On March 1, the Department of State released the Draft Supplemental Environmental Impact Statement (SEIS) for the Presidential Permit application for the proposed Keystone XL pipeline. The document is a draft technical review of potential environmental impacts. It does not make any recommendations on whether the pipeline border crossing should be approved or denied.

Consistent with the National Environmental Policy Act (NEPA), the Department of State (the Department) is holding a public comment period. The 45day public comment period began on March 8. The Department has decided to hold a public meeting in conjunction with the public comment period. The Department will take into account public comments before the Draft SEIS is finalized. Once final, the document will help inform the U.S. government's decision on whether the Keystone XL pipeline serves the national interest.

Line 67 is currently fully operational, transporting 450,000 to 500,000 barrels per day (bpd) of crude oil across the border from the Western Canadian Sedimentary Basin to Enbridge's terminal located in Superior, Wisconsin. From there, the material is shipped to various markets in the United States and Canada.

Enbridge is now proposing to expand the volume transported across the border in the Line 67 Pipeline in order to help address current and future demand by U.S. and Canada refineries for supplies of heavy crude oil from the Western Canadian Sedimentary Basin (WCSB) (``the Enbridge Energy, Line 67 Expansion Project'').

The Department has determined that before determining whether to authorize the proposed higher capacity operation of Line 67 at the U.S. border, it will conduct an environmental review of the Project consistent with the National Environmental Policy Act (``NEPA''). The Department will

Presidential Permits To Operate and Maintain Pipeline Facilities on U.S. and Canada

Notice is hereby given that the Department of State (DOS) has received from Enbridge Energy, Limited Partnership (``Enbridge''), a Presidential Permit application to amend the August 3, 2009 Presidential Permit issued to Enbridge by the DOS authorizing the construction, operation, and maintenance of the Line 67 (``Line 67'') Pipeline across the U.S.Canada border. Enbridge requests an amendment to its permit in order to operate the Line 67 up to its full design capacity of 880,000 barrels per day (bpd) of crude oil with an average annual capacity of 800,000 bpd of heavy crude.
