  <title><![CDATA[  Food Distribution Program on Indian Reservations: Resource Limits  and Exclusions, and Extended Certification Periods]]></title>

  <description><![CDATA[ This proposed rule would amend regulations for the Food 
Distribution Program on Indian Reservations (FDPIR). The changes are 
intended to improve program service, ensure consistency between FDPIR 
and the Food Stamp Program, and respond to concerns expressed by the 
National Association of Food Distribution Programs on Indian 
Reservations (NAFDPIR) that the current FDPIR resource limit was 
insufficient for the target population and served as a barrier to 
participation. The proposed rule would increase the maximum level of 
allowable resources to the same level permitted under the Food Stamp 
Program (including annual adjustments for inflation in accordance with 
Section 4104 of the Food, Conservation, and Energy Act of 2008 (Pub. L. 
110234)), allow a resource exclusion for the first $1,500 of the value 
of one prepaid funeral arrangement per household member, and allow 
households in which all members are elderly and/or disabled to be

  <title><![CDATA[  Asian Longhorned Beetle; Additions to Quarantined Areas in New  York]]></title>

  <description><![CDATA[ We are adopting as a final rule, without change, an interim 
rule that amended the Asian longhorned beetle regulations by expanding 
the boundaries of the quarantined areas in New York and restricting the 
interstate movement of regulated articles from these areas. The interim 
rule was necessary to prevent the artificial spread of the Asian 
longhorned beetle to noninfested areas of the United States.

  <title><![CDATA[  Importation of Cooked Pork Skins ]]></title>

  <description><![CDATA[ We are proposing to amend the regulations to allow for the 
importation of cooked pork skins from regions affected with footand
mouth disease, swine vesicular disease, African swine fever, and 
classical swine fever under certain conditions. We are taking this 
action after preparing a risk assessment that concluded that the 
cooking methods examined are sufficient to inactivate the pathogens of 
concern. This action would relieve restrictions on the importation of 
cooked pork skins while continuing to protect against the introduction 
of those diseases of concern.

  <title><![CDATA[  2008 Direct and Counter-Cyclical Program ]]></title>

  <description><![CDATA[ As announced by this notice, the Commodity Credit Corporation 
(CCC) is implementing the provisions of the Food, Conservation, and 
Energy Act of 2008 (the 2008 Farm Bill) regarding direct and counter
cyclical payments for the 2008 crop year. The 2008 Farm Bill authorizes 
direct and countercyclical payments, with some changes, that were 
previously authorized for preceding crops under the Farm Security and 
Rural Investment Act of 2002 (the 2002 Farm Bill). As a result of this 
notice, CCC will be able to commence administration of the Direct and 
Countercyclical Program (DCP) for the 2008 crop. Through a subsequent 
rule, CCC will implement DCP for the 2009 through 2012 crops.

  <title><![CDATA[  Housing Preservation Grants ]]></title>

  <description><![CDATA[ The Rural Housing Service (RHS), hereafter referred to as U.S. 
Department of Agriculture Rural Development is amending its regulations 
for the Housing Preservation Grants Program to include faithbased and 
community organizations. Faithbased and community organizations 
receiving Housing Preservation Grants (HPG) Program funding for the 
purpose of repairing and rehabilitating housing will operate within the 
guidance of the 7 CFR 1944, subpart N, as well as, comply with the 
terms specified in the HPG grant agreement. The intended effect is to 
improve the delivery and operation of the HPG Program.

(CEQ) regulations that implement the NEPA. Both changes would better 
align the Agency regulations with the CEQ NEPA regulations and provide 
for the efficient and timely environmental review of NRCS actions, 
particularly those actions where Congress has directed NRCS action 
within short time periods of 6090 days.

rule, without change, an interim final rule establishing interim final 
and final free and restricted percentages for domestic inshell 
hazelnuts for the 20072008 marketing year under the Federal marketing 
order for hazelnuts grown in Oregon and Washington. This rule continues 
in effect the interim final free and restricted percentages of 8.1863 
and 91.8137 percent, respectively, and the final free and restricted 
percentages of 9.2671 and 90.7329 percent, respectively. The 
percentages allocate the quantity of domestically produced hazelnuts 
which may be marketed in the domestic inshell market (free) and the 
quantity of domestically produced hazelnuts that must be disposed of in 
outlets approved by the Board (restricted). Volume regulation is 
intended to stabilize the supply of domestic inshell hazelnuts to meet

administers the marketing order which regulates the handling of sweet 
onions grown in the Walla Walla Valley of Southeast Washington and 
Northeast Oregon. Assessments upon Walla Walla sweet onion handlers are 
used by the Committee to fund the reasonable and necessary expenses of 
the program. The fiscal period begins January 1 and ends December 31. 
The assessment rate will remain in effect indefinitely unless modified, 
suspended, or terminated.

  <description><![CDATA[ This final rule establishes regulations for seasons, harvest 
limits, methods, and means related to taking of wildlife for 
subsistence uses in Alaska during the 200809 and 200910 regulatory 
years. These regulations have been subject to an annual public review 
cycle, but starting in 2008 the Federal Subsistence Management Program 
will provide a public review process for subsistence hunting and 
trapping regulations in evennumbered years and subsistence fishing and 
shellfish regulations in oddnumbered years. The Program will also 
address customary and traditional use determinations during the 
applicable biennial cycle. This cycle adjustment does not affect the 
public's ability to submit special action requests or requests for 
reconsideration, as outlined in the regulations. This rulemaking 
replaces the subpart D subsistence taking of wildlife taking 
regulations which expire June 30, 2008. This rule also amends the 
customary and traditional use determinations of the Federal Subsistence 
Board.

  <description><![CDATA[ We are advising the public that the Animal and Plant Health 
Inspection Service has prepared a regional programmatic environmental 
assessment and finding of no significant impact relative to the 
interstate movement of municipal solid waste from Hawaii to landfills 
in the States of Idaho, Oregon, and Washington. The environmental 
assessment contains a general assessment of the potential environmental 
effects associated with moving garbage interstate from Hawaii to Idaho, 
Oregon, and Washington subject to certain pest risk mitigation measures 
and documents our review and analysis of the environmental impacts 
associated with, and alternatives to, such movements. Based on its 
finding of no significant impact, the Animal and Plant Health 
Inspection Service has determined that an environmental impact 
statement need not be prepared.

amended by Section 824 of the Personal Responsibility and Work 
Opportunity Reconciliation Act of 1996, is to establish a time limit 
for the receipt of food stamp benefits for certain ablebodied adults 
who are not working. The provision authorizes the Secretary of 
Agriculture, upon a State agency's request, to waive the provision for 
any group of individuals if the Secretary determines ``that the area in 
which the individuals reside has an unemployment rate of over 10 
percent, or does not have a sufficient number of jobs to provide 
employment for the individuals.'' As required in the statute, in order 
to receive a waiver the State agency must submit sufficient supporting

  <title><![CDATA[  Peanut Standards Board ]]></title>

  <description><![CDATA[ The Farm Security and Rural Investment Act of 2002 requires 
the Secretary of Agriculture to establish a Peanut Standards Board 
(Board) for the purpose of advising the Secretary on quality and 
handling standards for domestically produced and imported peanuts. The 
initial Board was appointed by the Secretary and announced on December 
5, 2002. USDA seeks nominations for individuals to be considered for 
selection as Board members for terms of office ending June 30, 2011. 
Selected nominees sought by this action would replace those six 
producer and industry representatives who are currently serving for the 
term of office that ends June 30, 2008. The Board consists of 18 
members representing producers and industry representatives.

  <title><![CDATA[  Revision of the Hawaiian and Territorial Fruits and Vegetables  Regulations]]></title>

pertaining to the interstate movement of fruits and vegetables from 
Hawaii and the territories to consolidate requirements of general

and nonsubstantive changes to the regulations to make them easier to 
use. We are also proposing to make substantive changes to the 
regulations including establishing criteria within the regulations 
that, if met, would allow us to approve certain new fruits and 
vegetables for interstate movement in the United States and to  acknowledge pestfree areas in Hawaii and U.S. territories <br/>
expeditiously, and removing the listing in the regulations of some

  <description><![CDATA[ The Soda Springs Ranger District of the Caribou-Targhee 
National Forest will begin charging a $8.00 fee for overnight camping 
at the Pine Bar and Mill Canyon Campgrounds on the Soda Springs Ranger 
District. There will also be a $2.00 fee for an extra vehicle. 
Overnight camping at other campgrounds on the CaribouTarghee National 
Forest has shown that the public appreciates and enjoys the 
availability of developed recreation campground facilities. Funds from 
the use of these developed campground facilities will be used for the 
continued operation and maintenance of Pine Bar and Mill Canyon 
Campgrounds.

  <description><![CDATA[ We are reopening the comment period for our proposed rule that 
would amend our domestic quarantine regulations to provide for the 
interstate movement of Hass avocados from Mexican fruit fly and sapote 
fruit fly quarantined areas in the United States with a certificate if 
the fruit is safeguarded after harvest in accordance with specific 
measures. The proposed rule would also amend our foreign quarantine 
regulations to remove trapping and bait spray treatment requirements 
related to Anastrepha spp. fruit flies for imported Hass avocados from 
Michoacan, Mexico. This action will allow interested persons additional 
time to prepare and submit comments.

  <title><![CDATA[  Guaranteed Loans; Number of Days of Interest Paid on Loss Claims]]></title>

  <description><![CDATA[ The Farm Service Agency (FSA) is clarifying and simplifying 
its regulations governing the number of days interest will be paid on 
loss claims. The liquidation provisions currently provide a timeframe 
for the interest payment based upon ``the date of the decision to 
liquidate,'' which is often difficult to determine. This final rule 
will eliminate ``the date of the decision to liquidate'' as the 
beginning timeframe for the interest payment on loss claims. In 
addition, FSA is clarifying the guaranteed lender's responsibility for 
future recoveries.

crop. The loan commodities covered by this Federal Register Notice 
include: wheat, corn, grain sorghum, barley, oats, soybeans, rice, 
sunflower seed, rapeseed, canola, safflower, flaxseed, mustard seed, 
crambe, sesame seed, graded and nongraded wool, mohair, honey, dry 
peas, lentils, and small chickpeas. As a result of this notice, CCC 
will be able to commence administration of 2008crop MAL and LDP 
provisions and announce applicable 2008crop loan rates, schedules of 
premiums and discounts, and other related rates.

  <title><![CDATA[  Consolidation of the Fruit Fly Regulations ]]></title>

  <description><![CDATA[ We are amending the regulations to consolidate our domestic 
regulations regarding exotic fruit flies. Currently, these regulations 
are contained in six separate subparts, each of which covers a 
different species of fruit fly, and each of these subparts has parallel 
sections that are substantially the same as the corresponding sections 
in the other subparts. Therefore, we are combining these six subparts 
into a single subpart. We are also modifying the regulations by adding 
a mechanism through which quarantined areas can be removed from 
regulation expeditiously. These actions eliminate duplication and 
enhance the flexibility of our regulatory program.

area in the State of Idaho that is quarantined to prevent the spread of 
potato cyst nematode. The description of the quarantined area was 
updated on November 1, 2007, when the potato cyst nematode regulations 
became effective; on November 28, 2007, when one additional field was 
found to be infested; on January 9, 2008, when some fields that had 
been quarantined were found not to have an association with an infested 
field; and on March 21, 2008, when 24 associated fields were removed 
from the quarantined area after having been surveyed and found to be 
free of potato cyst nematode.

for import and exportrelated services that we provide for animals, 
animal products, birds, germ plasm, organisms, and vectors. We are 
proposing increases in those fees for fiscal years 2009 through 2013 in 
order to ensure that the fees accurately reflect the anticipated costs 
of providing these services each year. By publishing the annual user 
fee changes in advance, users can incorporate the fees into their 
budget planning. The user fees pay for the actual cost of providing 
these services.

  <title><![CDATA[  Vidalia Onions Grown in Georgia; Increased Assessment Rate]]></title>

  <description><![CDATA[ This rule increases the assessment rate established for the 
Vidalia Onion Committee (Committee) for the 2008 and subsequent fiscal 
periods from $0.10 to $0.13 per 40pound container of Vidalia onions 
handled. The Committee locally administers the marketing order which 
regulates the handling of Vidalia onions grown in Georgia. Assessments 
upon Vidalia onion handlers are used by the Committee to fund 
reasonable and necessary expenses of the program. The fiscal period 
begins January 1 and ends December 31. The assessment rate will remain 
in effect indefinitely unless modified, suspended, or terminated.

the United States Standards for Grades of Olive Oil. The proposal 
includes two major groups of oil: ``olive oil,'' produced from olives 
by mechanical means; and ``olivepomace oil,'' produced using heat and 
a solvent to separate the oil from the olivepomace remaining after 
olive oil is produced. The proposal includes new product descriptions, 
definitions, and requirements for the following grade designations: 
``U.S. Extra Virgin Olive Oil,'' ``U.S. Virgin Olive Oil,'' ``U.S. 
Lampante Virgin Olive OilNot Fit for Human Consumption,'' ``U.S. 
Refined Olive Oil,'' ``U.S. Olive Oil,'' ``U.S. OlivePomace Oil,''

  <title><![CDATA[  Revision of Land Management Plan, Lake Tahoe Basin Management  Unit, Located in California and Nevada]]></title>

  <description><![CDATA[ The USDA, Forest Service is resuming preparation of the Lake 
Tahoe Basin Management Unit revised land management plan (hereafter 
referred to as the Forest Plan), as directed by the National Forest 
Management Act (NFMA) . Preparation of the revised plan was halted when 
the 2005 Forest Service planning rule was enjoined. A new planning rule 
(36 CFR Part 219 was implemented on April 21, 2008, allowing the 
planning process to be resumed. This notice resumes the plan revision  process under the new planning rule.</p><p>    The Lake Tahoe Basin Management Unit (LTBMU) Forest Plan 
Comprehensive Evaluation Report documents the need for change and the 
initial scope of forest plan revisionbased upon management review & 
determination, February 2007which is still valid; this documentation 
provides information concerning public participation and collaboration. 
The original notice of initiation for plan revision appeared in the

opportunity to allow Conservation Reserve Program (CRP) participants 
with certain established vegetative cover to voluntarily modify the CRP 
contract to utilize certain CRP land enrolled for a critical feed use 
this year without a rental reduction. Producers will be required to 
obtain a modified conservation plan to include, among other things, 
haying or grazing of the established cover.

use on the SalmonChallis National Forest (SCNF), and assign the type 
of use(s) and season of use allowed on each road and trail or portion 
thereof. The Forest Service is revising the proposed action to correct 
inconsistencies with the Salmon National Forest and Challis National 
Forest Land and Resource Management plans, correct errors in the 
mileages of roads and motorized trails described in the original 
proposed action, and announce a 60day public comment period, rather 
than a 45day public comment period on the Draft EIS.

  <title><![CDATA[  User Fees for 2008 Crop Cotton Classification Services to Growers]]></title>

  <description><![CDATA[ The Agricultural Marketing Service (AMS) will raise the user 
fees for cotton producers for 2008 crop cotton classification services 
under the Cotton Statistics and Estimates Act. These user fees also are 
authorized under the Cotton Standards Act of 1923. The 2007 user fee 
for this classification service was $1.85 per bale. This rule will 
raise the fee for the 2008 crop to $2.00 per bale. This fee and the  existing reserve are sufficient to cover the costs<br/> [[Page 30735]]<br/> of providing classification services, including costs for <br/>
administration and supervision.

  <title><![CDATA[  Notice of Expiring Expanded Rural Area Definition ]]></title>

  <description><![CDATA[ On March 13, 2006 (71 FR 12671-74), a notice was published 
regarding the availability of hurricane disaster assistance that 
expanded the rural area definition for USDA Rural Development's housing 
programs. USDA Rural Development's housing programs are governed by the 
Housing Act of 1949, as amended (42 U.S.C. 1471, et seq.)(Act).
</p><p>    Section 541 of the Act (42 U.S.C. 1490q), which only applies to 
USDA Rural Development's housing programs, provided the authority to 
waive rural area requirements in Sec.  520 of the Act (42 U.S.C. 1490) 
subsequent to a natural disaster. This waiver authority applied with 
respect to assistance under Sec.  541. The Secretary could allocate 
appropriated disaster funds under Sec.  541(a) for each fiscal year 
during the 3year period beginning on the declaration of the disaster  by the President.</p><p>    Notice is hereby given that the expanded rural area definition 
(which increased the population limits to 75,000) under the March 13, 
2006 notice will expire at the end of the<script type="text/javascript">

Risk Management Agency (RMA) did not receive complete and valid 
application packages for the State of Delaware under the original 
Request for Application Notice published in the Federal Register on 
January 22, 2008, for the Crop Insurance Education in Targeted States 
Program (Targeted States Program). RMA is reannouncing its Funding 
OpportunityRequest for Applications under the Targeted States Program 
for the State of Delaware. Applicants who previously submitted an 
application under the January 22, 2008, Targeted States Program Request 
for Applications Notice for Delaware must reapply in accordance with 
the original Notice published in the Federal Register on January 22,  2008.</p><p>    All other portions and sections of the full text Notice remain 
unchanged.
