Endangered and Threatened Wildlife and Plants; Proposed Endangered Status for the Georgia Pigtoe Mussel, Interrupted

We, the U.S. Fish and Wildlife Service (Service), propose to list the Georgia pigtoe mussel (Pleurobema hanleyianum), interrupted rocksnail (Leptoxis foremani), and rough hornsnail (Pleurocera foremani), as endangered species under the Endangered Species Act of 1973, as amended (Act). The Georgia pigtoe, interrupted rocksnail, and rough hornsnail are endemic to the Coosa River drainage within the Mobile River Basin of Alabama, Tennessee, and Georgia. These three species have disappeared from large portions of their natural ranges due to extensive construction of dams that eliminated or reduced water currents and caused changes in habitat and water quality. The surviving populations are small, localized, and highly vulnerable to water quality and habitat deterioration.

Temporary Vehicle Restriction on U. S. Route 209

The National Park Service (NPS), Delaware Water Gap National Recreation Area, in conjunction with the Federal Highway
Administration, is repairing and reconstructing the Bushkill Creek Bridge along U.S. Route 209. During the repair and reconstruction period, Bushkill Creek Bridge will be closed. A detour route is available, but can only accommodate vehicles with a gross vehicle weight rating (GVWR) less than 15 tons. For this reason, NPS is instituting a temporary restriction of vehicles with a GVWR in excess of 15 tons (30,000 lbs GVWR) along U.S. Route 209 in the park. This temporary restriction will be in effect starting July 9, 2009 at 1800 hours and will remain in effect 24 hours a day until July 27, 2009 at 1800 hours.

Following a review of the petition, we find that the petition presents substantial scientific or commercial information indicating that revision of the critical habitat for E. pelinophilum may be warranted. This notice announces the termination of the process to develop an Environmental Impact Statement (EIS) for the Harriet Tubman Special Resource Study (SRS). The SRS was undertaken at the direction of Congress in Public Law 106516 to evaluate sites related to Harriet Tubman for potential inclusion in the national park system. The study area includes parts of Maryland and New York. A Notice of Intent to Prepare an EIS was published in the Federal Register on February 7, 2003.

Initial formal public scoping took place through spring 2004, followed by continuous informal consultation with stakeholders, agency officials, and the interested public. From June through September 2008, NPS held stakeholder and public meetings and took comments on the preliminary alternatives.

Pursuant to section 102(2)(C) of the National Environmental Policy Act of 1969, as amended, the Bureau of Reclamation (Reclamation) proposes to prepare an Environmental Impact Statement (EIS) on the Cle Elum Dam Fish Passage Facilities and Fish ReIntroduction Project. The Washington State Department of Ecology (Ecology) will be a joint lead with Reclamation in the preparation of this EIS, which will also be used to comply with requirements of the Washington State Environmental Policy Act (SEPA).

Reclamation is evaluating the construction of downstream juvenile [[Page 16008]]
fish passage and upstream adult fish passage alternatives at the dam for the Cle Elum Dam Fish Passage Facilities Project. Cle Elum Dam did not include fish passage facilities when constructed in 1933; consequently, fish passage to upstream habitat for fish species was blocked.

The Great Sand Dunes Wilderness within Great Sand Dunes National Monument was designated by Public Law 94567, dated Oct 20th, 1976. According to the act the wilderness was to comprise 33,450 acres with a potential wilderness addition of 670 acres. Public Law 95625, dated Nov 10th, 1978 added 1,109 acres to Great Sand Dunes National Monument and Public Law 9687, dated Oct 12th, 1979, amended this addition to 1,900 acres and further added that ``The Secretary shall designate the lands described by this paragraph for management in accordance with the adjacent lands within the monument * * *.'' This amendment, therefore, has the effect of authorizing inclusion of the 1,900 acres in the wilderness area. At the time the Acts were approved the added lands had nonconforming uses prohibited by the Wilderness Act of 1964 and so were designated as potential wilderness until such time as the nonconforming uses were eliminated.

We, the U.S. Fish and Wildlife Service (Service or USFWS) identify the Western Great Lakes (WGL) Distinct Population Segment (DPS) of the gray wolf (Canis lupus). The geographic extent of this DPS includes all of Minnesota, Wisconsin, and Michigan; the eastern half of North Dakota and South Dakota; the northern half of Iowa; the northern portions of Illinois and Indiana; and the northwestern portion of Ohio. Under the authority of the Endangered Species Act of 1973, as amended (Act), we, the U.S. Fish and Wildlife Service (Service), identify a distinct population segment (DPS) of the gray wolf (Canis lupus) in the Northern Rocky Mountains (NRM) of the United States and revise the List of Endangered and Threatened Wildlife by removing gray wolves within NRM DPS boundaries, except in Wyoming. The NRM gray wolf DPS encompasses the eastern onethird of Washington and Oregon, a small part of northcentral Utah, and all of Montana, Idaho, and Wyoming. The National Park Service (NPS) is preparing an Environmental Impact Statement (EIS) on a proposed Brooks River bridge and boardwalk, and associated access changes, to the Brooks Camp Area within Katmai National Park and Preserve. The purpose of the EIS is to evaluate a reasonable range of alternatives for a bridge and boardwalk that would span the lower Brooks River. The existing floating bridge would be removed. A new bridge would provide for the existing floatplane access to the Brooks Camp Area to continue, with planes beaching on the shore of Naknek Lake on the north side of Brooks River. This proposal would tier off the 1996 Brooks River Area Development Concept Plan (DCP) and EIS. If the decision is to construct a new bridge, it would result in an amendment to the access decision, which called for construction of a new floatplane dock, breakwater, onemile access road on the south side of Brooks River, and required a shuttle system.

This notice publishes an amendment to the Tulalip Tribe's Liquor Control Ordinance published in the Federal Register September 16, 1977 (42 FR 46612). The amendment regulates and controls the possession and consumption of liquor within the tribal lands. Per 30 U.S.C. 188(d), Whiting Oil & Gas Corporation timely filed petitions for reinstatement of oil and gas leases NDM 94955, NDM 97028 and NDM 97029, Billings and McKenzie Counties, North Dakota. The lessee paid the required rentals accruing from the date of termination.

No leases were issued that affect these lands. The lessee agrees to new lease terms for rentals and royalties of $10 per acre and 16\2/3\ percent or 4 percentages above the existing competitive royalty rate. We, the U.S. Fish and Wildlife Service (Service), announce the availability of the draft postdelisting monitoring plan (draft PDM Plan) for the Hawaiian hawk (Buteo solitarius) and the reopening of the public comment period for the proposed rule to remove (delist) the Hawaiian hawk from the Federal List of Endangered and Threatened Wildlife. If the proposed rule to delist the Hawaiian hawk is made final, we intend to monitor the hawk, in cooperation with the State of Hawaii and other conservation partners, through islandwide surveys every 5 years for a period of 20 years, from 2012 to 2032. We are soliciting review and comment on this draft PDM plan from local, State, and Federal agencies, and the public. We are also reopening the comment period on the proposed rule to ensure that the public has full access to the draft PDM Plan while commenting on the proposed rule.
