development of security related EALs. This EALFAQ was developed by the 
NRC at the request of NEI. The NRC is publishing this preliminary 
result to inform the public and solicit comments.

29, 2009. Issues encountered during the holiday season delayed

Natural Resources Defense Council; Denial of Petition for  Rulemaking]]></title>

  <description><![CDATA[ The Nuclear Regulatory Commission (NRC) is denying a petition 
for rulemaking submitted by the Natural Resources Defense Council (PRM
5090). The petitioner requested that the NRC amend the regulations 
that govern domestic licensing of highly enriched uranium (HEU) 
production and utilization facilities to establish a date when the NRC 
would no longer license the domestic use or export of HEU except for 
restricted use by a few specialized facilities. The petitioner has not 
demonstrated that existing NRC licensing, security and export 
regulations do not currently provide for reasonable assurance of 
adequate protection of the public health and safety, and the common 
defense and security of the United States.

proposed to be issued and grants the Commission the authority to issue 
and make immediately effective any amendment to an operating license

Draft Safety Culture Policy Statement: Request for Public  Comments; Extension of Comment Period]]></title>

  <description><![CDATA[ On November 6, 2009, (74 FR 57525) (ML093030375), the Nuclear 
Regulatory Commission (NRC) published for public comment a draft policy 
statement on safety culture to include the unique aspects of nuclear 
safety and security, and to note the Commission's expectations that all 
NRC licensees and certificate holders establish and maintain a positive 
safety culture that protects public health and safety and the common 
defense and security when carrying out licensed activities. The comment 
period was scheduled to expire on February 4, 2010, which coincides 
with the final day of the first of three public workshops the NRC is 
conducting to solicit input relating to the development of the safety 
culture policy statement, including: (1) development of a common safety  culture definition; and (2) development of highlevel<br/> [[Page 1657]]<br/>
description/traits of areas important to safety culture. Based on 
comments from licensees that these workshops may stimulate additional

Implementation of Open Government Directive ]]></title>

  <description><![CDATA[ In response to the Office of Management and Budget's (OMB) 
December 8, 2009, Open Government Directive, which helps to implement 
the President's January 21, 2009, Memorandum on Transparency and Open 
Government, the Nuclear Regulatory Commission (NRC) is requesting  public comment to aid the<br/> [[Page 1419]]<br/>
NRC's determination of what data sets it might be appropriate to 
publish online and what transparency, public participation, and 
collaboration improvements it might include as it drafts its Open 
Government Plan. The December 8, 2009, Directive generally instructs 
Federal agencies to identify and publish online in an open format at 
least three highvalue data sets by January 22, 2010, and an Open 
Government Plan by April 7, 2010. While the Open Government Directive, 
by its terms, does not strictly apply to independent agencies like the 
NRC, the President has stated that independent agencies should comply

Alternate Fracture Toughness Requirements for Protection Against  Pressurized Thermal Shock Events]]></title>

  <description><![CDATA[ The Nuclear Regulatory Commission (NRC) is amending its 
regulations to provide alternate fracture toughness requirements for 
protection against pressurized thermal shock (PTS) events for 
pressurized water reactor (PWR) pressure vessels. This final rule 
provides alternate PTS requirements based on updated analysis methods. 
This action is desirable because the existing requirements are based on 
unnecessarily conservative probabilistic fracture mechanics analyses. 
This action reduces regulatory burden for those PWR licensees who 
expect to exceed the existing requirements before the expiration of 
their licenses, while maintaining adequate safety, and may choose to 
comply with the final rule as an alternative to complying with the 
existing requirements.

In the Matter of: Certain Licensees Requesting Unescorted Access  to Radioactive Material; Order Imposing]]></title>

  <description><![CDATA[ I</p><p>    The Licensees identified in Attachment 1 \1\ to this Order hold 
licenses issued in accordance with the Atomic Energy Act (AEA) of 1954, 
as amended, by the U.S. Nuclear Regulatory Commission (NRC or 
Commission) or an Agreement State, authorizing them to perform services 
on devices containing certain radioactive material for customers 
licensed by the NRC or an Agreement State to possess and use certain 
quantities of the radioactive materials listed in Attachment 2 to this 
Order. Commission regulations at 10 CFR 20.1801 or equivalent Agreement 
State regulations require Licensees to secure, from unauthorized 
removal or access, licensed materials that are stored in controlled or 
unrestricted areas. Commission regulations at 10 CFR 20.1802 or 
equivalent Agreement State regulations require Licensees to control and 
maintain constant surveillance of licensed material that is in a 
controlled or unrestricted area and that is not in storage.
