``Design 
Features: Fuel Storage.'' This License Amendment Request (LAR) presents 
revised storage criteria for lowenriched uranium fuel stored at 
Catawba. This is accomplished by taking partial credit for soluble 
boron in the Catawba spent fuel pools (SFPs), in accordance with the 
regulatory requirements of 10 CFR 50.68(b). The TS bases for 3.3.15 and 
TS 4.3.3 would also be revised to change the number of usable storage  cells in each of the Catawba SFPs from 1418 to 1421.</p><p>    Before issuance of the proposed license amendment, the Commission

availability of the Record of Decision (ROD) for the Selma to 
Montgomery National Historic Trail Comprehensive Management Plan and 
Final Environmental Impact Statement (CMP/EIS). The ROD provides the 
background of the CMP/EIS, other alternatives considered, the basis for 
the decision, the environmentally preferable alternative, and public 
involvement in the decisionmaking process. The ROD was approved by the 
Southeast Regional Director on August 30, 2005. The CMP/EIS provides a 
framework for the management, use, and development of the National 
Historic Trail by the NPS and its partners over the next 15 to 20 
years. Beginning at Brown Chapel AME Church in Selma, Alabama, the 
trail follows the route of the March 1965 Selma to Montgomery voting 
rights march, traveling through Lowndes County along U.S. Highway 80,

  <title><![CDATA[  Notice of Proposed Reinstatement of Terminated Oil and Gas Lease  NMNM 13277]]></title>

  <description><![CDATA[ Under the provisions of section 371(a) of the Energy Policy 
Act of 2005, the lessee(s), Culbertson Management Trust, Dan W. Irwin, 
and Kathleen Irwin Schuster, timely filed a petition for reinstatement 
of oil and gas lease NMNM 13277 in Lea County, NM. The lessees paid the 
required rental accruing from the date of termination, June 1, 2002.
</p><p>    No leases were issued that affect these lands. The lessee agrees to 
the new lease terms for rentals and royalties of ($25 per acre) and 
24\2/3\ percent rate. The lessees paid the $500 administration fee for 
the reinstatement of the lease and $158 cost for publishing this  Notice.</p><p>    The lessees met the requirements for reinstatement of the lease per 
Sec. 31(e) of the Mineral Leasing Act of 1920 (30 U.S.C. 188(e)). We 
are proposing to reinstate the lease, effective the date of termination  subject to:<br/>
    <li> The original terms and conditions of the lease;     <li> The increased rental of ($25) per acre;<br/>

  <title><![CDATA[  Idaho Panhandle National Forest, Idaho--Supplemental Hidden Cedar  EIS Project]]></title>

  <description><![CDATA[ The USDA Forest Service will prepare a Supplemental 
Environmental Impact Statement (SEIS) for the Hidden Cedar Project. The 
Notice of Availability of the Draft EIS for the Hidden Cedar project 
was published Federal Register (66 FR 29799) on June 1, 2001 and the 
notice of the Final EIS (67 FR 4753847539) was published on July 19, 
2002. The Record of Decision on this project was administratively 
appealed to the Regional Forester per 36 CFR part 215. The Regional 
Forester affirmed my decision on September 27, 2002. However, due to 
information that has been identified since the availability of the 
final EIS and ROD I have determined a need for a supplement. On May 18, 
2005, I withdrew the Record of Decision for the Hidden Cedar project. 
The purpose for the withdrawal was to further address analysis issues 
raised through the recent opinion issued through the U.S. Court of 
Appeals for the Ninth Circuit in Lands Council v. Powell, 395 F.3d 
10151046 (9th Cir. 2005).

  <title><![CDATA[  Addition of Chile to the List of Countries Eligible To Export  Meat and Meat Products to the United States]]></title>

  <description><![CDATA[ The Food Safety and Inspection Service (FSIS) is adding Chile 
to the list of countries eligible to export meat and meat products to 
the United States. FSIS conducted a thorough review of Chile's meat 
slaughter and processing inspection system, including an onsite review 
of its meat inspection system in operation. FSIS concluded that Chile's 
meat inspection laws, regulations, and other written materials 
demonstrate that they establish requirements that are equivalent to the 
relevant requirements of the Federal Meat Inspection Act (FMIA) and its 
implementing regulations, and that Chile's implementation of meat 
inspection standards and procedures is equivalent to that of the United  States.</p><p>    Meat and meat products slaughtered and processed in certified 
Chilean establishments may be exported to the United States. All such 
products will be subject to reinspection by FSIS inspectors at U.S. 
portsofentry as required by law.

filed by Merial, Ltd. The NADA provides for oral use of an ivermectin 
and praziquantel paste as an overthecounter product for the treatment 
and control of various parasitic conditions of horses. This 
supplemental NADA reduces the minimum age for administration from 5 
months to 2 months of age.

  <title><![CDATA[  Airworthiness Directives; Airbus Model A310-200 and -300 Series  Airplanes]]></title>

  <description><![CDATA[ The FAA proposes to adopt a new airworthiness directive (AD) 
for certain Airbus Model A310200 and 300 series airplanes. This 
proposed AD would require repetitive inspections for cracks and 
corrosion of the areas behind the scuff plates below the passenger/crew 
doors and bulk cargo door, and repair of any cracked or corroded part. 
This proposed AD also would require repetitive inspections for cracks 
of the holes of the corner doublers, the failsafe ring, and the door 
frames of the passenger/crew door structures. This proposed AD is 
prompted by reports of corrosion behind the scuff plates at passenger/
crew doors and the bulk cargo door and fatigue cracks on the corner 
doublers of the forward and aft passenger/crew door frames. We are 
proposing this AD to prevent such corrosion and fatigue cracking, which 
could result in reduced structural integrity of the door surroundings.

  <title><![CDATA[  Airworthiness Directives; Empresa Brasileira de Aeronautica S.A.  (EMBRAER) Model EMB-135 Airplanes, and Model]]></title>

  <description><![CDATA[ The FAA is adopting a new airworthiness directive (AD) for 
certain EMBRAER Model EMB135 airplanes, and Model EMB145, 145ER, 
145MR, 145LR, 145XR, 145MP, and 145EP airplanes. This AD requires 
modification of the upper frame of the firewall for the auxiliary power 
unit (APU). This AD results from the discovery of a hole in the upper 
frame of the firewall for the APU. We are issuing this AD to ensure 
that the APU compartment is isolated from the rest of the airplane in 
the event of an APU fire. If the APU compartment is not isolated, smoke 
could enter the passenger cabin in the event of an APU fire.

British Aerospace Model HS 748 airplanes. This AD requires repetitive 
inspections for fatigue cracking, corrosion, and other related 
discrepancies of the rear pressure bulkhead and associated areas, and 
the fin attachment fittings, particularly the fin link beam; and 
related investigative and corrective actions. This AD results from a 
structural integrity audit of the airplane that showed the importance 
of inspecting for fatigue cracking and corrosion of these areas. We are 
issuing this AD to detect and correct cracking, corrosion, and other 
related discrepancies of the rear pressure bulkhead and associated 
areas, and the fin attachment fittings, particularly the fin link beam, 
which could result in damage to the airplane structure or injury to 
airplane occupants.

certain Boeing Model 767200 and 300 series airplanes. This AD 
requires replacing hinge assemblies with new hinge assemblies in the 
outboard overhead stowage bins and reworking hinge assemblies in the 
outboard overhead stowage bins that are adjacent to curtain tracks. 
This AD results from reports of hinge assemblies of outboard overhead 
stowage bins breaking or the stowage bin doors not latching properly. 
We are issuing this AD to prevent the outboard overhead stowage bins 
opening during flight and releasing baggage, and consequently injuring 
passengers and blocking the aisles during emergency egress.

repetitive inspections for cracking of the junction between the thrust 
reverser forward frame and the 12 o'clock and 6 o'clock beams; the 
thrust reverser common fittings; and the thrust reverser Jring 
structure at the 12 o'clock and 6 o'clock positions; and related 
investigative and corrective actions. This AD results from fatigue and 
damage tolerance testing of the engine thrust reversers which revealed 
fatigue cracking of the junction between the thrust reverser forward 
frame and the 12 o'clock beam, and of the thrust reverser Jring 
structure. We are issuing this AD to detect and correct such fatigue 
cracking, which could result in rupture of the Jring, forward frame, 
or common fittings; loss of the thrust reverser system; or inadvertent 
deployment of a thrust reverser in flight and consequent reduced 
controllability of the airplane.

  <description><![CDATA[ The Farm Credit Administration (FCA) published a final rule 
under part 627 on September 22, 2005 (70 FR 55513). This final rule 
gives certainty to Farm Credit System institutions regarding how the 
Farm Credit System Insurance Corporation will treat qualifying 
participations and securitizations if the institution is subsequently 
placed in conservatorship or receivership. In accordance with 12 U.S.C. 
2252, the effective date of the final rule is 30 days from the date of 
publication in the Federal Register during which either or both Houses 
of Congress are in session. Based on the records of the sessions of 
Congress, the effective date of the regulations is November 14, 2005.

that it has adopted an Airborne Toxic Control Measure (ATCM)

December 31, 2008. By letter dated March 28, 2005, CARB requested that 
EPA grant California authorization for such standards under section 
209(e)(2) of the Clean Air Act (CAA), 42 U.S.C. 7543(b) (EPA frequently 
calls such authorizations ``waivers of preemption''). This notice 
announces that EPA has tentatively scheduled a public hearing 
concerning California's request and that EPA is accepting written 
comment on the request.

  <title><![CDATA[  Trade Adjustment Assistance Program: Training and Employment  Guidance Letter]]></title>

</p><p>    The Employment and Training Administration interprets federal law 
requirements pertaining to Trade Adjustment Assistance (TAA). These 
interpretations are issued in Training and Employment Guidance Letters 
(TEGLs) to the State Workforce Agencies. The TEGL described below is 
published in the Federal Register in order to inform the public. TEGL 3204</p><p>    TEGL 3204 provides guidance to states on meeting Fiscal Year (FY)  2005 goals for the TAA and NAFTATAA programs.</p><p>    The information contained in TEGL 3204 is issued to States and the 
cooperating state workforce agencies (SWAs) as guidance provided by the 
Department of Labor (DOL) in its role as the principal in the TAA 
program. As agents of the Secretary of Labor, the states and

</p><p>    Notice is hereby given that the Delaware River Basin Commission 
will hold an informal conference followed by a public hearing on 
Wednesday, December 7, 2005. The hearing will be part of the 
Commission's regular business meeting. Both the conference session and 
business meeting are open to the public and will be held at the 
Commission's office building, located at 25 State Police Drive in West  Trenton, New Jersey.</p><p>    The conference among the commissioners and staff will begin at 
10:30 a.m. Topics of discussion will include presentations on the water 
supply plan for the State of Delaware; the initial report of the 
Delaware Toxics Reduction Program (DelTRiP); a status report on the 
dwarf wedge mussel habitat study under way in the Upper Basin; a report 
on PCB Minimization Plan submissions to date; and discussion regarding 
the composition and charges of the Peer Review Advisory Committee to be 
established for the purpose of evaluating pollutant minimization plans
