</p><p>    Pursuant to 21 U.S.C. 958(i), the Attorney General shall, prior to 
issuing a registration under this Section to a bulk manufacturer of a 
controlled substance in schedule I or II, and prior to issuing a 
regulation under 21 U.S.C. 952(a)(2) authorizing the importation of 
such a substance, provide manufacturers holding registrations for the 
bulk manufacture of the substance an opportunity for a hearing.
</p><p>    Therefore, in accordance with Title 21 Code of Federal Regulations 
(CFR), 1301.34(a), this is notice that on July 15, 2008, Cerilliant

</p><p>    Pursuant to Sec.  1301.33(a) of Title 21 of the Code of Federal 
Regulations (CFR), this is notice that on August 18, 2008, GE 
Healthcare, 3350 North Ridge Avenue, Arlington Heights, Illinois 60004 1412, made application by renewal to the Drug Enforcement <br/>
Administration (DEA) as a bulk manufacturer of Cocaine (9041), a basic  class of controlled substance listed in schedule II.</p><p>    The company plans to manufacture a radioactive product used in 
diagnostic imaging in the diagnosis of Parkinson's Disease and for 
manufacture in bulk for investigational new drug (IND) submission and  clinical trials.</p><p>    Any other such applicant, and any person who is presently

Notice of Lodging of Consent Decree Under the Oil Pollution Act]]></title>

</p><p>    Notice is hereby given that on November 25, 2008, a proposed 
Consent Decree (``Decree'') in United States v. f/v North Wind, Inc., 
Civil Action No. 1:06cv00272DAEBMK, was lodged with the United  States District Court for the District of Hawaii.</p><p>    The civil action relates to the July 1, 2005 incident when the M/V 
Casitas, a 145foot motor vessel owned and operated by f/v North Wind,  Inc., ran<br/> [[Page 74193]]<br/>
aground on the reef near North Island at Pearl and Hermes Atoll, a part 
of the Hawaiian Islands National Wildlife Refuge, and which is also 
within the Papahanaumokuakea Marine National Monument. In this action 
the United States and State of Hawaii seek to obtain damages for injury  to natural resources under the Oil Pollution Act (OPA).</p><p>    The proposed Decree would require North Wind to pay $2,817,626.48 
for damages, in exchange for a covenant not to sue from the United 
States and Hawaii for damages under OPA, the Comprehensive

  <title><![CDATA[  Import and Production Quotas for Certain List I Chemicals ]]></title>

  <description><![CDATA[ On March 9, 2006, the President signed the Combat 
Methamphetamine Epidemic Act of 2005, which mandates that DEA establish 
total annual requirements, and individual import, manufacturing, and  procurement quotas for ephedrine, pseudoephedrine, and <br/>
phenylpropanolamine. DEA issued an Interim Final Rule establishing 
procedures for applying for individual import, manufacturing, and 
procurement quotas. DEA is finalizing the rule with one change, to 
extend the authority to sign certifications to persons granted power of 
attorney to do so by the registrant.

November 4, 2008, a proposed Administrative Order on Consent (``AOC'') 
was executed in connection with the Peter Cooper Landfill Superfund 
Site (``Site''), in the Village of Gowanda (``Village''), Cattaraugus  County, New York.</p><p>    The proposed Consent Decree will settle the United States' claims 
on behalf of the U.S. Environmental Protection Agency (``EPA'') against

Orders for Preliminary Injunctive Relief (``Stipulated Orders'') in 
United States v. Commonwealth Utilities Corporation and the 
Commonwealth of the Northern Mariana Islands, Civil Action No. 080051, 
were lodged with the United States District Court for the Commonwealth 
of the Northern Mariana Islands. The Commonwealth Utilities Corporation 
(``CUC'') is a public corporation that owns and operates the Agingan 
and Sadog Tasi Sewage Treatment Plants and associated wastewater 
collection and conveyance systems, public water systems, and power

the factors in 21 U.S.C. 823(a) and determined that the registration of

hereby given that on November 20, 2008, a proposed Amended Consent 
Decree in United States and Commonwealth of Kentucky v. the Louisville 
and Jefferson County Metropolitan Sewer District (MSD) Civil Action No. 
3:08CV0068CRS, was lodged with the United States District Court for  the Western District of Kentucky, Louisville Division.</p><p>    The Amended Consent Decree represents the settlement of claims 
brought by the United States and Commonwealth pursuant to the Clean 
Water Act (CWA). The complaint contained claims seeking injunctive 
relief and the recovery of a civil penalty in connection with 
wastewater treatment facilities owned and operated by MSD. The Amended 
Consent Decree, which incorporates, amends and supercedes the previous 
Consent Decree entered by the Court on August 12, 2005, requires MSD to 
undertake action necessary to achieve compliance with its National

owned and/or operated by the Defendant in the States of Georgia, North 
Carolina, and Virginia, during the period January 2000 to November 
2006. The Consent Decree also resolves a claim that Defendant failed to 
prepare and implement a Spill Prevention, Control, and Countermeasure 
Plan for a Virginia facility, as required by 40 CFR 112.3. Pursuant to 
the Consent Decree, Defendant agrees to pay civil penalties of $715,000

</p><p>    In accordance with Departmental Policy, 28 CFR 50.7, notice is 
hereby given that a proposed Consent Decree in United States v. Apex 
Energy, Inc. et al., Civil No. 7:08cv00213, was lodged with the 
United States District Court for the Eastern District of Kentucky on  November 13, 2008.</p><p>    This proposed Consent Decree concerns a complaint filed by the 
United States against Apex Energy, Cambrian Coal Corporation, and 
Marshall Resources, Inc., pursuant to section 301(a) of the Clean Water 
Act, 33 U.S.C. 1311(a), to obtain injunctive relief and impose civil 
penalties against the Defendants for violating the Clean Water Act by 
discharging fill material without a permit into waters of the United 
States. The proposed Consent Decree resolves these allegations by 
requiring the Defendants to pay a civil penalty. In addition, 
Defendants have agreed to make a payment to the Kentucky Department of 
Fish and Wildlife Resources' Stream and Wetlands Mitigation Program

on behalf of the Environmental Protection Agency (``EPA''), under the 
Comprehensive Environmental Response, Compensation, and Liability Act

the Housatonic River known as the 1\1/2\ Mile Reach in Pittsfield,

will approve applicants for inclusion on publicly available provider 
lists in one or more federal judicial districts if an applicant

</p><p>    Notice is hereby given that on November 5, 2008, three proposed 
consent decrees in United States v. Belle Tire Distr., Inc., et al., 
No. 06cv0816, were lodged with the United States District Court for the  Western District of Michigan.</p><p>    In this cost recovery action brought pursuant to the Comprehensive 
Environmental Response, Compensation and Liability Act, 42 U.S.C. 9607, 
the United States sought recovery of unreimbursed past response costs 
and prejudgment interest incurred by the United States Environmental 
Protection Agency for a removal action at the Carl's Tire Retreading 
Site near Grawn in Grand Traverse County, Michigan. Under the three 
proposed consent decrees, three defendants will pay a total of $97,000 
to the Hazardous Substance Superfund, an amount determined based upon 
an analysis of their ability to pay a settlement or judgment.

Decree in United States v. Biofriendly Corporation, Civil Action No. 
CV087124 SJO (CTx), was lodged with the United States District Court  for the Central District of California.</p><p>    In this action, the United States sought civil penalties and 
injunctive relief under the Clean Air Act Section 211(d), 42 U.S.C. 
7545(d), for violations of the statute's registration requirements 
pertaining to fuel additives and fuels containing additives, which are 
manufactured and sold in the United States. The proposed Consent Decree 
would require Biofriendly Corporation to pay a civil penalty to the 
United States in the amount of $1,250,000. Defendant's performance of 
obligations under the Consent Decree would resolve its liability for  allegations in the underlying Complaint.</p><p>    For a period of thirty (30) days from the date of this publication,

  <title><![CDATA[  Exempt Chemical Mixtures Containing Gamma-Butyrolactone ]]></title>

  <description><![CDATA[ DEA is proposing that chemical mixtures that are 70 percent or 
less gammabutyrolactone (GBL), by weight or volume, be automatically 
exempt from regulatory controls under the Controlled Substances Act 
(CSA). DEA is seeking through this rulemaking to exempt only those 
chemical mixtures that do not represent a significant risk of 
diversion. If finalized as proposed, this regulation would result in 
GBL chemical mixtures, in concentrations greater than 70 percent, 
becoming subject to List I chemical regulatory requirements of the CSA, 
except if exempted through an existing categorical exemption. DEA is 
taking this action because there is a serious threat to the public 
safety associated with the ease by which GBL is chemically converted to 
the schedule I controlled substance gammahydroxybutyric acid (GHB).
</p><p>    DEA recognizes that concentration criteria alone cannot identify 
all mixtures that warrant exemption. As a result, 21 CFR 1310.13

</p><p>    Under 28 CFR 50.7, notice is hereby given that on October 30, 2008, 
three proposed and related Consent Decrees in United States v. American 
Hoechst Corp., et al., No. 3:08cv1509, United States v. A. R. Sandri, 
Inc., et al., No. 3:08cv1508, and United States v. M. Swift & Sons, 
Inc., et al., No. 3:08cv1507, were lodged with the United States  District Court for the District of Connecticut.</p><p>    The proposed Consent Decrees resolve claims of the United States, 
on behalf of the Environmental Protection Agency (``EPA''), under the 
Comprehensive Environmental Response, Compensation, and Liability Act 
(``CERCLA''), 42 U.S.C. 9601 et seq., in connection with the Solvents 
Recovery Service of New England, Inc. Superfund Site in Southington,  Connecticut (``Site''), against 272 defendants.</p><p>    The proposed Consent Decree in U.S. v. American Hoechst Corp., et 
al. requires 58 defendants to perform the Remedial Design/Remedial 
Action (``RD/RA'') set forth in the Record of Decision (``ROD'') for

Notice of Lodging of Consent Decree Under the Comprehensive  Environmental Response, Compensation and Liability Act]]></title>

</p><p>    Notice is hereby given that on October 29, 2008, a proposed Consent 
Decree in United States v. Agere Systems, Inc., et al., Civil Action 
No. 08CV5123 was lodged with the United States District Court for the  Eastern District of Pennsylvania.</p><p>    In this action the United States sought reimbursement of response 
costs incurred in connection with property known as the Berks Landfill 
Superfund Site (the ``Site''), located in Spring Township, 
Pennsylvania. The Consent Decree obligates the Settling Defendants to 
reimburse $190,000 of the United States' past response costs paid in 
connection with the Site from June 1, 2002 through April 28, 2006, and  all response costs paid or to be paid after that date.</p><p>    The Department of Justice will receive for a period of thirty (30) 
days from the date of this publication comments relating to the Consent

  <title><![CDATA[  Notice Pursuant to the National Cooperative Research and  Production Act of 1993--American Society of Mechanical]]></title>

</p><p>    Notice is hereby given that, on October 3, 2008, pursuant to 
Section 6(a) of the National Cooperative Research and Production Act of 
1993, 15 U.S.C. 4301 et seq. (``the Act''), American Society of 
Mechanical Engineers (``ASME'') has filed written notifications 
simultaneously with the Attorney General and the Federal Trade 
Commission disclosing additions or changes to its standards development 
activities. The notifications were filed for the purpose of extending 
the Act's provisions limiting the recovery of antitrust plaintiffs to 
actual damages under specified circumstances. Specifically, since June 
30, 2008, ASME has published three new standards and initiated twelve 
new standards activities within the general nature and scope of ASME's 
standards development activities, as specified in its original

notice is hereby given that, on October 12, 2008, a proposed 
Modification of Consent Decree in United States, et al. v. City of 
Nashua, New Hampshire, Civil Action No. 1:05cv00376PB, was lodged 
with the United States District Court for the District of New  Hampshire.</p><p>    In this action the United States, on behalf of the United States 
Environmental Protection Agency (``EPA''), filed a Complaint against 
the City of Nashua alleging violations of the Clean Water Act 
concerning the City's current or former combined sewer outfall 
(``CSO'') facilities. Under the terms of the Consent Decree, the City 
undertook the implementation of a CSO abatement plan with a completion 
date of August 2012. The mitigation measures are extensive, requiring

  <title><![CDATA[  Solicitation for a Cooperative Agreement--Production of Seven  Satellite/Internet Broadcasts]]></title>

Corrections (NIC) announces the availability of funds in FY 2009 for a 
cooperative agreement to fund the production of seven satellite/
Internet broadcasts. Five of the proposed satellite programs are 
nationwide satellite/Internet broadcasts (three and four hours each). 
One of the programs is eighthours in length and is for site 
coordinators as a precursor to a 32hour program. Another is a 
satellite/Internet Training Program which will be sixteen hours in 
length (four hours each day, Monday through Thursday). There will be a 
total of 39 hours of broadcast time in FY 2009.

comments. On October 4, 2005, the United States filed an Amended 
Complaint alleging that the National Association of Realtors (``NAR'') 
violated Section 1 of the Sherman Act, 15 U.S.C. 1, by adopting 
policies that suppress competition from real estate brokers who use 
passwordprotected ``virtual office Web sites'' or ``VOWs'' to deliver

decree in United States of America and the State of Kansas v. Magellan 
Ammonia Pipeline et al. Civil Action No. 08cv2532, was lodged with

</p><p>    The Complaint, filed by the Plaintiffs who are Trustees for natural 
resources, alleges that the Defendants are liable under Section 107 of 
the Comprehensive Environmental Response, Compensation, and Liability [[Page 65404]]<br/>
Act (``CERCLA''), 42 U.S.C. 9607(a), and Section 311 of the Clean Water 
Act (``CWA''), 33 U.S.C. 1321, for damages for injury to, destruction 
of, or loss of natural resources in or near Kingman, Kansas, resulting 
from the release of anhydrous ammonia from a pipeline owned and  operated by Defendants on or about October 27, 2004.</p><p>    In the Consent Decree, the Defendants have agreed to pay a total of

  <description><![CDATA[ The Office of Justice Programs (OJP) announces that the Review 
Panel on Prison Rape (Panel) will hold a hearing in Culpeper, Virginia 
on November 14, 2008. The hearing time and location are noted below.The 
purpose of the hearing is to assist the Bureau of Justice Statistics 
(BJS) in identifying common characteristics of victims and perpetrators 
of rape in county jails, and the characteristics of U.S. jails with the 
highest and lowest incidence of rape, based on an anonymous survey by 
BJS of inmates in a representative sample of jails. On June 25, 2008, 
BJS issued the report Sexual Victimization in Local Jails Reported by 
Inmates, 2007. The report provides a listing of local jails grouped 
according to the prevalence of reported sexual victimization, and it 
formed the basis of the Panel's decision about which facilities would 
be the subject of testimony.

  <description><![CDATA[ The purpose of this notice is to announce the meeting of the 
Criminal Justice Information Services (CJIS) Advisory Policy Board 
(APB). The CJIS APB is a federal advisory committee established 
pursuant to the Federal Advisory Committee Act. This meeting 
announcement is being published as required by Section 10 of the FACA.
</p><p>    The CJIS APB is responsible for reviewing policy issues and 
appropriate technical and operational issues related to the programs 
administered by the FBI's CJIS Division, and thereafter, making 
appropriate recommendations to the FBI Director. The programs 
administered by the CJIS Division are the Integrated Automated 
Fingerprint Identification System, the Interstate Identification Index, 
Law Enforcement Online, National Crime Information Center, the National 
Instant Criminal Background Check System, the National IncidentBased

Notice of Lodging of Proposed Settlement Agreement Under the  Comprehensive Environmental Response, Compensation and]]></title>

</p><p>    Notice is hereby given that on October 24, 2008, a proposed 
Settlement Agreement regarding the Precision National Plating Services 
Superfund Site (the Site), was filed with the United States District 
Court for the Middle District of Pennsylvania in United States v. 
Precision National Plating Services, Inc., Civil No. 3:08CV1946 (M.D. 
Penn.). Under the terms of the proposed Consent Decree, Precision will 
pay EPA $987,809.25 for unreimbursed response costs incurred at the 
Site from April 29, 2004 through August 18, 2007. In addition, 
Precision has agreed to reimburse EPA for future response costs 
associated with the Site, and Precision will continue work to clean up 
the Site pursuant to a Unilateral Administrative Order issued by EPA in  April 1998.</p><p>    The Department of Justice will receive comments relating to the 
proposed Agreement for a period of thirty (30) days from the date of

District Court for the District of Columbia on July 1, 1999 (United

States v. Cummins Engine Company, Case No. 1:98CV02546; United States
