Revisions to Rules Authorizing the Operation of Low Power  Auxiliary Stations in the 698-806 MHz Band; Public Interest]]></title>

  <description><![CDATA[ In this document, the Commission imposes a freeze on the 
filing of new license applications that seek to operate on any 700 MHz 
Band frequencies (698806 MHz) after the end of the DTV transition, 
February 17, 2009 as well as on granting any request for equipment 
authorization of low power auxiliary station devices that would operate 
in any of the 700 MHz Band frequencies. The Commission also holds in 
abeyance, until the conclusion of this proceeding, any pending license 
applications and equipment authorization requests that involve 
operation of low power auxiliary devices on frequencies in the 700 MHz 
Band after the end of the DTV transition.

Revisions to Rules Authorizing the Operation of Low Power  Auxiliary Stations in the 698-806 MHz Band; Public Interest]]></title>

  <description><![CDATA[ In this Notice of Proposed Rulemaking and Order (NPRM), to 
facilitate the DTV transition the Commission tentatively concludes to 
amend its rules to make clear that the operation of low power auxiliary 
stations within the 700 MHz Band will no longer be permitted after the 
end of the DTV transition. The Commission also tentatively concludes to 
prohibit the manufacture, import, sale, offer for sale, or shipment of 
devices that operate as low power auxiliary stations in the 700 MHz  Band. In addition, for those licensees that have obtained <br/>
authorizations to operate low power auxiliary stations in spectrum that 
includes the 700 MHz Band beyond the end of the DTV transition, the 
Commission tentatively concludes that it will modify these licenses so 
as not to permit such operations in the 700 MHz Band after February 17, 
2009. The Commission also seeks comment on issues raised by the Public 
Interest Spectrum Coalition (PISC) in its informal complaint and

Act commands us to issue certain regulations within 90 days of the NET 
911 Act's enactment. The intended effect of this action is to generate 
comment to guide the Commission when issuing those particular 
regulations.

Consumer and Governmental Affairs Bureau Seeks Comment on Liberty  Public School District Petition for Waiver of 47 CFR]]></title>

  <description><![CDATA[ In this document, the Commission seeks comment on a petition 
filed by the Liberty Public School District (LPS) for a limited waiver 
of the Commission's caller identification rules which prohibit 
terminating carriers from passing calling party number (CPN) to the 
called party where a privacy indicator has been triggered. LPS asserts 
that the security and emergency response duties of its security offices 
have been severely hampered by carriers' refusal to provide CPN, and 
requests that the Commission allow LPS to receive CPN, even where the 
calling party has activated a privacy indicator.

  <description><![CDATA[ In this document the Federal Communications Commission 
corrects an inadvertent error that occurred when the Commission adopted 
final rules for the Advanced Wireless Services in the 17101755 MHz and 
21102155 MHz bands, including provisions for application, licensing, 
operating and technical rules, and for competitive bidding. These rules 
were published in the Federal Register on Friday, February 6, 2004 (69 
FR 5711). Specifically, the error occurred in a table to the rules 
concerning interference protection at certain Federal Government 
operations in the 17101755 MHz band. As a result of this correction, 
the table will be amended as intended by the Commission.

291A at Dilley, Texas, as its fourth local FM aural transmission 
service. The reference coordinates for vacant Channel 291A at Dilley 
are 283606 NL and 990621 WL. This site is located 9.6 kilometers (6 
miles) southeast of Dilley. This site is located within 320 kilometers 
of the Mexican border. Although concurrence has been requested for 
Channel 291A at Dilley, notification has not been received. If a 
construction permit is granted prior to the receipt of formal 
concurrence in the allotment by the Mexican government, the 
construction permit will include the following condition: ``Operation 
with the facilities specified for Dilley herein is subject to 
modification, suspension or, termination without right to hearing, if

Allotments, Section 73.202(b) of the Commission's rules, 47 CFR 
73.202(b). The Commission requests comment on a petition filed by 
Prescott Valley Broadcasting Company, Inc. Petitioner proposes the 
substitution of FM Channel 247B for vacant Channel 239B at Blythe, 
California. The purpose of the requested channel substitution at Custer 
is to accommodate Petitioner's pending application to operate as a 
fullspaced Class C3 channel at Parker, Arizona. Channel 247B can be 
allotted at Blythe in compliance with the Commission's minimum distance 
separation requirements with a site restriction of 1 km (.61 miles) 
northeast of Blythe. The proposed coordinates for Channel 247B at 
Blythe are 333702 North Latitude and 1143520 West Longitude.

compensation from the Interstate TRS Fund (Fund). The Commission 
concludes that Hawk Relay has demonstrated adequately that its 
provision of IP Relay and VRS will meet or exceed all operational, 
technical, and functional TRS standards set forth in the Commission's 
rules; that it makes available adequate procedures and remedies for 
ensuring compliance with applicable Commission rules; and that to the 
extent Hawk Relay's service differs from the mandatory minimum 
standards, the service does not violate the rules.

and Response Network (WARN) Act by adopting rules that require non

will provide these licensees/permittees with the ability to enable the 
distribution of geotargeted Commercial Mobile Alert System (CMAS)  alerts to participating Commercial Mobile Service (CMS)<br/> [[Page 47551]]<br/>
providers. The Commission's stated goal is to implement section 602(c) 
in a manner consistent with the CMAS architecture and technologically 
neutral rules the Commission adopted in the CMAS First Report and

for commercial mobile service providers that elect to transmit

Allotments, Section 73.202(b) of the Commission's rules, 47 CFR 
73.202(b). The Commission requests comment on a petition filed by Roy 
E. Henderson. Petitioner proposes the substitution of FM Channel 227A 
for vacant Channel 263A at Custer, Michigan. The purpose of the 
requested channel substitution at Custer is to eliminate a short
spacing with the facilities proposed in an application to upgrade the 
facilities of Station WCUZ(FM) at Bear Lake, Michigan, from FM Channel 
261A to Channel 264C3. Channel 227A can be allotted at Custer in 
compliance with the Commission's minimum distance separation 
requirements with a site restriction of 13.1 km (8.1 miles) northeast 
of Custer. The proposed coordinates for Channel 227A at Custer are 44
0328 North Latitude and 850856 West Longitude. Concurrence by the 
Government of Canada is required for the allotment of Channel 227A at 
Custer, Michigan, because the proposed allotment is located within 320

  <description><![CDATA[ This document requests comments on a petition for rulemaking 
filed by Michael Cusinato, proposing to allot Channel 287B1 at Needles, 
California, as a fourth local service. To accommodate the proposed 
Needles allotment, Petitioner also requests the substitution of Channel 
228C2 for vacant Channel 286C2 at Ehrenberg, Arizona, and the 
substitution of Channel 286C2 for Channel 287C2 at Wickenburg, Arizona, 
and modification of the Station KHOVFM license accordingly at its 
license site. An Order to Show Cause is directed to Univision Radio 
License Corporation, licensee of Station KHOVFM to show cause why its 
license should not be modified to specify operation on Channel 286C2.

  <title><![CDATA[
Inflation Adjustment of Maximum Forfeiture Penalties ]]></title>

  <description><![CDATA[ This document increases the maximum monetary forfeiture 
penalties available to the Commission under its rules governing 
monetary forfeiture proceedings to account for inflation. The 
inflationary adjustment is necessary to implement the Debt Collection 
Improvement Act of 1996, which requires federal agencies to adjust  ``civil<br/> [[Page 44664]]<br/>
monetary penalties provided by law'' at least once every four years. 
The increase covers the period between June of the year the particular 
forfeiture amount was last set or adjusted and June 2007. The increase 
in the Consumer Price Index for the relevant period was applied to each 
maximum penalty, and then rounded using the statutorily defined rules 
to adjust each maximum monetary forfeiture penalty accordingly. The 
base forfeiture amounts in the Commission's rules remain unchanged by 
this rule revision.
