  <description><![CDATA[ By letter dated January 4, 2011, Strata Energy, Inc., (Strata) 
submitted an application to the U.S. Nuclear Regulatory Commission 
(NRC) for a new source materials license for the proposed Ross InSitu 
Uranium Recovery (ISR) Project (Ross Project) proposed to be located in 
Crook County, Wyoming. The NRC is issuing for public comment a Draft 
Supplemental Environmental Impact Statement (Draft SEIS) for the Ross 
Project. The Draft SEIS is Supplement 5 to NUREG1910, ``Generic 
Environmental Impact Statement for InSitu Leach Uranium Milling 
Facilities.''

Guidance About Fixed Gauge Licenses.'' The document has been updated 
from the previous revision to include safety culture, security of 
radioactive materials, protection of sensitive information, and changes 
in regulatory policies and practices. This document is intended for use 
by applicants, licensees, and the NRC staff and will also be available 
to Agreement States.

and included Big Rock Plant. This notice corrects a notice appearing in 
the Federal Register on January 22, 2013 (78 FR 44754476), to include 
a missing facility operating license number and a missing amendment 
number. This action is necessary to include the license and amendment 
number for which the license amendment was issued.

  <description><![CDATA[ The U.S. Nuclear Regulatory Commission (NRC) is amending its 
regulations to establish security requirements for the use and 
transport of category 1 and category 2 quantities of radioactive 
material. The NRC considers these quantities to be risk significant 
and, therefore, to warrant additional protection. Category 1 and 
category 2 thresholds are based on the quantities established by the 
International Atomic Energy Agency (IAEA) in its Code of Conduct on the 
Safety and Security of Radioactive Sources, which the NRC endorses. The 
objective of this final rule is to provide reasonable assurance of 
preventing the theft or diversion of category 1 and category 2 
quantities of radioactive material. The regulations also include 
security requirements for the transportation of irradiated reactor fuel 
that weighs 100 grams or less in net weight of irradiated fuel. The 
final rule affects any licensee that possesses an aggregated category 1 
or category 2 quantity of radioactive material, any licensee that

</p><p>    Pursuant to Section 189a. (2) of the Atomic Energy Act of 1954, as 
amended (the Act), the U.S. Nuclear Regulatory Commission (the 
Commission or NRC) is publishing this regular biweekly notice. The Act 
requires the Commission publish notice of any amendments issued, or 
proposed to be issued and grants the Commission the authority to issue 
and make immediately effective any amendment to an operating license or 
combined license, as applicable, upon a determination by the Commission 
that such amendment involves no significant hazards consideration, 
notwithstanding the pendency before the Commission of a request for a  hearing from any person.</p><p>    This biweekly notice includes all notices of amendments issued, or 
proposed to be issued from February 21, 2013, to March 6, 2013. The 
last biweekly notice was published on March 4, 2013 (78 FR 14126).

  <title><![CDATA[License Amendment Request:]]></title>

  <description><![CDATA[ In November 2012, URENCO USA submitted to the U.S. Nuclear 
Regulatory Commission (NRC) a license amendment request. The existing 
license (No. SNM2010) authorizes operation of a uranium enrichment 
facility in New Mexico. The facility produces enriched uranium up to a 
maximum of 5.0 percent U235, using a gas centrifuge process. If 
granted, the license amendment would authorize increased annual 
production capability from the present 3 million separative work units 
(SWU) to 10 million SWU.

  <title><![CDATA[List of Approved Spent Fuel Storage Casks:]]></title>

  <description><![CDATA[ The U.S. Nuclear Regulatory Commission (NRC) is amending its 
spent fuel storage regulations by revising the NAC International, Inc. 
(NAC) Modular Advanced Generation Nuclear Allpurpose Storage 
(MAGNASTOR[supreg]) System listing within the ``List of Approved Spent 
Fuel Storage Casks'' to include Amendment No. 3 to Certificate of 
Compliance (CoC) No. 1031. Amendment No. 3 revises authorized contents 
to include: Pressurized water reactor (PWR) damaged fuel contained in 
damaged fuel (DF) cans that are placed in a damaged fuel basket 
assembly; PWR fuel assemblies with nonfuel hardware per the expanded 
definition in the Amendment No. 3 application; and PWR fuel assemblies 
with up to five activated stainless steel fuel replacement rods at a 
maximum burnup/exposure of 32.5 gigawatt days per metric ton of uranium 
(GWd/MTU). Additionally, Amendment No. 3 revises paragraph 4.3.1(i) in 
appendix A of the CoC Technical Specifications (TS) to clarify that the

Approved Spent Fuel Storage Casks'' to include Amendment No. 3 to 
Certificate of Compliance (CoC) No. 1031. Amendment No. 3 includes 
changes that would revise authorized contents to include: pressurized 
water reactor (PWR) damaged fuel contained in damaged fuel cans that 
are placed in a damaged fuel basket assembly; PWR fuel assemblies with 
nonfuel hardware per the expanded definition in the Amendment No. 3 
application; and PWR fuel assemblies with up to five activated 
stainless steel fuel replacement rods at a maximum burnup/exposure of 
32.5 gigawatt days per metric ton of uranium (GWd/MTU). Additionally,

amend the licensing, inspection, and annual fees charged to its 
applicants and licensees. The proposed amendments are necessary to 
implement the Omnibus Budget Reconciliation Act of 1990 (OBRA90), as 
amended, which requires the NRC to recover through fees approximately 
90 percent of its budget authority in Fiscal Year (FY) 2013, not 
including amounts appropriated for Waste Incidental to Reprocessing 
(WIR) and amounts appropriated for generic homeland security 
activities. The NRC is currently operating under a Continuing 
Resolution (CR) which is set to expire on March 27, 2013. Based on the 
FY 2013 budget submitted to the Congress, the NRC is proposing fees in 
this rulemaking based on the FY 2013 budget which is estimated to be 
$1,053.2 million. After accounting for billing adjustments, the total 
amount to be billed as fees is approximately $924.8 million. These fees

in the NRC's Enforcement Program for cases involving discrimination and 
other wrongdoing after the NRC's Office of Investigations has completed 
an investigation substantiating the allegation. The pilot ADR Program 
will expand postinvestigation ADR to include all escalated nonwillful 
(traditional) enforcement cases with proposed civil penalties (this 
will not include violations associated with findings assessed through  the Reactor Oversight Process (ROP) \1\).<br/>

part 54 of Title 10 of the Code of Federal Regulations (10 CFR), to 
renew operating licenses DPR77 and DPR79. A notice of receipt and 
availability of the license renewal application (LRA) was published in  the Federal Register on February 22, 2013 (78 FR 12365).</p><p>    The Commission's staff has determined that TVA has submitted 
sufficient information in accordance with 10 CFR 54.19, 54.21, 54.22, 
54.23, 51.45, and 51.53(c), to enable the staff to undertake a review 
of the application, and that the application is therefore acceptable 
for docketing. The current Docket Numbers, 50327 and 50328, for 
operating license numbers DPR77, DPR79, respectively, will be

</p><p>    FirstEnergy Nuclear Operating Company (FENOC, the licensee) is the 
holder of Renewed Facility Operating License Nos. DPR66 and NPF73 
issued by the U.S. Nuclear Regulatory Commission (NRC) pursuant to part 
50 of Title 10 of the Code of Federal Regulations (10 CFR), ``Domestic 
Licensing of Production and Utilization Facilities,'' on November 5, 
2009. The licenses authorize the operation of the Beaver Valley Power 
Station, Units 1 and 2 (Beaver Valley, facility), in accordance with 
conditions specified therein. The facility is located on the licensee's  site in Shippingport, Pennsylvania.</p>
<h3>II</h3>
<p>    On December 22, 2005, FENOC notified the NRC of its intent to 
transition the facility to the National Fire Protection Association 
(NFPA) Standard 805 fire protection program in accordance with 10 CFR 
50.48(c). Under this initiative, the NRC has exercised enforcement

public comment a notice of receipt for a petition for rulemaking (PRM), 
dated October 3, 2012, which was filed with the NRC by Anthony R. 
Pietrangelo on behalf of the Nuclear Energy Institute (NEI or the 
petitioner). The petition was docketed by the NRC on October 18, 2012, 
and assigned Docket No. PRM727. The petitioner requests that the NRC 
add a new rule that governs the format and content of spent fuel 
storage cask Certificates of Compliance (CoCs), extend the backfit rule 
to CoCs, and make other improvements that result in ``more efficient 
and effective NRC oversight of dry cask storage activities as well as 
improved implementation of dry cask storage requirements by industry.''

Materials, Metallurgy and Reactor Fuels will hold a meeting on February

  <title><![CDATA[Early Site Permits and Conforming Amendments; Approvals:]]></title>

</p><p>    Virginia Electric and Power Company, doing business as Dominion 
Virginia Power (DVP), and Old Dominion Electric Cooperative (ODEC), 
hold Early Site Permit 003 (ESP003) for North Anna Site issued on 
November 27, 2007, pursuant to section 52.24 of Title 10 of the Code of 
Federal Regulations (10 CFR) ``Issuance of Early Site Permit.'' The  permit expires on November 27, 2027.</p>
<h3>II</h3>
<p>    By application dated March 1, 2012, DVP requested, on its own 
behalf and behalf of ODEC, pursuant to 10 CFR 50.80, that the U.S. 
Nuclear Regulatory Commission (NRC) consent to the transfer of ODEC's 
undivided ownership interest in ESP003 from ODEC to DVP, with DVP 
becoming the sole permit holder. As a result of this transfer, DVP will 
assume all of ODEC's rights and obligations, including all rights and  obligations under the ESP.</p><p>    A notice entitled, Approval of Transfer of Early Site Permit (ESP)

2012, the licensee conducted a Final Status Survey (FSS) in the soils 
of the building footprint per the NRC reviewed FSS Plan. The Class 1 
survey unit consisted of the exposed soils in the building footprint 
and the Class 2 survey unit was the immediate area surrounding the  excavation area.</p><p>    The U of IL submitted the FSS report with the request for license 
termination for the ATR on October 9, 2012 (ADAMS Accession No. 
ML12345A245). The NRC reviewed the FSS report and determined that the 
survey data was in accordance with the Decommissioning Plan and the FSS 
Plan. The report documented that compliance with the criteria in the 
NRCapproved decommissioning plan for both reactors had been  demonstrated.</p><p>    Additionally, a confirmatory survey including soil samples and a 
gamma walkover survey was completed by the NRC Region III staff. Their 
conclusions, as noted in the NRC's Inspection Report 05000151/12005

</p><p>    Nine Mile Point 3 Nuclear Project, LLC, and UniStar Nuclear 
Operating Services, LLC (UniStar), submitted a Combined License (COL) 
Application for a single unit of AREVA NP's U.S. EPR to the U.S. 
Nuclear Regulatory Commission (NRC) in accordance with the requirements 
of Title 10 of the Code of Federal Regulations (10 CFR), subpart C of 
part 52, ``Licenses, Certifications, and Approvals for Nuclear Power 
Plants.'' This reactor is to be identified as Nine Mile Point 3 Nuclear 
Power Plant (NMP3NPP), and located adjacent to the current Nine Mile 
Point Nuclear Station, Unit 1 and Unit 2, in Oswego County, New York. 
The NMP3NPP COL application incorporates by reference AREVA NP's 
application for a Standard Design Certification for the U.S. EPR. 
Additionally, the NMP3NPP COL application is based upon the U.S. EPR 
reference COL (RCOL) application for UniStar's Calvert Cliffs Nuclear 
Power Plant, Unit 3 (CCNPP3). The NRC docketed the NMP3NPP COL

fuel are separate from requirements for storage of spent nuclear fuel. 
Because these regulatory schemes are separate, there is no requirement 
that loaded storage casks also meet transportation requirements. 
Integration of storage and transport regulations could enable a more 
predictable transition from storage to transport by potentially 
minimizing future handling of spent fuel and uncertainty as to whether 
loaded storage casks may be transported from the storage location. As 
part of its evaluation of integration and compatibility between storage 
and transportation regulations, the U.S. Nuclear Regulatory Commission 
(NRC) staff is reviewing its policies, regulations, guidance, and 
technical needs in several key areas, such as: retrievability, cladding 
integrity, and safe handling of spent fuel; criticality safety features

its authority under Section 161A. The NRC is now proposing to further 
revise its regulations that address the voluntary application for 
enhanced weapons authority, preemption authority, and the mandatory 
firearms background checks under Section 161A to include as a class of 
designated facilities atreactor, independent spent fuel storage 
installations (ISFSIs).

</p><p>    Energy Northwest (the licensee) is the holder of Renewed Facility 
Operating License No. NPF21, which authorizes operation of the 
Columbia Generating Station. The license provides, among other things, 
that the facility is subject to all rules, regulations, and orders of 
the U.S. Nuclear Regulatory Commission (NRC, the Commission) now or  hereafter in effect.</p><p>    The facility consists of a boilingwater reactor located in Benton  County in the state of Washington.</p>
<h3>2.0 Request/Action</h3>
<p>    The regulations in paragraph 50.36a(a)(2) of Title 10 of the Code 
of Federal Regulations (10 CFR), require a radioactive effluent release 
report for each commercial nuclear power plant to be submitted annually 
such that the time between submission of any two reports is not longer  than 12 months.</p><p>    The licensee's Technical Specification (TS) 5.6.2, ``Radioactive 
Effluent Release Report,'' requires the Annual Radioactive Effluent 
Release Report (ARERR) to be submitted in accordance with 10 CFR 50.36a

regulatory guide (RG) 4.22, ``Decommissioning Planning During 
Operations.'' The guide describes a method that the NRC staff considers 
acceptable for use by holders of licenses in complying with the NRC's 
Decommissioning Planning Rule (DPR) (76 FR 35512; June 17, 2011). The 
DPR went into effect on December 17, 2012, and is intended to minimize 
the likelihood of new ``legacy sites,'' which are NRClicensed 
facilities with insufficient resources to complete decommissioning 
activities and termination of a license at the end of operations.
