  <description><![CDATA[ EPA is taking direct final action to amend the national 
emission standards for electric arc furnace (EAF) steelmaking 
facilities that are area sources of hazardous air pollutants published 
on December 28, 2007. The amendments to the area source standards for 
EAF steelmaking facilities clarify applicability of the opacity limit, 
make the performance test requirements for particulate matter 
consistent with requirements in the new source performance standards 
for EAF steelmaking facilities, allow title V test data to be used to 
demonstrate compliance, and revise the definition of ``scrap provider'' 
to include EAF steelmaking facilities that own and operate a scrap 
shredder.

Standards Applicable to Generators of Hazardous Waste;  Alternative Requirements for Hazardous Waste Determination and ]]></title>

  <description><![CDATA[ The Environmental Protection Agency (EPA or the Agency) is 
finalizing an alternative set of generator requirements applicable to 
laboratories owned by eligible academic entities, as defined in this 
final rule. The rule provides a flexible and protective set of 
regulations that address the specific nature of hazardous waste 
generation and accumulation in laboratories at colleges and 
universities, as well as other eligible academic entities formally 
affiliated with colleges and universities. This final rule is optional 
and colleges and universities and other eligible academic entities 
formally affiliated with a college or university have the choice of 
managing their hazardous wastes in accordance with the new alternative 
regulations as set forth in this final regulation or remaining subject 
to the existing generator regulations.

  <description><![CDATA[ EPA is proposing to amend the national emission standards for

adverse comment, we will not take further action on this proposed rule.

  <title><![CDATA[
Standards of Performance for New Stationary Sources and Emission  Guidelines for Existing Sources:]]></title>

  <description><![CDATA[ On September 15, 1997, EPA adopted new source performance 
standards (NSPS) and emission guidelines (EG) for hospital/medical/
infectious waste incinerators (HMIWI). The NSPS and EG were established 
under sections 111 and 129 of the Clean Air Act (CAA or Act). The 
Sierra Club and the Natural Resources Defense Council (Sierra Club) 
filed suit in the U.S. Court of Appeals for the District of Columbia 
Circuit (the Court) challenging EPA's methodology for adopting the 
regulations. On March 2, 1999, the Court remanded the rule to EPA for 
further explanation of the Agency's reasoning in determining the 
minimum regulatory ``floors'' for new and existing HMIWI. The Court did 
not vacate the regulations, so the NSPS and EG remain in effect and  were fully implemented by September 2002.</p><p>    On February 6, 2007, EPA published a proposed response to the 
Court's remand and a proposed response to the CAA section 129(a)(5) 
requirement to review the NSPS and EG every 5 years. However, following

Protection of Stratospheric Ozone: Request for Applications for  Essential Use Allowances for 2010 and 2011]]></title>

  <description><![CDATA[ The Environmental Protection Agency (EPA) is requesting 
applications for essential use allowances for calendar years 2010 and 
2011. Essential use allowances provide exemptions from the phaseout on 
production and import of ozonedepleting substances (ODSs). Essential 
use allowances must be authorized by the Parties to the Montreal 
Protocol on Substances that Deplete the Ozone Layer (the Protocol). The 
U.S. Government will use the applications received in response to this 
notice as the basis for its nomination of essential uses at the 21st 
Meeting of the Parties to the Protocol, to be held in 2009.

Diflubenzuron; Pesticide Tolerances for Emergency Exemptions]]></title>

  <description><![CDATA[ This regulation establishes time-limited tolerances for  combined residues of diflubenzuron and its metabolites p<br/>
chlorophenylurea and pchloroaniline in or on alfalfa, forage and 
alfalfa, hay. This action is in response to EPA's granting of an 
emergency exemption under section 18 of the Federal Insecticide, 
Fungicide, and Rodenticide Act (FIFRA) authorizing use of the pesticide 
on alfalfa and mixed grass/alfalfa fields. This regulation establishes 
a maximum permissible level for residues of diflubenzuron and its 
metabolites pchlorophenylurea and pchloroaniline, in these food 
commodities. The timelimited tolerances expire and are revoked on 
December 31, 2011.

  <title><![CDATA[
Effluent Limitations Guidelines and Standards for the  Construction and Development Point Source Category]]></title>

  <description><![CDATA[ The Environmental Protection Agency is proposing a regulation 
that would strengthen the existing regulatory program for discharges 
from construction sites by establishing technologybased Effluent 
Limitations Guidelines and New Source Performance Standards for the 
Construction and Development (C&D) point source category. This 
proposal, if implemented, would significantly reduce the amount of 
sediment and other pollutants discharged from construction sites. EPA 
estimates that this proposed rule would cost $1.9 billion dollars per 
year with annual monetized benefits of $332.9 million. This proposed 
rule requests comment and information on the proposed regulation and an 
alternate option with a different numeric limit based on different 
technologies, as well as specific aspects of the proposal such as 
technologies, costs, loading reductions, and economic achievability.

Protection of Stratospheric Ozone: The 2009 Critical Use  Exemption From the Phaseout of Methyl Bromide]]></title>

  <description><![CDATA[ EPA is proposing an exemption to the phaseout of methyl 
bromide to meet the needs of 2009 critical uses. Specifically, EPA is 
proposing uses that qualify for the 2009 critical use exemption and the 
amount of methyl bromide that may be produced, imported, or supplied 
from existing prephaseout inventory for those uses in 2009. EPA is 
taking action under the authority of the Clean Air Act to reflect a 
recent consensus decision taken by the Parties to the Montreal Protocol 
on Substances that Deplete the Ozone Layer at the Nineteenth Meeting of 
the Parties. EPA is seeking comment on the list of critical uses and on 
EPA's determination of the amounts of methyl bromide needed to satisfy 
those uses.

  <title><![CDATA[
Oil Pollution Prevention; Spill Prevention, Control, and  Countermeasure Rule; Revisions to the Regulatory Definition]]></title>

  <description><![CDATA[ The Environmental Protection Agency (EPA) is promulgating a 
final rule to amend a Clean Water Act (CWA) section 311 regulation that 
defines the term ``navigable waters.'' On July 17, 2002, EPA 
promulgated a final rule which included revisions to the definition of 
``navigable waters'' in the Spill Prevention, Countermeasure and 
Control (SPCC) regulation. In this action, EPA is announcing the 
vacatur of the July 17, 2002 revisions to the definition of ``navigable 
waters'' in accordance with an order, issued by the United States 
District Court for the District of Columbia (D.D.C.) in American 
Petroleum Institute v. Johnson, 571 F.Supp.2d 165 (D.D.C. 2008), 
invalidating those revisions. The court decision also restored the 
regulatory definition of ``navigable waters'' promulgated by EPA in 
1973; consequently, we are amending the definition of ``navigable 
waters'' in part 112 to comply with that decision.

Modification of Pesticide Tolerance Revocation for Diazinon]]></title>

  <description><![CDATA[ This final rule amends the pesticide tolerance regulation for 
diazinon by modifying the revocation of the tolerance for mushrooms. 
Pesticide tolerances are established under the Federal Food, Drug, and 
Cosmetic Act (FFDCA). This final rule resolves an objection filed by 
the American Mushroom Institute in response to a final rule on diazinon 
tolerances published on September 10, 2008, by granting the objection 
and modifying the revocation of the diazinon tolerance on mushrooms to 
expire on September 10, 2010.

disapproval of revisions to the applicable implementation plan for the 
State of Texas which relate to public participation on air permits for

approval and limited disapproval affects portions of SIP revisions 
submitted by Texas on December 15, 1995; July 22, 1998; and the SIP 
revisions submitted October 25, 1999. EPA is taking comments on this 
proposal and plans to follow with a final action.

Oil Pollution Prevention; Non-Transportation Related Onshore  Facilities]]></title>

  <description><![CDATA[ The Environmental Protection Agency (EPA) is proposing to 
amend the dates by which facilities must prepare or amend Spill 
Prevention, Control, and Countermeasure (SPCC) Plans, and implement 
those Plans. The Agency is also proposing to establish dates for farms 
to prepare or amend their Spill Prevention, Control, and Countermeasure 
Plans (SPCC Plans), and implement those Plans. EPA had delayed 
establishing compliance dates for farms pending revisions to the SPCC 
rule that would specifically address this sector. Two different 
extension dates are proposed for farms and production facilities that 
meet the qualified facilities criteria. Elsewhere in this Federal 
Register, the Agency is finalizing certain tailored and streamlined 
requirements for facilities subject to the SPCC requirements.

  <title><![CDATA[
Proposed Approval of the Central Characterization Project's  Remote-Handled Transuranic Waste Characterization Program]]></title>

  <description><![CDATA[ The Environmental Protection Agency (EPA or we) is announcing 
the availability of, and soliciting public comments for 45 days on, the 
proposed approval of the radioactive, remotehandled (RH), transuranic 
(TRU) waste characterization program implemented by the Central 
Characterization Project (CCP) at Oak Ridge National Laboratory (ORNL) 
in Oak Ridge, Tennessee. This waste is intended for disposal at the  Waste Isolation Pilot Plant (WIPP) in New Mexico.</p><p>    In accordance with the WIPP Compliance Criteria, EPA evaluated the 
characterization of RH TRU debris waste from ORNLCCP during an 
inspection conducted on June 30July 2, 2008. Using the systems and 
processes developed as part of the U.S. Department of Energy's (DOE's) 
Carlsbad Field Office (CBFO) program, EPA verified whether DOE could 
adequately characterize RH TRU waste consistent with the Compliance 
Criteria. The results of EPA's evaluation of ORNLCCP's RH program and 
its proposed approval are described in the Agency's inspection report,

  <title><![CDATA[Federal Agency Hazardous Waste Compliance ]]></title>

  <description><![CDATA[ Since 1988, the U.S. Environmental Protection Agency (EPA) has 
maintained a Federal Agency Hazardous Waste Compliance Docket (``the 
Docket'') under Section 120(c) of the Comprehensive Environmental 
Response, Compensation, and Liability Act (CERCLA). Section 120(c) 
requires EPA to establish a Docket that contains certain information 
reported to EPA by Federal facilities that manage hazardous waste or 
from which a reportable quantity of hazardous substances has been 
released. The Docket is used to identify Federal facilities that should  be evaluated to determine if they pose a<br/> [[Page 71645]]<br/>
threat to public health or welfare and the environment and to provide a 
mechanism to make this information available to the public. The Docket 
contains information that is submitted by Federal facilities under the 
following authorities: CERCLA Section 103, and RCRA Sections 3005, 3010

Ocean Dumping; Designation of Ocean Dredged Material Disposal  Sites Offshore of the Umpqua River, OR]]></title>

  <description><![CDATA[ EPA is withdrawing an earlier proposal to designate an ocean 
dredged material disposal site near the mouth of the Umpqua River, 
Oregon, and is proposing to designate two new ocean dredged material 
disposal sites located offshore of the Umpqua River, Oregon. EPA's 
proposed rule was published at 56 FR 49858 (October 2, 1991). Changes 
since that time to the single site EPA proposed, as well as changes to 
the ocean dumping program, including changes to the Marine Protection, 
Research, and Sanctuaries Act, as amended (MPRSA), 33 U.S.C. 1401 to 
1445, give rise to EPA's decision to withdraw the October 2, 1991, 
proposal and to propose two new sites near the mouth of the Umpqua 
River. The new sites are needed primarily to serve the longterm need 
for a location to dispose of material dredged from the Umpqua River 
navigation channel, and to provide a location for the disposal of 
dredged material for persons who have received a permit for such

found that the motor vehicle emissions budgets for 8hour ozone in the 
Eastern Kern County 8hour Ozone Early Progress Plan are adequate for 
transportation conformity purposes. On March 24, 2008, the California 
Air Resources Board submitted a revision to the California State 
Implementation Plan (SIP) containing Early Progress Plans for the 8
hour ozone standard for five California areas, including the Eastern 
Kern County nonattainment area. As a result of our adequacy finding, 
the Kern Council of Governments and the U.S. Department of 
Transportation must use these budgets in future conformity analyses 
once the finding becomes effective.

  <description><![CDATA[ EPA is proposing to approve a revision to the State 
Implementation Plan (SIP) submitted by the State of Tennessee on 
October 12, 2007. The revision pertains to the Knox County portion of 
the Tennessee SIP and includes changes to Knox County Air Quality 
Management Regulation (Knox County Regulation) Section 25.10Permit by 
Rule. Specifically, Section 25.10 was changed so that it clearly states 
that turbines and other internal combustion engines are excluded from 
the ``Permit by Rule'' provision. This revision is considered by the 
Tennessee Department of Environment and Conservation (TDEC), to be as 
or more stringent than the State of Tennessee's SIP requirements. This 
action is being taken pursuant to section 110 of the Clean Air Act  (CAA).</p><p>    In the Final Rules section of this Federal Register, EPA is 
approving the SIP revision as a direct final rule without prior 
proposal because the Agency views this as a noncontroversial submittal

proposing to authorize the State's changes. We are proposing to 
authorize the renumbering and revision of Wisconsin's previously

a proposed administrative settlement agreement and order on consent 
(``Settlement Agreement'') with Atlantic Richfield Company 
(``Respondent'') concerning the Leviathan Mine Superfund Site in Alpine 
County, California (``Site''). Section 122(h) of CERCLA, 42 U.S.C. 
9622(h), provides EPA with the authority to enter into administrative 
settlements for claims for costs incurred by EPA under CERCLA.
</p><p>    The Settlement Agreement resolves certain claims under Sections 106 
and 107 of CERCLA, 42 U.S.C. 9606, 9607. Under the Settlement 
Agreement, Respondent will perform certain response actions at the Site 
through July 31, 2013, pay over $1.7 million to reimburse the United 
States for certain past costs, pay certain future response costs, pay a

Underground Injection Control Program; Petition To Renew  Exemption From Hazardous Waste Disposal Restrictions to the]]></title>

  <description><![CDATA[ Notice is hereby given that renewal of an exemption to the 
Land Disposal Restrictions under the 1984 Hazardous and Solid Waste 
Amendments to the Resource Conservation and Recovery Act has been 
granted to Occidental Chemical Corporation (Occidental) for five Class 
I hazardous waste injection wells, identified as Well Nos. 3, 4, 7, 8, 
and 9, and located at Occidental's chemical manufacturing facility near 
Wichita, Kansas. As required by Code of Federal Regulations (CFR) Part 
148, Occidental has satisfactorily demonstrated to the Environmental 
Protection Agency by petition and supporting documentation that, to a 
reasonable degree of certainty, there will be no migration of hazardous 
constituents from the injection zone for as long as the waste remains 
hazardous, and therefore is protective of underground sources of 
drinking water. This time period is defined by 40 CFR 148.20 as 10,000

  <description><![CDATA[ The Environmental Protection Agency (EPA or the Agency) is  providing notice that it has responded to a petition for <br/>
reconsideration of the final rule, ``Regulation of OilBearing 
Hazardous Secondary Materials from the Petroleum Refining Industry 
Processed in a Gasification System to Produce Synthesis Gas'', 
published at 73 FR 57 (January 2, 2008). The EPA considered the 
petition along with information contained in the rulemaking docket in 
reaching a decision on the petition. EPA Assistant Administrator Susan 
Parker Bodine denied the petition for reconsideration in a letter to 
the petitioners issued in November 2008. The letter explains EPA's 
reasons for the denial. Section 7006(a) of the Resource Conservation 
and Recovery Act (RCRA) states, in pertinent part, that judicial review 
of the denial of any petition for the amendment or repeal of any 
regulation under the Act may be filed only in the United States Court 
of Appeals for the District of Columbia Circuit within 90 days of the 
denial.

  <title><![CDATA[
Renewable Fuel Standard for 2009, Issued Pursuant to Section  211(o) of the Clean Air Act]]></title>

  <description><![CDATA[ Section 211(o) of the Clean Air Act (CAA or the Act) requires 
the Administrator of the Environmental Protection Agency (EPA) to 
annually determine a renewable fuel standard (RFS) which is applicable 
to refiners, importers and certain blenders of gasoline, and publish 
the standard in the Federal Register. On the basis of this standard, 
each obligated party determines the volume of renewable fuel that it 
must ensure is consumed as motor vehicle fuel. This standard is 
calculated as a percentage, by dividing the amount of renewable fuel 
that the Act requires to be used in a given year by the amount of 
gasoline expected to be used during that year, including certain 
adjustments specified by the Act. In this notice we are publishing an 
RFS of 10.21% for 2009. This standard is intended to lead to the use of 
11.1 billion gallons of renewable fuel in 2009, as required by the 
Energy Independence and Security Act of 2007 (EISA). As discussed

Revised National Pollutant Discharge Elimination System Permit  Regulation and Effluent Limitations Guidelines for]]></title>

  <description><![CDATA[ Under the Federal Water Pollution Control Act (Clean Water Act 
or CWA), EPA is revising the National Pollutant Discharge Elimination 
System (NPDES) permitting requirements and Effluent Limitations 
Guidelines and Standards (ELGs) for concentrated animal feeding 
operations (CAFOs) in response to the order issued by the U.S. Court of 
Appeals for the Second Circuit in Waterkeeper Alliance et al. v. EPA, 
399 F.3d 486 (2d Cir. 2005). This final rule responds to the court 
order while furthering the statutory goal of restoring and maintaining 
the nation's water quality by ensuring that CAFOs properly manage  manure generated by their operations.</p><p>    This final rule revises several aspects of EPA's current 
regulations governing discharges from CAFOs. EPA is modifying the 
requirement to apply for a permit by specifying that an owner or 
operator of a CAFO that discharges or proposes to discharge must apply 
for an NPDES permit. The final rule also includes an option for an

on the proposed rule were to be submitted by November 20, 2008. On 
November 12, 2008, EPA received a court order extending the deadline 
for signature of the notice of final rulemaking to May 15, 2009, and we 
are extending the public comment period on the proposed rule to January 
5, 2009.

and process for awarding funding, the allocation system for 
distribution of funding, and terms and reporting under these grants. 
EPA has consulted with state and tribal officials in developing this  guidance.</p><p>    The primary goal of this funding is to ensure that state and tribal 
response programs include, or are taking reasonable steps to include, 
certain elements and a public record. Another goal is to provide 
funding for other activities that increase the number of response 
actions conducted or overseen by a state or tribal response program. 
This funding is not intended to supplant current state or tribal 
funding for their response programs. Instead, it is to supplement their  funding to increase their response capacity.<br/>

Petition for Rulemaking Requesting EPA Regulate Nanoscale Silver  Products as Pesticides; Notice of Availability]]></title>

petition for rulemaking and collateral relief filed by the 
International Center for Technology Assessment (ICTA) and others. In 
general, the petition requests that the Agency classify nanoscale 
silver as a pesticide, require formal pesticide registration of all 
products containing nanoscale silver, analyze the potential human 
health and environmental risks of nanoscale silver, take regulatory 
actions under the Federal Insecticide, Fungicide, and Rodenticide Act 
(FIFRA) against existing products that contain nanoscale silver, and 
take other regulatory actions under FIFRA as appropriate for nanoscale 
silver products. The Agency has determined that the petition raises

Eligibility Decision (REDs) for the pesticides chromated arsenicals 
(e.g., CCA), pentachlorophenol, and creosote, collectively referred to 
as ``heavy duty wood preservatives.'' The Agency's risk assessments and 
other related documents also are available in the chromated arsenicals, 
pentachlorophenol, and creosote Dockets. The term heavy duty wood 
preservative is used to differentiate wood preservatives applied using 
specialized high pressure treatment cylinders (also called ``retorts'') 
from those applied using nonspecialized methods (e.g., brush, dip). 
The three wood preservatives are used primarily for industrial purposes 
such as utility poles, pilings, and railroad ties. EPA has reviewed the 
heavy duty wood preservatives through the public participation process 
that the Agency uses to involve the public in developing pesticide 
reregistration and tolerance reassessment decisions. Through these

Unified Air Pollution Control District (GBUAPCD) portion of the 
California State Implementation Plan (SIP), and limited approval and

Control District (KCAPCD) and Mohave Desert Air Quality Management 
District (MDAQMD) portions of the SIP. These revisions concern 
particulate matter (PM) emissions from fugitive dust sources. We are 
proposing action on local rules that regulate these emission sources 
under the Clean Air Act as amended in 1990 (CAA or the Act). We are 
taking comments on this proposal and plan to follow with a final 
action.

Approval and Promulgation of Air Quality Implementation Plans;  Pennsylvania; Redesignation of the Pittsburgh-Beaver]]></title>

  <description><![CDATA[ EPA is withdrawing the proposed rule to approve a 
redesignation request and a maintenance plan State Implementation Plan 
(SIP) revision submitted by the Commonwealth of Pennsylvania. In a 
proposed rule published on July 11, 2007, EPA proposed to approve a 
request that the PittsburghBeaver Valley, Pennsylvania, ozone 
nonattainment area (the Pittsburgh Area) be redesignated as attainment 
for the 8hour ozone national ambient air quality standard (NAAQS) that 
was promulgated on July 18, 1997. In conjunction with the proposed 
action on the redesignation request, we also proposed to approve a 
maintenance plan for the Pittsburgh Area that provides for continued 
attainment of the 8hour ozone NAAQS for at least 10 years after 
redesignation, and, to approve a 2002 base year inventory for the 
Pittsburgh Area. On May 29, 2008, the Pennsylvania Department of 
Environmental Protection (PADEP) submitted a letter to formally 
withdraw the redesignation request and the maintenance plan SIP 
revision.

published on September 15, 2008. The direct final rule would have 
removed from the Code of Federal Regulations a rule that EPA 
promulgated in 1996 making provisions of the federal antidegradation 
policy directly applicable for all waters of the United States within 
the Commonwealth of Pennsylvania. EPA published the direct final rule 
with a parallel proposal to remove the federal antidegradation rule as 
it applies to waters in Pennsylvania. In a separate action today, EPA 
is also reopening the comment period of the proposed rule to ensure 
all parties have adequate opportunity to express their views to the 
Agency prior to taking final action on the proposed rule.

growing crops only under 40 CFR 180.920. Associated Octel Company, 
Limited, submitted a petition to EPA under the Federal Food, Drug, and 
Cosmetic Act (FFDCA), as amended by the Food Quality Protection Act of 
1996 (FQPA), requesting an exemption from the requirement of a 
tolerance. This regulation eliminates the need to establish a maximum 
permissible level for residues of (S,S)Ethylenediaminedisuccinic acid.

Pennsylvania. EPA is reopening the comment period for the proposed 
rule to ensure all parties have adequate opportunity to express their 
views to the Agency prior to taking final action on the proposed rule. 
The original comment period for the proposed rule closed on October 15, 
2008. In a separate action published in today's final rule section of 
the Federal Register, EPA is withdrawing a direct final rule that EPA 
also published on September 15, 2008, removing the federal regulation 
that made provisions of EPA's antidegradation policy directly 
applicable to waters in Pennsylvania.

National Primary Drinking Water Regulations: Minor Correction to  Stage 2 Disinfectants and Disinfection Byproducts]]></title>

  <description><![CDATA[ In this action, EPA is proposing to make a minor correction to 
the Stage 2 Disinfectants and Disinfection Byproducts Rule (DBPR) and 
make minor, unrelated, changes in references to expedited, alternative 
methods and other analytical methods in the regulations. EPA 
promulgated the Stage 2 Disinfectants and Disinfectant Byproducts Rule 
on January 4, 2006. A requirement for ground water systems serving 500
9,999 people was unintentionally excluded from the final rule. As a 
result, the rule allowed for less routine compliance monitoring than 
intended for this category of Public Water Systems (PWSs). These PWSs 
should have been required to monitor for both total trihalomethanes 
(TTHM) and haloacetic acids (HAA5) concentrations at two locations. Due 
to the error, they were only required to monitor for either TTHM or 
HAA5 at two locations. EPA is also proposing to make minor, unrelated 
changes in the CFR by adding references to the list of methods approved

and written comment on the California Air Resources Board's request for 
an authorization of its regulations for fleets that operate nonroad, 
diesel fueled equipment with engines 25 horsepower (hp) and greater and 
that require such fleets to meet fleet average emissions standards for 
oxides of nitrogen and particulate matter, or, alternatively, to comply 
with best available control technology requirements for the vehicles in 
those fleets. This previous announcement occurred on October 7, 2008, 
at 72 FR 58385. By this notice EPA is announcing an extension of the 
written comment period from November 28, 2008 to December 19, 2008.

Stay of Effectiveness of Control Measure Regulating Dust  Emissions at the Four Corners Power Plant; Navajo Nation]]></title>

  <description><![CDATA[ EPA is taking final action to stay the effectiveness of a 
control measure regulating dust emissions from certain operations that 
we promulgated in our Federal Implementation Plan for the Four Corners 
Power Plant located on the Navajo Nation. The control measure would 
take effect on November 5, 2008. On October 1, 2007, Arizona Public 
Service Company filed a Petition for Review claiming, inter alia, that 
EPA had not provided an adequate explanation for promulgating the 
control measure. In the litigation, EPA has agreed that the control 
measure should be remanded and vacated. EPA needs to complete this 
action staying the effectiveness of the control measure until the Court 
rules on the Petition, including the Petitioner's and EPA's requests to 
remand and vacate the control measure.
