  <description><![CDATA[ This notice provides instructions to potential applicants 
applying for funding under HUD's Fiscal Year (FY) 2009 grant programs 
available through Grants.gov, including changes to the Grants.gov 
registration process scheduled for January 2009. This notice does not 
pertain to applicants who will be applying in FY2009 for Continuum of 
Care funds. HUD will publish a separate notice to address the receipt 
of Continuum of Care applications in FY2009. Today's Federal Register 
notice provides information to help applicants better understand the 
registration and electronic submission process for HUD applications 
made available through Grants.gov. Grants.gov is the federal portal for 
applicants to electronically find and apply for over 1,000 funding 
opportunities made available by 26 federal grantmaking agencies. 
Grants.gov offers the applicant community a common Web site where 
applicants can apply for a variety of federal assistance programs. To

  <title><![CDATA[  HUD Programs: Violence Against Women Act Conforming Amendments]]></title>

  <description><![CDATA[ This interim rule conforms HUD's regulations to the self-
implementing provisions of the statutory protections for victims of 
domestic violence, dating violence, sexual assault, and stalking 
provided by the Violence Against Women Act (VAWA), as recently amended. 
These new protections apply to families applying for or receiving 
rental assistance under HUD's public housing and tenantbased and 
projectbased Section 8 programs. The primary objectives of VAWA are to 
reduce violence against women and to protect the safety and 
confidentiality of victims of domestic violence and abuse.

  <description><![CDATA[ This final rule modifies HUD's policies and practices 
regarding responses to subpoenas and other demands for testimony of HUD 
employees, or for production of documents by HUD. This rule delegates 
authority to additional officials within HUD's Office of General 
Counsel and revises the criteria used to evaluate such demands. 
Finally, this rule eliminates unnecessary provisions covering HUD's 
response to demands in cases in which the United States is a party to 
the case in which testimony or documents are requested. This rule 
follows publication of an August 12, 2008 proposed rule, but makes no 
changes at this final rule stage.

Proposed Information Collection: Family Unification Program (FUP)]]></title>

  <description><![CDATA[ The proposed information collection requirement described 
below has been submitted to the Office of Management and Budget (OMB) 
for review, as required by the Paperwork Reduction Act. The Department  is soliciting public comments on the subject proposal.</p><p>    Public Housing Agencies (PHA) application for funding of new 
Housing Choice Vouchers to promote family unification. The Family 
Unification Program (FUP) is a program under which vouchers are 
provided to families for whom the lack of adequate housing is a primary 
factor in the imminent placement of the family's child, or children, in 
outofhome care; or the delay in the discharge of the child, or 
children, to the family from outofhome care. Youths at least 18 years 
old and not more than 21 years old (have not reached 22nd birthday) who 
left foster care at age 16 or older and who do not have adequate 
housing are also eligible to receive housing assistance under the FUP. 
A FUP voucher issued to such a youth may only be used to provide

Emergency Capital Repair Grants for Multifamily Housing Projects  Designated for Occupancy by the Elderly: Notice of]]></title>

  <description><![CDATA[ This notice announces the availability of approximately $9.5 
million in grant funds to make emergency capital repairs to eligible 
multifamily projects owned by private nonprofit entities that are 
designated for occupancy by elderly tenants. The capital repair needs 
must relate to items that present an immediate threat to the health, 
safety, and quality of life of the tenants. The intent of these grants 
is to provide onetime assistance for emergency items that could not be 
absorbed within the project's operating budget and other project 
resources, and where the tenants' continued occupancy in the immediate 
near future would be jeopardized by a delay in initiating the proposed 
cure. The notice provides instructions for owners of multifamily 
projects to request funding and instructions for the HUD field offices 
to process requests.

transaction in addition to any MixedFinance and Capital Fund Financing

rents published were in fact the final FY2009 Final FMRs. Today's 
Federal Register notice corrects the title of Schedule B to ``FY2009 
Final Fair Market Rents For Existing Housing.''

Pet Ownership for the Elderly and Persons With Disabilities]]></title>

  <description><![CDATA[ This final rule amends HUD's regulations governing the 
requirements for pet ownership in HUDassisted public housing and 
multifamily housing projects for the elderly and persons with 
disabilities. Specifically, this final rule conforms these pet 
ownership requirements to the requirements for animals assisting 
persons with disabilities in HUD's public housing programs, other than 
housing projects for the elderly or persons with disabilities. This 
final rule follows publication of an October 15, 2007, proposed rule, 
and takes into consideration the public comments received on the  proposed rule. In response to one comment, HUD has made a <br/>
nonsubstantive change to the proposed rule. Specifically, consistent 
with the phrasing used in HUD's public housing pet ownership 
regulations, this final rule amends the assisted housing regulations to 
refer to ``animals that assist, support, or provide service to persons 
with disabilities.''

of this document is to announce the names, addresses and the amount 
awarded to the winners to be used to help HispanicServing Institutions 
of Higher Education to expand their role and effectiveness in 
addressing community development needs in their localities, including 
neighborhood revitalization, housing and economic development, 
principally for persons of low and moderateincome consistent with the 
purposes of Title I of the Housing and Community Development Act of 
1974 as amended.

also provides information on demographic and other characteristics of 
the occupants. Federal and local agencies use AHS data to evaluate 
housing issues.

Privacy Act; Notification of an Amendment to an Existing Privacy  Act System of Records, Housing Counseling System]]></title>

  <description><![CDATA[ HUD proposes to amend one of its system of records subject to 
the Privacy Act of 1974 (5 U.S.C. 552a), as amended. HCS/CAR contains 
detailed characteristics of housing counseling clients that receive 
specific services from HUDapproved counseling agencies. The previous 
system of records was published at 78 FR 17366. The Department is 
modifying the system of records to include new capabilities for the 
system and to include a new ``Purpose'' captions, and an expansion on 
other captions for additional clarification purposes, to rename a new 
system manger in order to accurately identify the official responsible 
for managing the system. Additionally, updates are applied to the 
``Routine Use'' caption, to expand the use of data to HUD approved 
entities for the purpose of conducting research and evaluation studies 
directly related to the participation and outcome of HUD's Housing 
Counseling Programs.

  <description><![CDATA[ The Department of Housing and Urban Development (HUD) proposes 
to establish a new record system to add to its inventory of systems of 
records subject to the Privacy Act of 1974 (5 U.S.C. 552a), as amended. 
The proposed new system of record is the Single Family Nonprofit Data 
Management System (NPDMS) developed by the Office of Single Family 
Housing. NPDMS will be used as an automated webased tool used to 
manage the Nonprofit program activities. The application will be used 
to improve the application, recertification, and reporting process for 
organizations that participate in HUD Federal Housing Administration 
(FHA) Nonprofit Program activities and will be used to assist HUD staff 
with the daily administration of these programs.

Civil Money Penalties: Certain Prohibited Conduct ]]></title>

  <description><![CDATA[ This rule would revise HUD's regulations that govern the 
imposition of civil money penalties. Specifically, the rule would 
revise the definition of ``material or materially'' and add a 
definition of ``ability to pay,'' which is one factor used in 
determining the appropriateness of the amount of any civil money 
penalty. Additionally, the proposed rule would require respondents, in 
their responses to the prepenalty notice, to specifically address the 
factors used in determining the appropriateness and amount of civil 
money penalty. This rule would also allow Government Counsel to file 
complaints on behalf of the Mortgagee Review Board and departmental 
officials. Finally, this rule would make other minor clarifying 
changes.

Public Housing Operating Fund Program; Increased Terms of Energy  Performance Contracts]]></title>

  <description><![CDATA[ This interim rule would make conforming amendments to the 
regulations of the Public Housing Operating Fund Program to reflect 
recent statutory amendments that allow for: The maximum term of an 
energy performance contract (EPC) between a public housing authority 
(PHA) and an entity other than HUD to be up to 20 years, and the 
extension of an existing EPC, without reprocurement, to a period of no 
more than 20 years, to allow additional energy conservation 
improvements. The increase in the maximum EPC term, which is currently 
limited to 12 years, is provided by statutory amendments and will 
enable longer payback periods for energy conservation measures.

of additional waivers and alternative requirements applicable to the 
Community Development Block Grant (CDBG) disaster recovery grant 
provided to the State of Louisiana on June 14, 2006, and March 7, 2007, 
for the purpose of assisting in the recovery in the most impacted and 
distressed areas related to the consequences of Hurricanes Katrina and 
Rita in 2005. Although the reconsideration period is normally 2 years

  <description><![CDATA[ This final rule makes changes to the Department's Mortgagee 
Review Board (Board) regulations to clarify and better reflect 
statutory directives and amend current practice, and to modify the 
Board's procedures governing hearings. This rule also removes 
provisions that unnecessarily duplicate the authorizing statute and  clarifies the authority and duties of the Board in taking <br/>
administrative action against mortgagees approved by the Federal 
Housing Administration. This rule separates and clarifies the grounds 
for administrative action and the factors considered by the Board in 
evaluating whether to take administrative action, as well as requiring 
the mortgagee to address these factors in its response to the Board's  notice of violation.</p><p>    This rule follows publication of a March 28, 2008, proposed rule on 
which HUD received one public comment. At this final rule stage, HUD 
has decided to adopt the proposed rule with minor changes, as described 
below.

Notice of Funding Availability (NOFA) for the Continuum of Care  Homeless Assistance Program: Extension of Application]]></title>

  <description><![CDATA[ On July 10, 2008, HUD published the NOFA for the Continuum of 
Care (CoC) Homeless Assistance Program. Through this NOFA, HUD is 
making available approximately $1.42 billion in Fiscal Year (FY) 2008 
for the CoC program. On August 13, 2008, HUD published a notice that 
established the deadline date for the submission of applications and 
corrected or clarified portions of the CoC NOFA. Since that date, 
Hurricane Ike has greatly impacted Continuums of Care in Texas, 
Louisiana and other places. In response to this disaster, today's 
publication extends the deadline date for the submission of 
applications.

  <description><![CDATA[ This notice describes the statutorily required reconsideration 
of additional waivers and alternative requirements applicable to the 
CDBG disaster recovery grant provided to the State of Alabama on June 
14, 2006, for the purpose of assisting in the recovery in the most 
impacted and distressed areas related to the consequences of Hurricane 
Katrina in 2005. HUD previously published an allocation and application 
notice on February 13, 2006, applicable to this grant and four others 
under the same appropriation and extended that notice on August 8, 
2008. As described in the Supplementary Information section of this 
notice, HUD is authorized by statute to waive statutory and regulatory 
requirements and specify alternative requirements for this purpose, 
upon the request of the state grantee. This notice for the State of 
Alabama also notes statutory provisions affecting program design and 
implementation. The original notice has been reconsidered and the 
waivers are being retained.

to amend one of its Privacy Act record systems subject to the Privacy

changes in the system name, location, new system managers and current 
updates to the ``Purpose'' and ``Systems Security Measures'' 
statements. This system is managed and operated by HUD's Office of 
Public and Indian Housing. IMS replaces the former Public and Indian 
Housing Information Center (PIC) system. The notice for the PIC system 
was published at 67 FR 20986. This record system supports the 
administration of programs for families receiving housing assistance 
for those entities that administer HUD's Office of Public and Indian 
Housing rental assistance programs. The entities that administer PIH's 
rental assistance programs are the Public Housing Authorities (PHAs). 
Additionally, as part of HUD's oversight responsibility, the collected

  <description><![CDATA[ The proposed information collection requirement described 
below has been submitted to the Office of Management and Budget (OMB) 
for review, as required by the Paperwork Reduction Act. The Department  is soliciting public comments on the subject proposal.</p><p>    A buyer may assume an FHAinsured mortgage by becoming the 
substitute mortgagor through the credit approval process. Prior to 
releasing a seller from liability on the mortgage note or for mortgages 
after December 15, 1989, HUD or a Direct Endorsement (DE) lender must 
review the credit of the assumer and record the approval.

Final Fair Market Rents for Fiscal Year 2009 for the Housing  Choice Voucher Program and Moderate Rehabilitation Single]]></title>

  <description><![CDATA[ Section 8(c)(1) of the United States Housing Act of 1937 
(USHA) requires the Secretary to publish FMRs periodically, but not 
less than annually, adjusted to be effective on October 1 of each year. 
The primary uses of FMRs are to determine payment standard amounts for 
the Housing Choice Voucher program, to determine initial renewal rents 
for some expiring projectbased Section 8 contracts, to determine 
initial rents for housing assistance payment (HAP) contracts in the 
Moderate Rehabilitation Single Room Occupancy program (Mod Rehab), and 
to serve as a rent ceiling in the HOME rental assistance program. 
Today's notice provides final FY2009 FMRs for all areas that reflect 
the estimated 40th and 50th percentile rent levels trended to April 1, 
2009. The FY2009 FMRs are based on 2000 Census data updated with more 
current survey data. For FY2009, FY2008 FMRs are updated using 2006 
American Community Survey (ACS) data, and more recent Consumer Price

  <description><![CDATA[ In accordance with section 102(a)(4)(C) of the Department of 
Housing and Urban Development Reform Act of 1989, this announcement 
notifies the public of past funding decisions made by the Department in 
a competition for funding under the 2005, 2006 and 2007 Notices of 
Funding Availability (NOFAs) for the Homeless Assistance Grants 
program. This announcement contains the names of the awardees and the 
amounts of the awards made available. Federal Register notices on these 
actions were not published at the time; however, the public was advised 
of these grant selections since they were posted on HUD's Web site. The 
postings contained listings of the selected applicants including 
descriptions of the projects.

Multifamily Mortgage Insurance Premiums (MIPs) and Credit Subsidy  Obligations for Fiscal Year (FY) 2009]]></title>

  <description><![CDATA[ This notice announces the mortgage insurance premiums (MIPs) 
for Federal Housing Administration (FHA) multifamily mortgage insurance 
programs that have commitments to be issued or reissued in Fiscal Year 
(FY) 2009. The FY2009 MIPs are the same as in FY2008. This annual 
notice includes for the first time two additional MIPs for the hospital 
mortgage insurance programs: (1) Supplemental loans for hospitals; and 
(2) refinancing for existing FHAinsured hospitals. These are not new 
MIPs and the amounts charged for them will be the same as in previous  years.</p><p>    In addition to announcing MIPs for FY2009, this notice announces 
that credit subsidy obligations are required for firm commitments 
issued or reissued for FHA's three positive credit subsidy programs: 
(1) Section 221(d)(3) New Construction/Substantial Rehabilitation for 
Nonprofit/Cooperatives; (2) Section 241(a) Supplemental Loans for 
apartments only; and (3) Section 223(d) Operating Loss Loans. These 
obligations are not new for FY2009.
